Updated: New Trial for Ray Tensing? Prosecutor to Decide Today

Update: Hamilton County Prosecuting Attorney Joseph Deters said during a morning press conference that he will retry Ray Tensing who was accused of murder in a fatal shooting during a traffic stop last year.  Deter’s office will be seeking a change of venue, citing the trial’s intense media scrutiny and social media publicity.  A hearing on the case is scheduled for Nov. 28 before Hamilton County Judge Megan Shanahan.

 

Hamilton County Ohio:  The prosecutor will announce today whether there will be a new trial for Ray Tensing, a former police officer, after a mistrial was declared Nov. 12.   Tensing was accused of murder and voluntary manslaughter in the July 2015 traffic stop shooting of Sam DuBose.

Jurors had deliberated about 25 hours in the first trial but could not reach a verdict.

DuBose family members, the Cincinnati City Council and others pressed for a new murder trial.

To convict Tensing, of murder, jurors had to find he purposely killed DuBose, 43.  That charge carries a possible sentence of 15 years to life in jail.

The voluntary manslaughter charge means the killing happened during sudden passion or a fit of rage with a possible sentence of three to 11 years.
