Tex McIver, 63, is charged with misdemeanor reckless conduct and felony involuntary manslaughter in connection with his wife’s death.
Diane McIver was shot through the seat of the couple’s SUV as they were driven by a friend near Piedmont Park in September 2016. She later died at the hospital.
According to police, Diane McIver was shot while sitting in the passenger seat of her Ford Expedition the evening of Sept. 25. Her husband, attorney Tex McIver, was sitting directly behind her in the backseat.
Diane McIver’s best friend of thirty years, whom he only identified as Dani Jo, was driving.
The three were on their way back to Atlanta’s Buckhead community from the McIver’s farm in Putnam County.
Tex McIver’s criminal defense attorney, Stephen Maples said the couple kept a revolver in the car’s center console, wrapped in a bag.
It is not known why Diane handed her husband the gun, but he did say it went off while still inside the bag.
Atlanta police spent nearly three months investigating the claim that the 38-caliber revolver on Tex McIver’s lap accidentally fired, killing his wife.
