In June, a jury found the former NFL tight end Kellen Winslow guilty of the May 2018 rape of an Encinitas homeless woman he had befriended, but the jury deadlocked on several other charges. Those are the focus of his retrial.

The jury in June also found Winslow guilty of two misdemeanors: indecent exposure for flashing a 57-year-old-neighbor in May 2018 and lewd act targeting a 77-year-old woman at a Carlsbad gym in February. The gym incident happened while Winslow was free on bail and awaiting trial in the rape case.

The jury deadlocked – in favor of conviction – on eight other charges, including the alleged rapes of the hitchhiker in March 2018 and of a teen girl at a San Diego house party in 2003, when Winslow was 19.

No matter the outcome of this retrial, the convictions for rape, indecent exposure and a lewd act stand.

If the jury finds him guilty of raping a second woman, Winslow faces a potential sentence of life in prison.

Sentencing on the charges he was found guilty of in the first trial is on hold pending the outcome of this retrial.

Background

Kellen Winslow was charged with felonies of sexual assault on the same homeless woman twice as two counts of forcible rape, plus first-degree burglary, two counts of kidnapping with intent to commit rape, one count of forcible oral copulation, one count of forcible sodomy, one count of indecent exposure and two counts of residential burglary.

In addition, he had misdemeanor charges of elder abuse, battery of an elderly person, and lewd conduct.

Winslow was initially arrested in 2018 after authorities said they had tied him to two alleged break-ins in Encinitas, one at the home of a 71-year-old woman on June 1 and another at the residence of an 86-year-old woman on June 7.

After posting bail, Winslow was arrested again on the additional charges of raping two women, a 54-year-old woman in March 2018 and a 59-year-old woman in May 2018.

Both women were attacked in Encinitas. He is accused of kidnapping the 54-year-old.

Also in May of 2018, a 57-year-old woman accused Winslow of exposing himself to her.

Another woman stepped forward to say she had been attacked by him when she was 17, according to the investigation.

While he was out on $2-million bail, Winslow was arrested on suspicion of lewd conduct in front of a 77-year-old woman at a gym on two separate occasions in February of this year. He has been jailed since without bail.
