Jennifer Adkins and several women and doctors have a lawsuit against the state of Idaho over the state's near-total abortion ban claiming that the ban has harmed them. The plaintiffs include four women who were denied abortions in Idaho and sought care elsewhere. They argue that the laws are enforced at the expense of Idaho women. A grim and explicit argument is being made by attorneys representing the state, which has faced numerous lawsuits over abortion since the U.S. Supreme Court overturned national abortion protections in 2022, triggering Idaho laws that restricted the procedure. The plaintiff say that 'the critical question is: Who should be able to receive abortions under the medical exceptions'? And say that 'two years after the laws were passed, no one has offered an answer'. Adkins has claimed that she was unable to get an abortion in Idaho so long as her baby had a heartbeat causing her to feel devastated. Her baby had multiple severe anomalies that affected several different organ systems and would not survive the pregnancy. After being denied an abortion, days later she went to Seattle for the abortion, where she attended procedures alone while her husband stayed with their toddler at a nearby hotel. Doctors claim they have had to delay patient care and deny treatment out of concern for breaking the law and describe the situation as 'perilous confusion' that forces health care professionals to flout their obligations and put patients at risk. |
