Today in UK JCPC Supreme Court Lord Neuberger, Lord Kerr, Lord Reed, Lord Hughes and Dame Mary Arden will hear the case of Smith (Personal Representative of Hugh Smith (Deceased) and others (Appellants) v Molyneaux (Respondent) (British Virgin Islands). At issue is Whether the Court of Appeal was correct to set aside an order granting possession of part of the appellants' land occupied by the respondent, on the basis that the respondent had been in adverse possession of the land for over 12 years.
