BMC Construction Inc. Vs Brian Richmond and Tracey Thompson

BMC Construction Inc. were engaged by Brian Richmond and Tracey Thompson who had purchased a 40 or 50 year old house for $800,000 in the Sandy Springs area. They had an architect who drew up plans to do some remodelling. BMC looked at the plan and provided a detailed estimated cost for what the repairs would be. It was a large job and some materials were purchased by Brian and Tracey that BMC would install. BMC have been in business for 40 years and are owned by Lambel Patterson. His company is a remodelling company that uses licenced contractors to do the work. The estimated cost of the work was $567,360 which Brian, Tracey and their architect agreed to the work but there was never a signed contract put in place. No deposit was required before the work commenced. There were some changes to the original plan and the planned 6 to 9 month job would likely take a little longer. Brian and Tracey were renting a property nearby and were keen to move into their property. The revised completion was February 2022. However, that completion date could not be met but none the less Brian and Tracey moved in. As worked progressed, BMC submitted a monthly costs invoice due upon receipt for $71,465. Brian and Tracey requested the details of the invoice which BMC then supplied. But when the invoice submitted on March 1, 2023 for $176,690 which included the amounts from the December invoices that Brian and Tracey had not paid. Those invoices were for December 1 ($71,000 and December 16 ($46,000), even though the invoices were for work and material costs incurred. So $176,690 (with some adjustment) is the amount BMC are seeking in this lawsuit. Brian and Tracey claim they were dissatisfied with the work and following exchanges of emails they prohibited BMC from bringing the sub-contractors from coming back to fix the alleged complaints. So BMC have adjusted their amount downward for the work not done to fix any complaints and have added interest amounts for the amounts not paid to date. Brian and Tracey have a counter claim..
