{"id":9960,"date":"2017-12-10T08:31:51","date_gmt":"2017-12-10T13:31:51","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=9960"},"modified":"2017-12-10T08:31:51","modified_gmt":"2017-12-10T13:31:51","slug":"making-murderer-court-upholds-brendan-dassey-conviction","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2017\/12\/10\/making-murderer-court-upholds-brendan-dassey-conviction\/","title":{"rendered":"Making a Murderer: Court upholds Brendan Dassey conviction"},"content":{"rendered":"<p class=\"story-body__introduction\">A US appeals court has upheld the conviction of Brendan Dassey, whose case was the focus of the Netflix documentary Making a Murderer.<\/p>\n<p>Dassey and his uncle Steven Avery were convicted of murdering a young woman, , in 2005.<\/p>\n<p>Last year, Dassey&#8217;s conviction was overturned on the basis that his confession was coerced.<\/p>\n<p>But the state asked for a review and, on Friday, judges voted 4-3 that Dassey&#8217;s confession was voluntary.<\/p>\n<p>The split decision from the Seventh Circuit Court of Appeals, which is based in Chicago, is a big blow for the 27-year-old&#8217;s hopes of being freed.<\/p>\n<p>One of the judges, who voted that Dassey&#8217;s confession was not voluntary, told the Chicago-Sun Times:\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/chicago.suntimes.com\/news\/making-a-murderer-defendant-confession-stands-appellate-court-decision-brendan-dassey\/\" target=\"_blank\" rel=\"noopener\">&#8220;His confession was not voluntary and his conviction should not stand. I view this as a profound miscarriage of justice.&#8221;<\/a><\/p>\n<p>His confession, made when he was 16, was a key factor in his conviction. He admitted helping his uncle Avery &#8211; who had already served 18 years for a crime he did not commit &#8211; rape, kill and mutilate Ms Halbach.<\/p>\n<figure id=\"attachment_9961\" aria-describedby=\"caption-attachment-9961\" style=\"width: 428px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2017\/12\/Steven-Avery.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-9961\" src=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2017\/12\/Steven-Avery.jpg\" alt=\"Steven Avery\" width=\"428\" height=\"304\" srcset=\"https:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2017\/12\/Steven-Avery.jpg 428w, https:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2017\/12\/Steven-Avery-300x213.jpg 300w\" sizes=\"auto, (max-width: 428px) 100vw, 428px\" \/><\/a><figcaption id=\"caption-attachment-9961\" class=\"wp-caption-text\">Dassey said he and his uncle Steven Avery (pictured) killed a photographer in 2005.<\/figcaption><\/figure>\n<p>He was sentenced to life in prison, but the documentary filmmakers cast doubt on the legal process used to convict him.<\/p>\n<p>In 2016, Judge William Duffin ordered he be freed immediately after finding that investigators in the 2007 trial made &#8220;repeated false promises&#8221; to Dassey by assuring him &#8220;he had nothing to worry about&#8221;.<\/p>\n<p>When considered with &#8220;Dassey&#8217;s age, intellectual deficits, and the absence of a supportive adult&#8221;, he considered the confession coerced.<\/p>\n<p>But the decision in Chicago on Friday has overturned Judge Duffin&#8217;s ruling.
