{"id":8298,"date":"2017-06-30T08:07:58","date_gmt":"2017-06-30T12:07:58","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=8298"},"modified":"2017-06-30T08:07:58","modified_gmt":"2017-06-30T12:07:58","slug":"french-bank-bnp-paribas-accused-complicity-rwandan-genocide","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2017\/06\/30\/french-bank-bnp-paribas-accused-complicity-rwandan-genocide\/","title":{"rendered":"French bank BNP Paribas accused of complicity in Rwandan genocide"},"content":{"rendered":"<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/F-gnj4G6eEU\" width=\"652\" height=\"367\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>France\u2019s largest bank is facing serious accusations after three NGOs on Thursday said they filed legal action against BNP Paribas alleging \u201ccomplicity in genocide, war crimes and crimes against humanity\u201d during Rwanda\u2019s 1994 genocide.<\/p>\n<p>The suit alleges Banque Nationale de Paris (BNP), as the bank was known before its merger with Paribas in 2000 to become <a href=\"http:\/\/www.france24.com\/en\/tag\/bnp-paribas\/\" target=\"_blank\" rel=\"noopener\">BNP Paribas<\/a>, \u201cparticipated in financing the purchase of 80 tonnes of arms that served to perpetrate the genocide\u201d despite the fact, it claims, \u201cthat the bank could not have doubted the genocidal intentions of the authorities of the country for which it authorized the transfer\u201d of funds. The groups note that a <a href=\"http:\/\/www.france24.com\/en\/tag\/united-nations\/\" target=\"_blank\" rel=\"noopener\">United Nations<\/a> arms embargo was in effect at the time.<\/p>\n<p>The genocide in the tiny central African country claimed 800,000 lives, mostly from <a href=\"http:\/\/www.france24.com\/en\/tag\/rwanda\/\" target=\"_blank\" rel=\"noopener\">Rwanda<\/a>\u2019s ethnic Tutsi minority, between April and July 1994.<\/p>\n<p>The three NGOs leading the charge are Sherpa, an anti-corruption group that defends victims of economic crimes, Ibuka France, an association that defends survivors of the genocide, and the Collective of Civil Parties for Rwanda (CPCR), a group based in France that pursues claims against genocide suspects. Sherpa earned headlines recently when it filed <a href=\"http:\/\/www.france24.com\/en\/20170613-france-judicial-inquiry-lafargeholcim-syria-terrorism-jalabiya\" target=\"_blank\" rel=\"noopener\">a lawsuit against the Swiss-French cement giant LafargeHolcim<\/a> alleging the company financed Islamic State group in Syria.<\/p>\n<p>In their complaint against BNP, the NGOs claim the bank \u201cauthorised two transfers of funds [totalling more than $1.3 million] on June 14 and 16, 1994, from the account that the National Bank of Rwanda held with BNP towards an account at the Swiss bank UBP\u201d held under the name of Willem Tertius Ehlers. The group\u2019s complaint says Ehlers, a South African national and former secretary to South African leader P.W. Botha, owned an arms brokerage firm called Delta Aero at the time.<\/p>\n<p>The suit claims Ehlers and Rwandan Hutu colonel Th\u00e9oneste Bagosora concluded an arms sale in the Seychelles on the day after the second transfer of funds. It says the weapons were officially purchased by Zaire, as the <a href=\"http:\/\/www.france24.com\/en\/tag\/dr-congo\/\" target=\"_blank\" rel=\"noopener\">Democratic Republic of Congo<\/a> was then known, but with two Rwandans in the delegation that travelled to the Seychelles. The groups cite testimony given by Bagosora himself before the International Criminal Tribunal for Rwanda describing the transfer of weapons from the Seychelles to Goma, on Zaire\u2019s border with Rwanda, and then into Rwanda.<\/p>\n<p>Bagosora, now 70, is serving a 35-year sentence for crimes against humanity in connection with the genocide.<\/p>\n<p>For its part, BNP Paribas has yet to respond to the substance of the allegations. \u201cWe have learned through the media about a lawsuit being filed,\u201d a BNP Paribas spokesperson told news agencies on Thursday. \u201cAt this time, we do not have sufficient information about it to enable us to comment on it.\u201d<\/p>\n<p>A separate complaint was filed on Wednesday against &#8220;X&#8221;, or persons unknown in the French legal parlance, for \u201ccomplicity in genocide and complicity in crimes against humanity\u201d during the Rwandan genocide by Survie, a French group that \u201cdenounces all forms of French neo-colonial intervention in Africa\u201d.<\/p>\n<p>Survie wants an inquiry to be opened. \u201cThere are strong suspicions about the involvement of French politicians and military personnel in the cooperation with the Rwandan government before, during and after the genocide,\u201d said Safya Akorri, Survie\u2019s lawyer, <a href=\"http:\/\/www.leparisien.fr\/international\/genocide-au-rwanda-la-france-visee-par-une-nouvelle-plainte-28-06-2017-7095615.php\" target=\"_blank\" rel=\"noopener\">according to Le Parisien, which alongside Radio France broke the news about the complaint<\/a>.\u201d It is up to the judiciary, and not civil society, to help in understanding their role and establishing possible penal responsibility.\u201d<\/p>\n<p>Survie had filed a prior complaint that was dismissed last fall.<\/p>\n<p>In the <a href=\"http:\/\/www.revue21.fr\/la_vie_de_xxi\/lancement-du-numero-39-de-xxi-et-rencontre-sur-le-rwanda\/\" target=\"_blank\" rel=\"noopener\">latest issue of the French quarterly XXI<\/a>, editor-in-chief Patrick de Saint-Exup\u00e9ry looks at similar allegations as relayed by an unnamed civil servant who had access to still-classified French archives from the time. Saint-Exup\u00e9ry\u2019s piece accuses the Elys\u00e9e Palace of ordering the re-armament of Hutu authorities in the wake of the genocide. His source claims a memo to that effect was signed by Hubert V\u00e9drine, the palace\u2019s secretary general at the time under late Socialist president Fran\u00e7ois Mitterrand.<\/p>\n<p>\u201cFor more than 20 years, associations, historians, the French judiciary have been asking for access to these archives.
