{"id":8230,"date":"2017-06-28T14:30:49","date_gmt":"2017-06-28T18:30:49","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=8230"},"modified":"2017-06-28T14:30:49","modified_gmt":"2017-06-28T18:30:49","slug":"officer-van-dyke-takes-stand-hearing-laquan-mcdonalds-killing","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2017\/06\/28\/officer-van-dyke-takes-stand-hearing-laquan-mcdonalds-killing\/","title":{"rendered":"Officer Van Dyke takes stand in hearing on Laquan McDonald&#8217;s killing"},"content":{"rendered":"<article class=\"trb_ar\">\n<div class=\"trb_ar_main\">\n<div>\n<div class=\"trb_ar_page\">\n<p>The Chicago police officer at the center of a fatal shooting that has rocked the Police Department for 19 months took the witness stand Wednesday in a Cook County courtroom in a surprise development.<\/p>\n<p>Officer\u00a0<a id=\"PEGPF00155\" title=\"Jason Van Dyke\" href=\"http:\/\/www.chicagotribune.com\/topic\/crime-law-justice\/law-enforcement\/jason-van-dyke-PEGPF00155-topic.html\">Jason Van Dyke<\/a>, charged with murder in the on-duty fatal shooting of black teenager\u00a0<a id=\"PEOCVC00408\" title=\"Laquan McDonald\" href=\"http:\/\/www.chicagotribune.com\/topic\/crime-law-justice\/laquan-mcdonald-PEOCVC00408-topic.html\">Laquan McDonald<\/a>, testified at a hearing to determine if a special prosecutor can use statements the officer gave police investigators to aid in their case against Van Dyke.<\/p>\n<p>While on the stand for about half an hour, Van Dyke said he believed he was required to speak with then-Detective David March and then-Deputy Chief David McNaughton shortly after the October 2014 shooting.<\/p>\n<p>Van Dyke repeatedly told prosecutors that he did not recall if anyone specifically warned him he would be fired or disciplined if he did not answer questions speak at the scene of the shooting.<\/p>\n<aside class=\"trb_ar_sponsoredmod trb_barker_mediaconductor\">\n<div class=\"tlod\">\n<div id=\"tl_outer\" class=\"ArticleSub\">\n<div id=\"tl_inner\">\n<div>\u00a0&#8220;Sir, I don&#8217;t remember, but the understanding is there that you have to cooperate,&#8221; Van Dyke told Joseph McMahon, the Kane County state&#8217;s attorney who was appointed special prosecutor in the McDonald killing.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/aside>\n<p>A long-standing legal rule prohibits statements that officers are required to give from being used against them in criminal proceedings.
