All claimed asylum and have been assessed by the Australian government as having a prima facie <a class=\"u-underline\" href=\"http:\/\/www.igis.gov.au\/inquiries\/docs\/inquiry_mr-e.pdf\" data-link-name=\"in body link\">legitimate claim to refugee status<\/a>.\u00a0 Abdellatif remains in Villawood detention centre \u2013 the rest of the family are in community detention, without valid visas and subject to curfews and conditions, but free to move in the wider community.<\/p>\n<p>An Interpol Red Notice from <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/world\/egypt\" data-link-name=\"auto-linked-tag\" data-component=\"auto-linked-tag\">Egypt<\/a> in Abdellatif\u2019s name \u2013 years ago exposed as erroneous \u2013 has stalled his claim for protection.<\/p>\n<p>From Villawood\u2019s high-security Hotham wing, Abdellatif told Guardian Australia that half a decade of indefinite detention \u2013 without charge, trial, or any suggestion of an ending \u2013 had torn at the fabric of his family and damaged his mental and physical health.<\/p>\n<aside class=\"element element-rich-link element--thumbnail element-rich-link--not-upgraded\" data-component=\"rich-link\" data-link-name=\"rich-link-3 | 1\">\n<div class=\"rich-link\">\n<div class=\"rich-link__container\">\n<div class=\"rich-link__read-more\">\n<div class=\"rich-link__arrow\">\u201cMy case has taken five years to be finalised, it\u2019s ridiculous. It\u2019s not only crushed my hope. It\u2019s torture.\u201d<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/aside>\n<p>Abdellatif\u2019s Red Notice was based on a conviction in a 1999 show trial in Cairo that has since been discredited and its judgements overturned, because of false allegations and a reliance on evidence obtained by torturing prisoners.<\/p>\n<p>The Australian government conceded as long ago as April 2015 that it knew the \u201c<a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/world\/2016\/nov\/26\/australian-government-concedes-evidence-against-asylum-seeker-was-obtained-by-torture\" data-link-name=\"in body link\">evidence used against Mr Abdellatif in the Egyptian trial was obtained under torture<\/a>\u201d.<\/p>\n<p><a class=\"u-underline\" href=\"https:\/\/www.interpol.int\/INTERPOL-expertise\/Notices\/Red-Notices\" data-link-name=\"in body link\">Red Notices <\/a>are Interpol\u2019s global alert system for wanted persons. In about one third of the 190 member countries (though not in Australia), police treat a Red Notice as an authority to arrest someone. But rights groups argue that the Red Notice system is abused by authoritarian governments to target enemies and silence dissent.\u00a0 The human rights organisation Fair Trials has lodged a formal application with Interpol to have Abdellatif\u2019s Red Notice re-examined in full.<\/p>\n<p>A <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/world\/sayed-abdellatif\" data-link-name=\"in body link\">three-year investigation<\/a> by the Guardian has revealed numerous flaws in the case against Abdellatif. Allegations of murder, firearms offences and property destruction <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/world\/2013\/jun\/07\/conviction-egyptian-asylum-seeker\" data-link-name=\"in body link\">were never made against Abdellatif at his Cairo trial<\/a> and were wrongly attached to the Interpol Red Notice.<\/p>\n<p>After The Guardian\u2019s investigation Interpol took the extraordinary step of withdrawing those charges. The remaining convictions against Abdellatif, for \u201cmembership of a terrorist group\u201d and \u201cproviding forged travel documents\u201d, <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/australia-news\/2015\/feb\/16\/indefinite-detention-of-asylum-seeker-is-based-on-conviction-secured-by-torture\" data-link-name=\"in body link\">relied on evidence obtained under \u201csevere torture\u201d<\/a>. He was convicted in absentia, without any chance of defending himself against the allegations. <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/world\/2013\/jun\/19\/sayed-abdellatif-breaks-silence-detention\" data-link-name=\"in body link\">He has denied both charges<\/a>.
