{"id":7303,"date":"2017-05-08T06:45:14","date_gmt":"2017-05-08T10:45:14","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=7303"},"modified":"2017-05-08T06:45:14","modified_gmt":"2017-05-08T10:45:14","slug":"construction-boss-jailed-death-woman-crushed-windows","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2017\/05\/08\/construction-boss-jailed-death-woman-crushed-windows\/","title":{"rendered":"Construction boss jailed after death of woman crushed by windows"},"content":{"rendered":"<div class=\"content__article-body from-content-api js-article__body\" data-test-id=\"article-review-body\">\n<p>A construction boss has been jailed for a year for gross negligence over the death of a lawyer crushed by half-tonne windows.<\/p>\n<p><a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/uk\/2012\/sep\/05\/lawyer-killed-window-frame-london\" data-link-name=\"in body link\">Amanda Telfer<\/a>, 43, was killed when the stack of large unglazed frames collapsed on her as she walked past a building site in Hanover Square, central London. Members of the public rushed to help, but Telfer could not be saved and she was pronounced dead at the scene just before noon on 30 August 2012.<\/p>\n<p>A jury found the supervisor at IS Europe Ltd, Kelvin Adsett, 64, of Slough, Berkshire, guilty of manslaughter and breaching health and safety. It was said on his behalf that his life was destroyed as the result of \u201can aberration of carelessness\u201d.<\/p>\n<p>Sentencing him to 12 months in prison, Judge Peter Rook QC told him: \u201cYour actions contributed to the wholly needless and untimely death of Amanda Telfer.\u201d The judge said he had shown \u201creckless disregard\u201d for what was a life-threatening situation.<\/p>\n<p>Westgreen Construction Limited site manager Damian Lakin-Hall, 50, of Cobham, Surrey, was convicted of failing to take reasonable care of safety while at work.\u00a0 Rook sentenced him to six months\u2019 jail, suspended for two years.<\/p>\n<p>IS Europe Ltd, of Slough, was found guilty at the Old Bailey of two health and safety breaches. The company was described by the judge as the \u201calter ego\u201d of Adsett. The court heard it was now dormant due to Adsett\u2019s ill health and had just \u00a3250 in the bank.<\/p>\n<p>The judge said: \u201cThere would have been a fine of \u00a3100,000. However, given ISE\u2019s limited assets, the only fine I can order is \u00a3250.\u201d<\/p>\n<p>Costs of \u00a3100,000 will be split between the three defendants, with insurance covering the firm\u2019s share.<\/p>\n<p>In a victim impact statement, Telfer\u2019s father, Barry, told how he was still coming to terms with the death of his daughter, who had previously worked for human rights charity Reprieve.\u00a0 He said he and his wife Ann last saw her on the morning of the tragedy. He said: \u201cShe was cheerful, making plans and looking forward. An hour later she was dead.\u201d\u00a0 Mr Telfer added: \u201cEvery parent who has lost a child through violent and sudden death will know the overwhelming shock and disbelief that is impossible to describe.\u201d<\/p>\n<p>The court had heard how the frames, which together weighed 655kg, had been left leaning against a wall after being delivered the previous day, before the site was ready for their installation.<\/p>\n<p>Prosecutor Duncan Atkinson QC said it was \u201cobvious to anyone\u201d they carried a \u201cclear and serious risk of death\u201d to anyone walking past.<\/p>\n<p>The frames were seen to move in the wind, prompting concern from the public that they might fall into the busy central London street. Another member of the public had almost been hit in a \u201cnear-miss\u201d at the site just days before the fatal accident, the court heard.<\/p>\n<p>Atkinson said: \u201cThere were a series of obvious and, in many cases, straightforward steps that could have been taken to avoid that risk \u2013 ranging from cancellation, delay, refusal of delivery on the one hand, to the storage, the use of straps and barriers.
