{"id":6477,"date":"2017-03-29T08:17:56","date_gmt":"2017-03-29T12:17:56","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=6477"},"modified":"2017-03-29T08:17:56","modified_gmt":"2017-03-29T12:17:56","slug":"mark-duggans-family-lose-inquest-appeal","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2017\/03\/29\/mark-duggans-family-lose-inquest-appeal\/","title":{"rendered":"Mark Duggan&#8217;s family lose inquest appeal"},"content":{"rendered":"<p class=\"story-body__introduction\">The family of Mark Duggan, whose death sparked riots around England, have lost a legal challenge against the conclusion his death was lawful.<\/p>\n<p>Jurors concluded the 29-year-old was <a class=\"story-body__link\" href=\"http:\/\/www.bbc.co.uk\/news\/uk-england-25657949\">lawfully killed by a police marksman<\/a> in Tottenham, north London, in August 2011.<\/p>\n<p>Mr Duggan&#8217;s mother, Pamela, had asked for the January 2014 finding to be quashed.<\/p>\n<p>But three Court of Appeal judges have rejected her case.<\/p>\n<p>His family was challenging an October 2014 High Court ruling which found the jury was legally entitled to have reached its conclusion.<\/p>\n<h2 class=\"story-body__crosshead\">&#8216;Matter of common sense&#8217;<\/h2>\n<p>They found that the police officer who twice shot Mr Duggan, known as V53, &#8220;honestly believed&#8221; he was holding a gun at the time.<\/p>\n<p>At the appeal court, the family had argued jurors should also have been directed to consider whether the police officer&#8217;s belief was also reasonable.<\/p>\n<p>But the judges said there was &#8220;no need for the coroner to spell out to the jury that, as part of their decision whether V53 honestly believed that Mr Duggan had a gun and was about to use it, they needed to consider whether such a belief was reasonable&#8221;.<\/p>\n<figure class=\"media-landscape has-caption full-width\"><\/figure>\n<p><img decoding=\"async\" src=\"http:\/\/ichef-1.bbci.co.uk\/news\/624\/cpsprodpb\/61CD\/production\/_95373052_60f95de1-02af-4a1b-99d2-53e61789d496.jpg\" \/><\/p>\n<p><span class=\"media-caption__text\"><em>Mark Duggan&#8217;s family attended court earlier this month but were not in court for Wednesday&#8217;s verdict<\/em> <\/span><\/p>\n<p>They said this consideration was, as &#8220;a matter of common sense&#8221;, an &#8220;inevitable part of the exercise&#8221;.<\/p>\n<p>Mr Duggan&#8217;s <a class=\"story-body__link\" href=\"http:\/\/www.bbc.co.uk\/news\/uk-england-london-14434318\">shooting led to five days of rioting in London<\/a>, which spread to other cities across the country.<\/p>\n<figure class=\"media-landscape has-caption full-width\"><\/figure>\n<figure class=\"media-landscape has-caption full-width\"><span class=\"image-and-copyright-container\"><img decoding=\"async\" src=\"http:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/AFED\/production\/_95373054_a0b1892e-e601-4103-8c6e-e1e609df6cba.jpg\" \/>\u00a0 <\/span><figcaption class=\"media-caption\"><span class=\"media-caption__text\"><em>Mark Duggan&#8217;s death led to five days of rioting which began in Tottenham, north London, before spreading across the capital and to other cities around the country<\/em> <\/span><\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p>Armed officers intercepted the minicab Mr Duggan was travelling in, believing he was part of a gang and had collected a gun.<\/p>\n<p>The inquest jury concluded Mr Duggan, who jumped from the taxi, had dropped the firearm on to some grass as soon as the minicab came to a stop.<\/p>\n<p>But the jury also accepted officer V53 &#8220;honestly believed&#8221;
