{"id":6064,"date":"2017-03-07T06:22:48","date_gmt":"2017-03-07T11:22:48","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=6064"},"modified":"2017-03-07T06:22:48","modified_gmt":"2017-03-07T11:22:48","slug":"government-defends-10-year-sentence-plan-copyright-infringers","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2017\/03\/07\/government-defends-10-year-sentence-plan-copyright-infringers\/","title":{"rendered":"Government defends 10-year sentence plan for copyright infringers"},"content":{"rendered":"<div class=\"articleWrapper\">\n<div class=\"articleContent\">\n<div class=\"storytext\">\n<p>The Intellectual Property Office (IPO) has hit back at a campaign against new government measures to increase the sentence for online copyright infringement to 10 years.<\/p>\n<p>The government\u2019s Digital Economy Bill aims to standardise the maximum sentence for both online and physical infringement. Currently, the maximum sentence is two years for online piracy and 10 for physical piracy.<\/p>\n<p>But campaigning organisation Open Rights Group claimed in a proposed amendment that the increased sentence could see a surge in activity by \u2018copyright trolls\u2019 and that it would criminalise minor infringements.<\/p>\n<p>However, the IPO said the revised offence is designed to deter and deal with deliberate infringement, while protecting innocent or unwitting infringers.<\/p>\n<p>According to the government, the proposals have introduced a \u2018mental element\u2019 which requires intention to make a gain, or reason to believe that the copyright owner will suffer loss or be exposed to risk of loss.<\/p>\n<p>\u2018Ten-year sentences would only be applied in the most serious of criminal circumstances. It is highly unlikely that small, unintentional infringement would be caught by this offence,\u2019 the IPO said.
