{"id":5117,"date":"2017-01-18T07:33:21","date_gmt":"2017-01-18T12:33:21","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=5117"},"modified":"2017-01-18T07:33:21","modified_gmt":"2017-01-18T12:33:21","slug":"disability-campaigner-claims-victory-bid-wheelchair-users-priority-buggies-buses","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2017\/01\/18\/disability-campaigner-claims-victory-bid-wheelchair-users-priority-buggies-buses\/","title":{"rendered":"Disability campaigner claims victory in bid for wheelchair users to have priority over buggies on buses"},"content":{"rendered":"<article data-insert-mobile-adslot=\"\">\n<div class=\"articleBodyText section version-2\">\n<div class=\"article-body-text component version-2\">\n<div class=\"component-content\">\n<p><span class=\"m_first-letter\">D<\/span>isabled campaigner Doug Paulley has claimed &#8220;an important victory&#8221; <a href=\"https:\/\/www.google.co.uk\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=4&amp;cad=rja&amp;uact=8&amp;ved=0ahUKEwi-5tyI0cvRAhWGXBoKHY6uD4wQFggwMAM&amp;url=http%3A%2F%2Fwww.telegraph.co.uk%2Fnews%2Fuknews%2Froad-and-rail-transport%2F11279325%2FParents-with-buggies-not-required-to-make-way-for-wheelchairs-on-buses.html&amp;usg=AFQjCNHlC_ChoX0H38QQQj5_LsB9nrP2oQ&amp;bvm=bv.144224172,d.d2s\">in his legal battle for wheelchair users to have priority use<\/a> for wheelchair spaces on buses.<\/p>\n<p>The Supreme Court unanimously ruled it was not enough for drivers to &#8220;simply request&#8221; a non-wheelchair user to vacate the space without taking any further steps.\u00a0 The highest court in the land ruled, if a refusal to move is unreasonable, <a href=\"https:\/\/www.google.co.uk\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=4&amp;cad=rja&amp;uact=8&amp;ved=0ahUKEwi-5tyI0cvRAhWGXBoKHY6uD4wQFggwMAM&amp;url=http%3A%2F%2Fwww.telegraph.co.uk%2Fnews%2Fuknews%2Froad-and-rail-transport%2F11279325%2FParents-with-buggies-not-required-to-make-way-for-wheelchairs-on-buses.html&amp;usg=AFQjCNHlC_ChoX0H38QQQj5_LsB9nrP2oQ&amp;bvm=bv.144224172,d.d2s\">the driver must consider taking further steps to &#8220;pressurise&#8221; the reluctant passenger to leave the space<\/a>, &#8220;depending on the circumstances&#8221;.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"articleBodyText section\">\n<div class=\"article-body-text component \">\n<div class=\"component-content\">\n<p>Those steps could in appropriate cases, include &#8220;a refusal to drive on&#8221;.<\/p>\n<p>Mr Paulley, from Wetherby, West Yorkshire, was cheered by other wheelchair users and disabled people outside the court in London after the ruling.<\/p>\n<p>He said: &#8220;I am absolutely delighted. It has been a long fight. We have achieved something really substantial here which will make a difference to people who need the wheelchair space &#8211; not just wheelchair users but other disabled people.<\/p>\n<p>&#8220;This is important &#8211; a significant cultural change.&#8221;<\/p>\n<p>Mr Paulley&#8217;s marathon legal battle was triggered on the morning of February 24 2012 when he attempted to board the 9.40 bus from Wetherby to Leeds operated by FirstGroup which had a sign saying: &#8220;Please give up this space if needed for a wheelchair user.&#8221;<\/p>\n<p>He was on his way to catch a train to meet his parents for lunch in Stalybridge.\u00a0 But he was left at the stop <a href=\"https:\/\/www.google.co.uk\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=2&amp;cad=rja&amp;uact=8&amp;ved=0ahUKEwi-5tyI0cvRAhWGXBoKHY6uD4wQFggiMAE&amp;url=http%3A%2F%2Fwww.telegraph.co.uk%2Fwomen%2Fmother-tongue%2F11290990%2FBuggies-and-mums-on-British-buses-are-a-disgrace.html&amp;usg=AFQjCNF1_PqF4gr0NQ2XYou1e6a_wz6HQQ&amp;bvm=bv.144224172,d.d2s\">because a woman with a sleeping baby in a pushchair refused to move<\/a> out of the designated area when asked by the bus driver.
