{"id":4376,"date":"2016-12-21T06:02:47","date_gmt":"2016-12-21T11:02:47","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=4376"},"modified":"2016-12-21T06:02:47","modified_gmt":"2016-12-21T11:02:47","slug":"teenagers-spend-christmas-adult-jail-despite-victorian-court-ruling-unlawful","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2016\/12\/21\/teenagers-spend-christmas-adult-jail-despite-victorian-court-ruling-unlawful\/","title":{"rendered":"Teenagers to spend Christmas in adult jail despite Victorian court ruling it unlawful"},"content":{"rendered":"<div class=\"copy-paste-block\">\n<p>A group of juvenile offenders will spend Christmas in Victoria&#8217;s maximum security adult jail despite a court ruling that their transfer to Barwon Prison was illegal.<\/p>\n<p>The Victorian government says it will appeal the Supreme Court judgement that it acted unlawfully by failing to give proper consideration to the teenagers&#8217; human rights.\u00a0 Justice Greg Garde today initially ordered the 15 teenagers be moved to a youth facility by tomorrow afternoon but later changed his mind after the government argued it had nowhere else to house them.\u00a0 A stay has been placed on their transfer out of Barwon Prison until December 28.<\/p>\n<p>The teens were among up to 40 youths who were transferred to the prison&#8217;s Grevillea unit in November after riots damaged the Parkville and Malmsbury youth detention facilities.\u00a0 At the time Youth Affairs Minister Jenny Mikakos said the transfer was due to the teens&#8217; &#8220;disgraceful&#8221; behaviour.\u00a0 At trial government lawyers told Justice Garde the transfer was due to capacity issues at the damaged detention centres.<\/p>\n<div class=\"article-body__media article-body__media--image\"><picture data-alt=\"\" data-default-src=\"http:\/\/imageresizer.static9.net.au\/EeFQo2GB0OsyyeiJFWUCaKUu-dI=\/718x0\/http%3a%2f%2fprod.static9.net.au%2f_%2fmedia%2f2016%2f12%2f21%2f16%2f42%2fjail.ashx%3fw%3d603\"><source srcset=\"http:\/\/imageresizer.static9.net.au\/EeFQo2GB0OsyyeiJFWUCaKUu-dI=\/718x0\/http%3a%2f%2fprod.static9.net.au%2f_%2fmedia%2f2016%2f12%2f21%2f16%2f42%2fjail.ashx%3fw%3d603\" media=\"(min-width: 901px)\" \/><source srcset=\"http:\/\/imageresizer.static9.net.au\/3c0Pi51Yui0wzM8FHoFWAis-Guo=\/543x0\/http%3a%2f%2fprod.static9.net.au%2f_%2fmedia%2f2016%2f12%2f21%2f16%2f42%2fjail.ashx%3fw%3d603\" media=\"(min-width: 768px)\" \/><source srcset=\"http:\/\/imageresizer.static9.net.au\/bUZvvpQzzXoe4Pat4tnHgmmZHZk=\/743x0\/http%3a%2f%2fprod.static9.net.au%2f_%2fmedia%2f2016%2f12%2f21%2f16%2f42%2fjail.ashx%3fw%3d603\" media=\"(min-width: 401px)\" \/><source srcset=\"http:\/\/imageresizer.static9.net.au\/2w38O9ggD3RASB63u9-PHB2l_GI=\/376x0\/http%3a%2f%2fprod.static9.net.au%2f_%2fmedia%2f2016%2f12%2f21%2f16%2f42%2fjail.ashx%3fw%3d603\" \/><\/picture>&#8220;I don&#8217;t walk away from those (previous) comments &#8211; their behaviour was disgraceful,&#8221; Ms Mikakos told reporters after the court ruling.<\/div>\n<p>The minister was standing by her decision to transfer the group to Barwon, suggesting the Supreme Court got it wrong.<\/p>\n<p>&#8220;We made a tough call to send these young offenders to the Grevillea unit at Barwon Prison and we will defend that decision,&#8221; she said.<\/p>\n<p>&#8220;The government is extremely disappointed by today&#8217;s outcome.&#8221;<\/p>\n<p>The government&#8217;s appeal will be heard next Wednesday.<\/p>\n<p>In today&#8217;s judgement, Justice Garde found the Grevillea unit had not been lawfully established as a youth remand centre under the relevant legislation.\u00a0 He said the government had transferred the youths in November for &#8220;an improper and extraneous purpose&#8221; of emergency accommodation.<\/p>\n<p>In late November the Andrews government agreed to move indigenous teens out of Barwon after a legal challenge was launched by the Victorian Aboriginal Legal Service. Lawyers for the remaining non-indigenous youths then challenged their transfer on the basis it was unlawful and breached their human rights.<\/p>\n<p>Opposition Leader Matthew Guy says Ms Mikakos should now lose her job.
