{"id":3953,"date":"2016-12-09T09:18:02","date_gmt":"2016-12-09T14:18:02","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=3953"},"modified":"2016-12-09T09:18:02","modified_gmt":"2016-12-09T14:18:02","slug":"man-cant-use-castle-doctrine","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2016\/12\/09\/man-cant-use-castle-doctrine\/","title":{"rendered":"Judge: PA man can&#8217;t use Castle Doctrine defense for killing home intruder"},"content":{"rendered":"<p>A Washington County man has been ordered held without bail after he was arraigned on charges stemming from the fatal shooting of an unarmed intruder last month.<\/p>\n<p>Fifty-three-year-old David Murray was charged Thursday with 77 drug offenses and criminal homicide in connection with the Nov. 25 shooting death of 52-year-old Nathaniel Gardner.<\/p>\n<p>Police say Murray told authorities that he shot Gardner after he kicked in the door of his Cecil Township trailer and assaulted him.<\/p>\n<p>While investigating the death, police uncovered a large marijuana growing operation at Murray&#8217;s residence.<\/p>\n<p>Washington County District Attorney Eugene Vittone says that because of the discovery of illegal activity on the premises, Murray cannot utilize the Castle Doctrine to justify use of deadly force.<\/p>\n<p>It&#8217;s unclear if Murray has an attorney who could comment.<\/p>\n<p><a href=\"http:\/\/www.mcall.com\/news\/nationworld\/pennsylvania\/mc-pa-castle-doctrine-defense-denied-20161209-story.html\" target=\"_blank\">The Morning Call<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">A Washington County man has been ordered held without bail after he was arraigned on charges stemming from the fatal shooting of an unarmed intruder last month.
