The allegation against Rupert Murdoch\u2019s son was made at a <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">court hearing<\/a> on 5 December, in a case that involves accusations against <em>The Sun<\/em>.<\/p>\n<p>Murdoch was Executive Chairman of News International in 2010.<\/p>\n<p>News UK \u2013 the new name for News International \u2013 faced <a href=\"http:\/\/www.thecanary.co\/2016\/01\/15\/sun-may-set-final-time-major-scandal-threatens-knock-paper-knees-video\/\" target=\"_blank\">fresh phone hacking claims<\/a> in January 2016. <em>The Sun<\/em> and the now defunct <em>News of the World<\/em> (<em>NoW<\/em>) are both implicated in the claims. And in April, Mr Justice Mann <a href=\"http:\/\/www.thecanary.co\/2016\/04\/28\/sun-hits-rock-bottom-criminal-trial-launched-paper\/\" target=\"_blank\">ruled<\/a> that there is enough compelling evidence in the case to warrant a full trial against the publisher.<\/p>\n<h4><strong>Authorisation from the top<\/strong><\/h4>\n<p>The full trial will begin next year, <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">according<\/a> to <em>The Guardian<\/em>. But a case management hearing \u2013 a pre-trial hearing \u2013 took place on 5 December. And David Sherborne, who is representing the 17 people suing News UK, <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">claimed<\/a> that senior executives (including Murdoch) conducted a policy of email deletion. And that the policy removed\u00a0\u201cemails that could be unhelpful in future litigation in which News International could be a defendant\u201d.<\/p>\n<p>Rebekah Brooks has also been implicated in approving that policy. Brooks was the <a href=\"http:\/\/www.telegraph.co.uk\/news\/uknews\/phone-hacking\/8640245\/Rebekah-Brooks-timeline-of-her-role-in-the-phone-hacking-scandal.html\" target=\"_blank\" rel=\"nofollow\">CEO<\/a> of News International in 2010.<\/p>\n<p>Sherborne <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">explained<\/a> what he alleged the email policy intended to do:<\/p>\n<blockquote><p>to eliminate in a consistent manner across NI (subject to compliance with legal and regulatory requirements as to retention) emails that could be unhelpful in the context of future litigation in which an NI company is a defendant.<\/p><\/blockquote>\n<p>The <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">evidence<\/a> for the claim includes an email sent by the CIO of News International Andrew Hickey. That email was sent to an in-house lawyer and <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">read<\/a>:<\/p>\n<blockquote><p>Fyi also spoke with her [Brooks] on this and fine with what we are doing but adamant on Jan 2010 and has discussed it with JRM who wants to draw a line under Wapping and pre-2010. Can you pop round to discuss implications with me thanks andy<\/p><\/blockquote>\n<p>News Group Newspapers (NGN), an arm of News UK, had <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">provided<\/a> a \u201cnon-admission\u201d on the email policy previously. Its representative, Andrew Green, however, was told to present its position on the emails again. Mann <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">instructed<\/a> Green that \u201cthere should be a proper pleading\u2026 even if it turns out to be a blanket denial\u201d.<\/p>\n<p>NGN have to respond to that instruction in 21 days.<\/p>\n<h4><strong>Mounting evidence<\/strong><\/h4>\n<p>This latest evidence in the case follows prior submissions. An <a href=\"http:\/\/www.thecanary.co\/2016\/04\/14\/latest-scandal-final-nail-coffin-sun\/\" target=\"_blank\">email exchange<\/a> was submitted in the case earlier this year. It allegedly <a href=\"http:\/\/www.thecanary.co\/2016\/04\/14\/latest-scandal-final-nail-coffin-sun\/\" target=\"_blank\">showed<\/a> that phone hacking was approved by a senior official at <em>The Sun<\/em>. Admissions from previous employees that they were involved in phone hacking provided the basis for the case. Court documents <a href=\"http:\/\/www.thecanary.co\/2016\/01\/15\/sun-may-set-final-time-major-scandal-threatens-knock-paper-knees-video\/\" target=\"_blank\">maintain<\/a> that the witnesses were:<\/p>\n<div id=\"wpads-pixel-ads\">\u00a0intimately involved or engaged in these unlawful activities on behalf of NGN, both at the News of the World and The Sun<\/div>\n<p>NGN says the claims are baseless, and has <a href=\"http:\/\/www.independent.co.uk\/news\/uk\/crime\/rebekah-brooks-new-claims-that-phone-hacking-was-rife-at-the-sun-under-former-editor-a6810976.html\" target=\"_blank\" rel=\"nofollow\">vowed<\/a> to vigorously defend itself:<\/p>\n<blockquote><p>Following many years of investigation, there were no charges against The Sun or its employees for voicemail interception.<\/p>\n<p>Today, certain claimants seeking financial settlements arising from activities at the News of the World have made unsubstantiated claims against The Sun. If the court permits such claims to proceed, The Sun will defend them vigorously.<\/p><\/blockquote>\n<p>It also <a href=\"https:\/\/www.theguardian.com\/media\/2016\/dec\/05\/james-murdoch-involved-news-international-email-deletion-high-court-phone-hacking\" target=\"_blank\" rel=\"nofollow\">claims<\/a> the email deletion was merely good \u2018housekeeping\u2019 practice.<\/p>\n<p>When the phone hacking scandal broke at the <em>NoW<\/em> in 2011, News International vehemently denied the claims. It asserted that the scandal was due to a \u2018rogue\u2019 reporter. But that claim was destroyed after the \u2018<a href=\"http:\/\/www.thecanary.co\/2016\/01\/15\/sun-may-set-final-time-major-scandal-threatens-knock-paper-knees-video\/\" target=\"_blank\">For Neville<\/a>\u2018 email surfaced. Its release <a href=\"http:\/\/www.thecanary.co\/2016\/01\/15\/sun-may-set-final-time-major-scandal-threatens-knock-paper-knees-video\/\" target=\"_blank\">showed<\/a> that hacking was rife at the <em>NoW<\/em>, and that senior staff were aware it was going on.<\/p>\n<p>This High Court case will undoubtedly unearth further information as it progresses. But the Murdochs will surely be hoping it follows a different path to the <em>NoW<\/em> scandal. Because that ended with the\u00a0tabloid closing down, and the <a href=\"http:\/\/webarchive.nationalarchives.gov.uk\/20140122145147\/http:\/www.levesoninquiry.org.uk\/\" target=\"_blank\" rel=\"nofollow\">Leveson inquiry<\/a> being launched.<\/p>\n<p>Time will tell whether <em>The Sun <\/em>awaits the same fate.<\/p>\n<p><em>Source <a href=\"http:\/\/www.thecanary.co\/2016\/12\/06\/suns-phone-hacking-trial-heating-new-evidence-implicates-murdochs-son\/\" target=\"_blank\">http:\/\/www.thecanary.co\/2016\/12\/06\/suns-phone-hacking-trial-heating-new-evidence-implicates-murdochs-son\/<\/a><br \/>\n<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">The High Court has been told\u00a0that the deletion of emails at News International in 2010 personally involved James Murdoch.
