{"id":31313,"date":"2026-09-09T18:31:16","date_gmt":"2026-09-09T22:31:16","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=31313"},"modified":"2026-09-09T18:31:16","modified_gmt":"2026-09-09T22:31:16","slug":"tate-brothers-to-stay-in-us-jail-court-rules-as-they-fight-extradition-to-britain","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2026\/09\/09\/tate-brothers-to-stay-in-us-jail-court-rules-as-they-fight-extradition-to-britain\/","title":{"rendered":"Tate brothers to stay in US jail, court rules, as they fight extradition \u200cto Britain"},"content":{"rendered":"<p>Andrew and Tristan Tate have lost their bid for release from a Florida prison as they try to fight their extradition \u200cto Britain &#8211; where they are wanted on rape and trafficking charges.<\/p>\n<p><strong><a href=\"https:\/\/news.sky.com\/topic\/andrew-tate-10341\/1\" target=\"_self\">Andrew Tate<\/a><\/strong>, \u200c39, and Tristan Tate, 38, were arrested in\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/miami-8270\/1\" target=\"_self\">Miami<\/a><\/strong>\u00a0on 18 July after the UK requested their extradition to face allegations of rape, \u200bassault and facilitating trafficking for sexual exploitation.<\/p>\n<p>Magistrate Judge Lauren Louis denied bail for the social media influencers following a hearing last month in Miami federal court.<\/p>\n<p>Both Tate brothers, who have dual US and\u00a0<strong><a href=\"https:\/\/news.sky.com\/uk\" target=\"_self\">British<\/a><\/strong>\u00a0citizenship, have denied any wrongdoing.<\/p>\n<p>The former professional kickboxers, who have millions of followers on social media, claim their online personas are characters and not their true personalities.<\/p>\n<p>Prosecutors told the court on Wednesday that there was a strong presumption in favour of detaining defendants who are being held \u200bin international extradition cases.<\/p>\n<p>They also cited the British authorities&#8217; allegations in which they face a total of 59 charges relating to four alleged victims between July 2010 and \u200bAugust 2017.<\/p>\n<p>The pair previously faced rape and human trafficking charges in the UK related to three alleged \u200bvictims, the Crown Prosecution Service (CPS) said.<\/p>\n<p>A British judge issued a warrant for their arrests in 2024, but they have not appeared in British court to enter a plea to those charges.<\/p>\n<p>The UK is seeking \u200cto extradite the brothers to face \u200bboth sets of charges.<\/p>\n<p>The prosecutors also pointed to allegations by authorities in\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/romania-6246\/1\" target=\"_self\">Romania<\/a><\/strong>, where the brothers face human trafficking allegations.<\/p>\n<p>The brothers&#8217; defence lawyers said in court \u200cfilings there was no need to keep them behind bars during the extradition process because their &#8220;extraordinary public visibility&#8221; would make it difficult for them to flee, arguing the brothers had regularly appeared in court in Romania.<\/p>\n<div class=\"sdc-article-widget sdc-article-image\" data-testid=\"article-image\">\n<figure class=\"sdc-article-image__figure\">\n<div class=\"sdc-article-image__wrapper\" data-aspect-ratio=\"16\/9\"><img decoding=\"async\" class=\"sdc-article-image__item\" src=\"https:\/\/e3.365dm.com\/26\/03\/768x432\/skynews-andrew-tate-tristan-tate_7195423.jpg?20260317144036\" sizes=\"(min-width: 1024px) 1024px, 100vw\" srcset=\"https:\/\/e3.365dm.com\/26\/03\/384x216\/skynews-andrew-tate-tristan-tate_7195423.jpg?20260317144036 380w, https:\/\/e3.365dm.com\/26\/03\/768x432\/skynews-andrew-tate-tristan-tate_7195423.jpg?20260317144036 760w, https:\/\/e3.365dm.com\/26\/03\/1600x900\/skynews-andrew-tate-tristan-tate_7195423.jpg?20260317144036 1024w, https:\/\/e3.365dm.com\/26\/03\/2048x1152\/skynews-andrew-tate-tristan-tate_7195423.jpg?20260317144036 2048w\" alt=\"Tristan (L) and Andrew Tate in Hong Kong below a road sign with the same name as where they grew up in Luton. (Image:\u00a0 Andrew Tate @Cobrat)<\/span><\/figcaption><\/figure>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&#8220;The Tates&#8217; compliance record \u200bis clear and convincing evidence they are not a danger to the community,&#8221; \u200bthe defence<br \/>\nlawyers wrote.<\/p>\n<p>The defence lawyers proposed that Judge Louis release them on the conditions they pay money to the court, know as posting bond, as well as surrendering \u200btheir passports and submiting to location monitoring.<\/p>\n<p>However US Magistrate Lauren Louis denied the defence motion for release, meaning the Tates will stay imprisoned during an extradition process that could take months.<\/p>\n<p>In a statement after the ruling, their lawyers said: &#8220;They are now facing an extraordinary situation in which they are being held thousands of miles from Romania while Romanian proceedings continue, deadlines approach, an additional indictment is said to be imminent and their own Romanian lawyer says he cannot properly prepare.<\/p>\n<p>&#8220;No serious person can pretend that this can be reviewed properly through occasional conversations from a federal detention centre in another country.&#8221;<\/p>\n<p>Britain has until 16 September to submit its full extradition request to the State Department, US court records show.<\/p>\n<p>After the brothers were\u00a0<a href=\"https:\/\/news.sky.com\/story\/andrew-and-tristan-tate-arrested-in-miami-on-uk-extradition-request-over-rape-and-sex-trafficking-charges-13564845\" target=\"_self\"><strong>arrested in July by US authorities in Miami<\/strong><\/a>, the Crown Prosecution Service (CPS) said it was bringing further charges against them.<\/p>\n<div class=\"sdc-article-widget sdc-article-image\" data-testid=\"article-image\">\n<figure class=\"sdc-article-image__figure\">\n<div class=\"sdc-article-image__wrapper\" data-aspect-ratio=\"16\/9\"><img decoding=\"async\" class=\"sdc-article-image__item\" src=\"https:\/\/e3.365dm.com\/26\/08\/768x432\/skynews-andrew-tate-mclaren_7330665.jpg?20260825103408\" sizes=\"(min-width: 1024px) 1024px, 100vw\" srcset=\"https:\/\/e3.365dm.com\/26\/08\/384x216\/skynews-andrew-tate-mclaren_7330665.jpg?20260825103408 380w, https:\/\/e3.365dm.com\/26\/08\/768x432\/skynews-andrew-tate-mclaren_7330665.jpg?20260825103408 760w, https:\/\/e3.365dm.com\/26\/08\/1600x900\/skynews-andrew-tate-mclaren_7330665.jpg?20260825103408 1024w, https:\/\/e3.365dm.com\/26\/08\/2048x1152\/skynews-andrew-tate-mclaren_7330665.jpg?20260825103408 2048w\" alt=\"Andrew Tate driving a custom McLaren 765LT Spider super-car in 2024. (Image: EPA-EFE\/Shutterstock)<\/span><\/figcaption><\/figure>\n<\/div>\n<p>&nbsp;<\/p>\n<p>Andrew Tate was charged with seven further counts of rape, three counts of arranging or facilitating trafficking for sexual exploitation, three counts of assault occasioning actual bodily harm and 19 additional charges relating to indecent images of a child and extreme pornography.<\/p>\n<p>Tristan Tate was charged with one count of sexual assault, two counts of rape and three counts of arranging or facilitating trafficking for sexual exploitation.<\/p>\n<p>The CPS said it had identified four additional alleged victims.
