{"id":31226,"date":"2026-08-26T05:27:53","date_gmt":"2026-08-26T09:27:53","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=31226"},"modified":"2026-08-26T05:27:53","modified_gmt":"2026-08-26T09:27:53","slug":"european-rights-court-orders-turkey-to-free-imprisoned-businessman","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2026\/08\/26\/european-rights-court-orders-turkey-to-free-imprisoned-businessman\/","title":{"rendered":"European rights court orders Turkey to free imprisoned businessman"},"content":{"rendered":"<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-126h8e-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">The European Court of Human Rights (ECHR) has ordered Turkey to immediately release Osman Kavala, an activist and philanthropist who has been detained in prison for almost a decade.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Kavala was sentenced to life behind bars in 2022 for charges related to nationwide protests in 2013 and a failed coup attempt three years later.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Since his initial arrest and detention in 2017, rights groups and Kavala himself have maintained that the charges against him are politically motivated.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The ECHR on Tuesday ruled that his continued detention was unlawful and that his rights to a fair trial, freedom of expression and association had been violated.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;The measures taken against the applicant&#8230; had been predominantly motivated by an ulterior purpose, namely, to punish him for his role in the Gezi Park demonstrations and for expressing his opinions as a human rights defender, and to silence him,&#8221;\u00a0<a href=\"https:\/\/hudoc.echr.coe.int\/eng-press?i=003-6587080-8727102\" target=\"_blank\" rel=\"noopener\">the court said in its ruling<\/a>.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The court also found that Kavala&#8217;s aggravated life sentence amounted to &#8220;inhuman and degrading treatment&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Rights advocates and opposition groups say President Recep Tayyip Erdogan&#8217;s government has increasingly weaponised the judiciary to target critics and rivals.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The court said Kavala&#8217;s case had exposed a &#8220;systemic problem&#8221; in Turkey of the &#8220;detention and prosecution of political opponents, human rights defenders and journalists&#8221;, adding that there were &#8220;structural shortcomings which affected the guarantees of independence and impartiality of the judiciary&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Turkish government has insisted the country&#8217;s courts are independent.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"links\">\n<div class=\"ssrcss-126h8e-Spacer e1aon0op0\">\n<div class=\"ssrcss-1gccci3-Stack e1y4nx260\">\n<ul class=\"ssrcss-94r6ik-Stack e1y4nx260\" role=\"list\">\n<li class=\"ssrcss-qzx51b-LinkItem e3eyuya1\">\n<div class=\"ssrcss-1gccci3-Stack e1y4nx260\">\n<p class=\"ssrcss-7zrqh4-LinkHeadline e3eyuya4\"><a href=\"https:\/\/www.bbc.co.uk\/news\/world-europe-61218241\" target=\"_blank\" rel=\"noopener\"><span aria-hidden=\"false\">Turkish activist sentenced to life in prison<\/span><\/a><\/p>\n<\/div>\n<\/li>\n<li class=\"ssrcss-qzx51b-LinkItem e3eyuya1\">\n<div class=\"ssrcss-1gccci3-Stack e1y4nx260\">\n<p class=\"ssrcss-7zrqh4-LinkHeadline e3eyuya4\"><a href=\"https:\/\/www.bbc.co.uk\/news\/world-europe-59385194\" target=\"_blank\" rel=\"noopener\"><span aria-hidden=\"false\">The case that set Turkey on collision course with the West<\/span><\/a><\/p>\n<\/div>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-126h8e-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Kavala, 68, became a symbol of a government crackdown on civil society in Turkey following his arrest in October 2017.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">He and others were accused of orchestrating and financing anti-government protests in 2013, which started in Istanbul&#8217;s Gezi park before spreading across Turkey.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The demonstrations posed the first serious challenge to the rule of Erdogan, who was Turkey&#8217;s dominant prime minister at the time and became its directly elected president the following year.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Human rights group Amnesty International says prosecutors falsely alleged that the Gezi park protests were an attempt to overthrow the government.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In 2019, the ECHR demanded Kavala&#8217;s immediate release, describing his detention as arbitrary and politically motivated. Turkey did not implement the ruling.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">He was initially acquitted in February 2020 but within hours was rearrested on new charges of being part of a failed military coup in 2016.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">His acquittal over the Gezi Park protests was overturned in January 2021, and he was sentenced to life in prison in April 2022 &#8211; a conviction now declared &#8220;null and void&#8221; by the ECHR.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Reacting to the latest ECHR ruling, Amnesty International&#8217;s Eve Geddie said: &#8220;This obstruction of justice must end. Turkey&#8217;s authorities, including judicial and prosecutorial, must act to free Osman Kavala immediately and unconditionally.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Kavala was born in Paris and educated in the UK. Before being thrust to prominence, he ran a cultural centre.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Erdogan has previously accused Kavala of being an agent of the Hungarian-born US billionaire George Soros.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Turkey has refused to comply with the two previous ECHR rulings on Kavala&#8217;s case, and it is not clear whether Ankara will implement the court&#8217;s third binding ruling.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The case remains one of the most serious recent flashpoints between Ankara and Strasbourg.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Council of Europe oversees how its 46 member states execute ECHR rulings.
