Sweeping presidential authority over &#8216;independent&#8217; regulators<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-126h8e-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Nearly 100 years ago, the Supreme Court ruled unanimously that Democratic President Franklin Delano Roosevelt did not have unchecked power to replace commissioners on regulatory agencies set up by Congress to be insulated from presidential authority.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">On Monday, facing a challenge by Republican Trump, the court decisively scrapped that precedent.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Subordinates who exercise the president&#8217;s power are subject to removal by him,&#8221; Chief Justice John Roberts wrote in the majority opinion. &#8220;Then, and only then, can they remain accountable to the president, and the president to the people.&#8221;<\/p>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-126h8e-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In this ruling, the court&#8217;s justices divided into familiar groupings. All six conservatives, three of whom were appointed by Trump, found in favour of the president. The three liberal justices, all appointed by Democrats, dissented.<\/p>\n<div class=\"ssrcss-2st5ed-ListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><a class=\"ssrcss-1e0jzsh-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c93629rzpgxo\" target=\"_blank\" rel=\"noopener\">Supreme Court allows late-arriving mail-in ballots in defeat for Trump<\/a><\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><a class=\"ssrcss-1e0jzsh-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cn8q2z5wpn2o\" target=\"_blank\" rel=\"noopener\">Trump&#8217;s final appeal of E Jean Carroll sex abuse case rejected<\/a><\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><a class=\"ssrcss-1e0jzsh-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cy4wwy0nkeno\" target=\"_blank\" rel=\"noopener\">Supreme Court blocks Trump&#8217;s attempt to fire Federal Reserve governor Lisa Cook<\/a><\/p>\n<\/li>\n<\/ul>\n<\/div>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The court&#8217;s decision will give Trump, and all future presidents, broad power to remove and replace regulators from dozens of key agencies with whom they disagree.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Federal Trade Commission was directly at issue in this case (as it was in Roosevelt&#8217;s), but the precedent the court sets here will apply to regulatory bodies interpreting election laws, issuing communications policies, resolving labour disputes and establishing financial and environmental regulations.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">By now, Americans are used to dramatic policy swings when a president of a different political party takes over the presidency \u2013 from Barack Obama to Trump to Joe Biden and back to Trump. This court&#8217;s decision is sure to supercharge that trend.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Ninety years of precedent has been completely and unequivocally overruled,&#8221; Trump exclaimed in a Truth Social post after the decision, &#8220;greatly increasing presidential power at a time when it is most needed!&#8221;<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-usmnse-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"2-Liberal-justices-find-conservative-allies-\u2013-much-to-Trumps-dismay\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">2. Roberts warned of the &#8220;calamities that could arise&#8221; if presidents were able to impose their will on the Federal Reserve.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If that ruling weren&#8217;t enough of a setback for the president, another court decision on Monday \u2013 on whether federal law prohibits states from counting mail-in ballots postmarked by election day but received after \u2013 broke against the president.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In that case, the three liberal justices were joined by Roberts as well as Trump-appointee Amy Coney Barrett, who penned the majority opinion.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">States have broad powers to set the &#8220;time, place and manner&#8221; of holding congressional elections, Barrett wrote, quoting the US Constitution. She dismissed Trump&#8217;s allegations that mail-in balloting is susceptible to election fraud, indicating that this was an issue best resolved through the &#8220;democratic process&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Trump was quick to call for just that, urging Congress to pass his election-reform package that would significantly curtail mail-in voting.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Although the Republican-controlled House of Representatives has approved this legislation, Democrats \u2013 and a handful of Republicans \u2013 have blocked a vote in the Senate.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The president may have won sweeping new powers, but when it comes to two of his big policy goals \u2013 lower interest rates and election reform \u2013 the court majority was not his friend on Monday.<\/p>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-usmnse-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"3-Trumps-defamation-appeal-quietly-flops\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">3. Trump&#8217;s defamation appeal quietly flops<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-126h8e-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If Trump&#8217;s Truth Social account is any indication, the biggest source of his ire on Monday was buried in 28 pages of court orders released on Monday morning.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Listed among dozens of cases the justices chose not to weigh in on was &#8220;Trump, President of US v. Carroll, E.
