{"id":30734,"date":"2026-05-01T05:08:20","date_gmt":"2026-05-01T09:08:20","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=30734"},"modified":"2026-05-01T05:19:12","modified_gmt":"2026-05-01T09:19:12","slug":"the-british-renters-rights-act-comes-into-force-what-it-means-for-tenants-and-landlords","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2026\/05\/01\/the-british-renters-rights-act-comes-into-force-what-it-means-for-tenants-and-landlords\/","title":{"rendered":"The British Renters&#8217; Rights Act comes into force &#8211; what it means for tenants and landlords"},"content":{"rendered":"<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">Described as the biggest shake-up to renting in England for more than 30 years, new laws giving tenants more rights start on Friday 1 May 2026.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Renters&#8217; Rights Act aims to give more stability and security to the 11 million people who rent from private landlords.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The new rules also mean big changes for landlords, with some warning that there could be delays evicting bad tenants from their properties.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"How-long-will-tenants-be-able-to-rent-a-property-for\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">How long will tenants be able to rent a property for?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Fixed-term tenancies, where renters are tied into contracts lasting for 12 or 24 months, are banned under the new rules. Instead, properties will be rented on a &#8220;periodic&#8221; or rolling basis.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">This means that tenants who wish to remain in a property can do so. The government says the change will provide renters with greater security.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Tenants who want to leave can give two months&#8217; notice. The government says this will end &#8220;the injustice of tenants being trapped paying rent for substandard properties&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Existing tenants do not need to sign a new contract as the change happens automatically.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If you rent your home, your landlord or agent must provide you with an\u00a0<a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/69bc04b8f7b1c24d8e23ce60\/The_Renters__Rights_Act_Information_Sheet_2026.pdf\" target=\"_blank\" rel=\"noopener\">information sheet about the changes<\/a>.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Renters&#8217; Rights Act applies to England. Scotland has had periodic agreements for tenancies since 2017, but Wales and Northern Ireland still allow fixed-term contracts.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"Will-landlords-be-able-to-evict-people-for-no-reason\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">Will landlords be able to evict people for no reason?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">More than 11,000 households in England had their homes repossessed by bailiffs following a Section 21 &#8220;no-fault&#8221; eviction in the year to June 2025.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Under the new law, it is significantly harder to evict tenants.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Any valid eviction notices issued before the end of April 2026 still apply.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But from 1 May, a landlord deciding to evict a tenant must have a valid legal reason to do so.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">This includes where the landlord wants to sell or move into a property &#8211; but not within the first 12 months of a tenancy.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Where a tenant is significantly behind on rent &#8211; known as being in rent arrears &#8211; the landlord will usually have to wait until they are owed three months&#8217; money before giving notice.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However tenants who damage the property or commit antisocial behaviour can be given notice at any point.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"How-much-notice-do-landlords-have-to-give-when-they-have-a-valid-reason-to-evict-a-tenant\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">How much notice do landlords have to give when they have a valid reason to evict a tenant?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Landlords need to give four months&#8217; notice.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Under the new rules, if a tenant does not leave after that period, a judge will decide whether to order possession of the property.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If the tenant has significant rent arrears, they can be given four weeks&#8217; notice.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If the tenant has committed antisocial behaviour, a landlord can go to court immediately upon giving notice.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In court, the landlord must prove the grounds for eviction have been met, and the tenant can provide a defence.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The court will not be able to award possession for 14 days after notice was given, to allow tenants time to access support.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"How-have-landlords-reacted-to-the-changes-to-eviction-rules\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">How have landlords reacted to the changes to eviction rules?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Some landlord groups are concerned that requiring court hearings for disputes could worsen already lengthy delays<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">According to the Ministry of Justice, private landlords currently wait 26 weeks &#8211; the median figure &#8211; between bringing a claim and being able to repossess a property. Ten years ago, the figure was approximately 16 weeks.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The government says it is recruiting up to 1,000 judges and tribunal members across all courts and tribunals.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Some landlords have warned that they could leave the market because of the changes.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><a href=\"https:\/\/mhclgmedia.blog.gov.uk\/2026\/03\/20\/%f0%9f%9b%8e%ef%b8%8f-landlords-here-are-6-ways-to-get-yourself-ready-for-new-renters-rights\/\" target=\"_blank\" rel=\"noopener\">Advice for landlords published by the government<\/a>\u00a0includes a reminder that tenants must be given the information sheet on how the Renters&#8217; Rights Act affects their tenancy.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"links\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div class=\"ssrcss-1gccci3-Stack e1y4nx260\">\n<ul class=\"ssrcss-94r6ik-Stack e1y4nx260\" role=\"list\">\n<li class=\"ssrcss-qzx51b-LinkItem e3eyuya1\">\n<div class=\"ssrcss-1gccci3-Stack e1y4nx260\">\n<p class=\"ssrcss-7zrqh4-LinkHeadline e3eyuya4\"><a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cje453e2xxpo\" target=\"_blank\" rel=\"noopener\"><span aria-hidden=\"false\">Landlords divided as new renters law looms<\/span><\/a><\/p>\n<\/div>\n<\/li>\n<li class=\"ssrcss-qzx51b-LinkItem e3eyuya1\">\n<div class=\"ssrcss-1gccci3-Stack e1y4nx260\">\n<p class=\"ssrcss-7zrqh4-LinkHeadline e3eyuya4\"><a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c30r5z3vdydo\" target=\"_blank\" rel=\"noopener\"><span aria-hidden=\"false\">My tenant owes \u00a315,000 in rent, but I can&#8217;t get them out of the property<\/span><\/a><\/p>\n<\/div>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"When-can-landlords-increase-the-rent\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">When can landlords increase the rent?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Landlords will need to give two months&#8217; notice and can only increase rent once a year to the property&#8217;s &#8220;open market rent&#8221;. This means the amount they could reasonably expect to receive if the property was advertised the next day.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If a tenant believes the amount is too high, they can challenge the landlord at a type of civil court called a first-tier tribunal.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Bidding wars&#8221; are now illegal, meaning new tenants cannot be asked to pay more than the advertised price.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-l7emlr-ComponentWrapper e1aon0op1\" data-block=\"flourish\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div class=\"ssrcss-147e9zi-FlourishWrapper eockrme0\">\n<div id=\"28684571\">\n<div data-component=\"include-html\"><iframe loading=\"lazy\" title=\"Interactive or visual content\" src=\"https:\/\/flo.uri.sh\/visualisation\/28684571\/embed?auto=1\" width=\"700\" height=\"575\" frameborder=\"0\" scrolling=\"no\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p>&nbsp;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Average UK monthly private rents increased by 3.5%, to \u00a31,377, in the 12 months to January 2026 according to a provisional estimate by the Office for National Statistics (ONS).<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Some campaigners in England have called for rent caps to be introduced in England, but the government has no plans to bring them in.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Scotland has announced it will bring in rent controls, which are expected to start in 2027<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"links\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div class=\"ssrcss-1gccci3-Stack e1y4nx260\">\n<ul class=\"ssrcss-94r6ik-Stack e1y4nx260\" role=\"list\">\n<li class=\"ssrcss-qzx51b-LinkItem e3eyuya1\">\n<div class=\"ssrcss-1gccci3-Stack e1y4nx260\">\n<p class=\"ssrcss-7zrqh4-LinkHeadline e3eyuya4\"><a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/ce8eyr5y64xo\" target=\"_blank\" rel=\"noopener\"><span aria-hidden=\"false\">Rent controls are coming to the UK &#8211; but they&#8217;re not a guaranteed win for tenants<\/span><\/a><\/p>\n<\/div>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"How-much-deposit-will-tenants-have-to-pay\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">How much deposit will tenants have to pay?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">There are no changes to the rules of the\u00a0<a href=\"https:\/\/www.gov.uk\/tenancy-deposit-protection\" target=\"_blank\" rel=\"noopener\">protected deposit schemes<\/a>\u00a0currently operating in England to cover potential damages.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The maximum a landlord can ask for remains:<\/p>\n<div class=\"ssrcss-2st5ed-ListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">five weeks&#8217; rent &#8211; if the rent for the year is less than \u00a350,000<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">six weeks&#8217; rent if the yearly rent is \u00a350,000 or more<\/p>\n<\/li>\n<\/ul>\n<\/div>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However, landlords will only be able to request one month&#8217;s rent in advance to secure a tenancy &#8211; or 28 days&#8217; rent for tenancies with rental periods of less than one month.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Some landlords warn this could mean groups with insecure income, or overseas students, could be less likely to find a home in future. Many would previously have paid several months&#8217; rent in advance.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Landlords are still able to request a guarantor to take responsibility for rent payments if the tenant falls behind.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"What-if-tenants-receive-benefits-or-have-children\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">What if tenants receive benefits or have children?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It will be illegal for landlords and agents to discriminate against prospective tenants who receive benefits or who have children.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However, landlords and agents will still be able to do reference and affordability checks before selecting a tenant.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"Can-tenants-have-pets-in-a-rented-home\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">Can tenants have pets in a rented home?<\/span><\/h2>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">A landlord must consider a request to have a pet and cannot &#8220;unreasonably&#8221; refuse.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Tenants will be able to challenge decisions if they think they are unfair.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">A landlord may be able to refuse a pet if:<\/p>\n<div class=\"ssrcss-2st5ed-ListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">another tenant has an allergy<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">the property is too small for a large pet or several pets<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">the pet is illegal<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">the landlord is a leaseholder, and the freeholder does not allow pets<\/p>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"subheadline\">\n<div class=\"ssrcss-18pjzom-Spacer e1aon0op0\">\n<div data-testid=\"subheadline\">\n<h2 id=\"How-will-the-new-laws-affect-students\" class=\"ssrcss-1sc9t00-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">How will the new laws affect students?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\" data-block=\"text\">\n<div class=\"ssrcss-oyhass-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Tenants who live in purpose-built student accommodation &#8211; often owned by universities or large companies &#8211; will still be able to enter fixed-term tenancy agreements.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Students in these homes will have security for the duration of the academic year. However, they can be given two weeks&#8217; notice to leave once the fixed-term agreement has ended.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Private landlords who rent to students will be able to serve four months&#8217; notice with a move-out date between June and September.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">This is to allow time to find new tenants for the next academic year.
