{"id":30,"date":"2016-09-03T16:25:38","date_gmt":"2016-09-03T20:25:38","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=30"},"modified":"2016-09-03T16:27:16","modified_gmt":"2016-09-03T20:27:16","slug":"charges-dismissed-against-former-jersey-city-police-chief","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2016\/09\/03\/charges-dismissed-against-former-jersey-city-police-chief\/","title":{"rendered":"Charges dismissed against former Jersey City Police Chief"},"content":{"rendered":"<div id=\"top_images\">\n<div class=\"Caption\">A judge has dismissed all charges against former Jersey City Police Chief Robert Cowan in a lawsuit filed by a city police officer who was charged with drunken driving in 2013 and claimed his arrest was an act of political revenge.<\/div>\n<\/div>\n<div id=\"Byline\"><\/div>\n<div id=\"article_container\">\n<div id=\"Byline\">\n<div class=\"EmailPrint\"><\/div>\n<div class=\"EmailPrint\">Officer Michael Lang, a 10-year veteran of the department, alleged officers violated his civil rights when they arrested him on June 9, 2013 after a night drinking at Healy&#8217;s Tavern celebrating a friend&#8217;s birthday. Lang, a supporter of former Jersey City Mayor Jerramiah Healy, filed a five-county lawsuit in Hudson County in August 2014 alleging his DWI arrest was a result of not supporting Mayor Steve Fulop in his bid to unseat Healy in the 2013 election.<\/div>\n<\/div>\n<div class=\"entry-content\">\n<p>The drunken driving charges\u00a0lodged against Lang\u00a0were dismissed in 2014 by a judge who found the officers who arrested him\u00a0had no probable cause.<\/p>\n<p>In a <a href=\"https:\/\/www.documentcloud.org\/documents\/3038457-SOR-CaptCity-Lang-v-JC.html\">77-page ruling<\/a> filed Wednesday, Superior Court Judge Daniel D&#8217;Alessandro wrote that Lang had not provided sufficient evidence to support his claims. Lang&#8217;s lawsuit &#8211; which also names Jersey City and Cowan&#8217;s brother, Capt. Thomas Cowan as defendants &#8211; alleges political association retaliation, malicious prosecution, false arrest, abuse of process and municipal liability.<\/p>\n<p>The judge notes that in a deposition, Lang was asked &#8220;You agree that you have no evidence that Robert Cowan has knowledge of your political support for Jeremiah Healy?&#8221;<\/p>\n<p>Lang&#8217;s reply was, &#8220;Correct.&#8221;<\/p>\n<p>In addition to dismissing all claims against the former chief, the court dismissed Lang&#8217;s claim of political retaliation against Thomas Cowan and the city. However, D&#8217;Alessandro denied the motion to dismiss the claims for malicious prosecution and false arrest against Thomas Cowan.<\/p>\n<p>Lang&#8217;s lawsuit was one of several brought against Robert Cowan by officers.
