He previously admitted stealing and distributing numerous DVD and Blu-ray discs, including &#8216;Spider-Man: No Way Home&#8217;. The recommendation is largely based on an unconnected firearm charge, not copyright infringement. The MPA has requested to speak at the sentencing hearing, noting that the movie studio victims likely lost tens of millions of dollars.<\/p>\n<p>Three years ago, pirated Blu-ray copies of \u2018Spider-Man: No Way Home\u2019\u00a0<a href=\"https:\/\/torrentfreak.com\/spider-man-no-way-home-blu-ray-leaks-early-on-pirate-sites-220311\/\" target=\"_blank\" rel=\"noopener\">began circulating<\/a>\u00a0on pirate sites, weeks before the film\u2019s official release.<\/p>\n<p>Shortly before, pre-release discs were offered in an eBay listing, suggesting that someone had managed to get their hands on several pre-release copies of the film. The exact source and circumstances were unknown.<\/p>\n<p>Earlier this year, the mystery was partly solved when the U.S. Department of Justice indicted the alleged wrongdoer. Following an in-depth investigation by the FBI, the authorities\u00a0<a href=\"https:\/\/torrentfreak.com\/employee-charged-in-spider-man-pre-release-blu-ray-theft-linked-to-mass-piracy-250309\/\" target=\"_blank\" rel=\"noopener\">indicted 37-year-old Steven Hale<\/a>, accusing him of stealing several Blu-rays and DVDs from his former employer; a disc manufacturing and distribution company in Memphis.<\/p>\n<p>In May, Hale\u00a0<a href=\"https:\/\/torrentfreak.com\/employee-pleads-guilty-in-spider-man-pre-release-piracy-case\/\" target=\"_blank\" rel=\"noopener\">pleaded guilty<\/a>\u00a0to stealing and distributing numerous DVD and Blu-ray discs for commercial advantage and private financial gain. Among them, the pre-released \u2018Spider-Man: No Way Home\u2019 and other titles such as \u2018Venom: Let There Be Carnage,\u2019 \u2018Encanto,\u2019 and \u2018The Matrix Resurrections.\u2019<\/p>\n<h2>Firearm Charge<\/h2>\n<p>In addition to the copyright infringement charge, Hale was also indicted for a firearm offense. When raiding his premises, law enforcement found a gun in a car that was registered in his name, which, for a felon, is a separate criminal offense.<\/p>\n<p>The defense argued that the gun, which was loaded, didn\u2019t belong to Hale but to his father. In addition, Hale\u2019s attorney also stressed that it \u201cwas simply there by coincidence,\u201d not to facilitate the copyright infringement.<\/p>\n<p>The government agrees that there\u2019s no apparent connection between the firearm and the theft of the DVDs and Blu-rays. However, the \u2018coincidental\u2019 discovery doesn\u2019t necessarily mean a lower prison sentence.<\/p>\n<h2>Government Recommends a 57-Month Prison Sentence<\/h2>\n<p>This week, the U.S. Department of Justice (DoJ) shared its position on the upcoming sentencing with the court. The filing notes that this isn\u2019t the first time that the defendant has had a run-in with the law.<\/p>\n<p>\u201cThe defendant has an extensive criminal record involving armed robbery, attempted robbery, theft of property, and driving with a suspended license, as well as pending gun and drug charges,\u201d the DoJ writes.<\/p>\n<p>The filing also reveals Hale\u2019s theft of the films was deliberate and methodical, stating he would hide boxes of DVDs near a \u201cmalfunctioning emergency door,\u201d cut the security tape, and then move them to his vehicle after hours to avoid detection.<\/p>\n<p>&nbsp;<\/p>\n<p><center><em>From the DoJ filing<\/em><\/center>&nbsp;<\/p>\n<p><center><picture class=\"alignnone size-full wp-image-271509\"><source srcset=\"https:\/\/torrentfreak.com\/images\/halecirc-1.jpg.webp 1522w, https:\/\/torrentfreak.com\/images\/halecirc-1-300x185.jpg.webp 300w\" type=\"image\/webp\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/torrentfreak.com\/images\/halecirc-1.jpg\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" srcset=\"https:\/\/torrentfreak.com\/images\/halecirc-1.jpg 1522w, https:\/\/torrentfreak.com\/images\/halecirc-1-300x185.jpg 300w, https:\/\/torrentfreak.com\/images\/halecirc-1-600x371.jpg 600w, https:\/\/torrentfreak.com\/images\/halecirc-1-150x93.jpg 150w\" alt=\"\" width=\"600\" height=\"371\" \/><\/picture><\/center>&nbsp;<\/p>\n<p>Interestingly, the government agrees with the defense that the gun was not specifically linked to the copyright infringement. In fact, the DoJ views these as separate offenses.<\/p>\n<p>\u201cIn this case, there is no indication that the defendant possessed or used a firearm to steal DVDs from his employer or commit copyright infringement,\u201d the recommendation reads.<\/p>\n<p>This is not necessarily good news for the defendant, as the DoJ further argues that both crimes should not be grouped at all, contrary to a suggestion in the pre-sentence report. Instead, the DoJ requests separate sentences for both crimes, to be served concurrently.<\/p>\n<p>In this case, the government recommends a 57-month prison sentence for the firearm charge, which is at the low end of their 57- to 71-month calculation. This is higher than the 21-month prison sentence it recommends for the copyright infringement.<\/p>\n<p>If the court agrees, the defendant will have to serve the longest sentence, which is related to the firearms charge.<\/p>\n<h2>Defense Hopes for Leniency<\/h2>\n<p>Earlier this month, the defense called for a lower sentence, also arguing that the gun had nothing to do with the stolen movies.<\/p>\n<p>The defense\u2019s strategy focused on lowering the sentence in other ways, concluding that 37 to 46 months would be a more suitable sentencing range.<\/p>\n<p>This lower sentence would be appropriate considering that the gun was not Hale\u2019s and \u201cthere by coincidence.\u201d In addition, the defense argued that his previous attempted robbery conviction should not count as a \u201ccrime of violence\u201d.<\/p>\n<p>Hale\u2019s attorney asked the court for leniency, painting a picture of a man who made a \u201cvery poor choice\u201d after struggling against difficult circumstances his entire life. Despite growing up impoverished, he managed to get a Bachelor of Science degree in Business Management.<\/p>\n<h2>MPA Requests to be Heard<\/h2>\n<p>With both sides heard, the Tennessee federal court is expected to announce Hale\u2019s sentence in the coming weeks. Interestingly, the MPA has asked to chime in before that happens.<\/p>\n<p>The movie industry group, which represents the victims in this case, indicated that it would like to address the court at sentencing.
