{"id":29610,"date":"2025-07-09T05:05:12","date_gmt":"2025-07-09T09:05:12","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=29610"},"modified":"2025-07-09T05:05:12","modified_gmt":"2025-07-09T09:05:12","slug":"jury-free-trials-recommended-to-save-courts-from-collapse","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2025\/07\/09\/jury-free-trials-recommended-to-save-courts-from-collapse\/","title":{"rendered":"Jury-free trials recommended to save courts from &#8216;collapse&#8217;"},"content":{"rendered":"<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">Thousands of cases that would normally be heard in front of a jury should be decided by judges alone, according to recommendations made by a former senior judge.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Sir Brian Leveson was asked by the Lord Chancellor to come up with a series of proposals to reduce the backlog of cases in the criminal courts.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">There are almost 77,000 cases waiting for trial in the Crown Court in England and Wales &#8211; meaning some defendants and victims are waiting years for justice.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">After reviewing the state of the criminal courts, Sir Brian suggested &#8220;fundamental&#8221; reforms to &#8220;reduce the risk of total system collapse&#8221;. But some barristers argue juries are essential for fair justice &#8211; and scrapping them is wrong.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">To fix what he calls a broken system, Sir Brian has suggested having judge-only trials for certain cases such as fraud and bribery.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Another recommendation involves having more out of court resolutions like cautions.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">He wants a new division of the Crown Court with two magistrates and a judge to handle less serious offences, and to increase the number of sentence reductions for guilty pleas at the first opportunity offered.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">This is all about shortening the process in the hope of cutting the big backlog.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Our criminal justice system stands at a critical juncture,&#8221; said\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c5y85lwpzv3o\" target=\"_blank\" rel=\"noopener\">Sir Brian who was requested to look into the matter in December<\/a>\u00a0last year.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Challenged on BBC Breakfast whether the right to a jury trial in the UK was a basic right, Sir Brian said: &#8220;You say it&#8217;s a basic right &#8211; your right is your right to a fair trial.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;One of the consequences of the delay is victims, witnesses and indeed defendants are kept waiting for years and years and can&#8217;t move on with their lives. Something has got to be done to try and address that.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;If we don&#8217;t do something very dramatic, these cases will get longer and longer delayed.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Sir Brian added: &#8220;These are not small tweaks but fundamental changes that will seek to make the system fit for the 21st century.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The proposals would mean more cases will be heard in the magistrates&#8217; courts, with jury trials reserved for the most serious cases.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Either-way offences &#8211; those which can be heard in a Crown Court or a magistrates court &#8211; with a maximum custodial sentence of two years or less, such as possession of drugs, bike theft and voyeurism, could face lower penalties of 12 months imprisonment or less.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Defendants in cases for offences including assault of an emergency worker, stalking and possessing an indecent photograph of a child would also no longer be able to choose a jury trial.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-1o1fzgd-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"Radical-change\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">&#8216;Radical change&#8217;<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Not all lawyers agree with the suggested changes, however.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">And in response, Mary Prior KC, chair of the Criminal Bar Association, said: &#8220;Any fundamental change is going to require the criminal barristers who prosecute and defend in the Crown Court to believe that this is the best way forward.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;As this is such a radical change to the criminal justice system we will be listening to what our members say. There is a lot to digest.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Manisha Knights, Solicitor Advocate with MK Law, said: &#8220;Our jury system is central and pivotal to our justice system.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;With juries comes diversity whereas the judiciary still very much lacks it. The right to be tried by one&#8217;s peers should not be removed or be diluted in any way, shape or form.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The English and Welsh legal system is widely regarded as one of the best and most independent in the world, with\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/teach\/class-clips-video\/articles\/z6wjmfr\" target=\"_blank\" rel=\"noopener\">the first known English jury trial dating from the 1200s.<\/a><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Not all countries commonly use juries, however &#8211; for example Germany has no juries while France reserves them for the most serious cases.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Non-jury trials have been used in Northern Ireland since 1973 to prevent jury intimidation or bias in terrorism prosecutions.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">At the height of the Troubles, more than 300 cases a year were tried by a judge sitting alone but in 2023 there were just 12 non-jury trials.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Legislation allowing their use must be renewed every two years by Parliament.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Magistrates&#8217; Association welcomed the review, saying it will speed up justice for thousands.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Magistrates are ready and willing to support these and other initiatives aimed at reducing the pressure on Crown Courts,&#8221; said Mark Beattie, national chair of the Magistrates&#8217; Association.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;We urge the government to implement Leveson&#8217;s recommendations as soon as possible. Every day that they aren&#8217;t in place, is a day when victims, witnesses and defendants have to wait for justice.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Met Police Commissioner Sir Mark Rowley said: &#8220;As Sir Brian rightly identifies, criminal justice in this country runs the risk of &#8216;total system collapse&#8217; unless we take the radical steps needed to reverse years of decline.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;It cannot be right that in London more than 100 trials listed are for 2029. This is intolerable for victims and all parties who rely on a properly functioning court system to provide closure from what are often traumatic experiences, made worse by persistent delays.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">He added: &#8220;I welcome this report and look forward to working with partners across government to deliver the bold reforms that are now a necessity, not an option.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">Among the recommendations are:<\/b><\/p>\n<div class=\"ssrcss-h5qd1q-ListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">A reclassification of certain offences<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The creation of a new division of the Crown Court with two magistrates and a judge to handle &#8220;less serious offences&#8221;, which would include some theft, burglary, and fraud offences<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Greater use of out of court resolutions &#8211; which would allow the police to deal quickly with lower level, often first time offending &#8211; including increased use of cautions and conditional cautions<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Removal of the right to elect trial in cases where the maximum sentence is two years&#8217; imprisonment with reclassification of some offences to &#8220;summary only&#8221; (meaning they will only be heard in a magistrates&#8217; court)<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The threshold for criminal damage being dealt with as a summary only offence to be increased from \u00a35,000 to \u00a310,000.<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Maximum sentence reduction increased to 40% for guilty pleas at first opportunity, encouraging quicker case resolution<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Judge-alone trials introduced either by election on the part of the defendant or for the most complex cases<\/p>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The review recommended the immediate implementation of key reforms but acknowledged that many of the changes will take time to introduce, and &#8220;must be managed carefully to ensure the public is never put at risk&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The government says it will now consider all of Sir Brian&#8217;s recommendations, and will respond in full ahead of legislation in the autumn.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Lord Chancellor and Justice Secretary Shabana Mahmood said in a statement: &#8220;I have already lifted courts funding to record levels, funding 4,000 more court sitting days than under my predecessors.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;But swifter justice requires bold reform, and that is what I asked Sir Brian Leveson to propose.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">She added: &#8220;As part of our Plan for Change, I will do whatever it takes to bring down the backlog and deliver swifter justice for victims.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">A second review focusing on court efficiency will be published later this year.<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cm2m808kml0o\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">Thousands of cases that would normally be heard in front of a jury should be decided by judges alone, according to recommendations made by a former senior judge.
