{"id":29392,"date":"2025-05-21T07:23:39","date_gmt":"2025-05-21T11:23:39","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=29392"},"modified":"2025-05-21T07:23:39","modified_gmt":"2025-05-21T11:23:39","slug":"uk-supreme-court-backs-wild-camping-on-dartmoor","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2025\/05\/21\/uk-supreme-court-backs-wild-camping-on-dartmoor\/","title":{"rendered":"UK Supreme Court backs wild camping on Dartmoor"},"content":{"rendered":"<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">The legal right to wild camp on Dartmoor has been\u00a0<\/b><a href=\"https:\/\/www.supremecourt.uk\/cases\/uksc-2023-0126\" target=\"_blank\" rel=\"noopener\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">upheld by the Supreme Court<\/b><\/a><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">\u00a0in a decision that is likely to reignite the debate over public access to land in England.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Judges unanimously rejected an appeal by landowners Alexander and Diana Darwall who said people should not be able to camp without permission from landowners.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In England there is no general right to wild camp on most private land but Dartmoor National Park in Devon is a rare exception.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Darwalls said they were &#8220;disappointed&#8221; by the judgement adding: &#8220;Hollowing out the role of landowners and farmers will not improve the vitality of the Dartmoor Commons.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<div class=\"ssrcss-h5qd1q-ListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c24995gjdy0o\" target=\"_blank\" rel=\"noopener\">How did we get to Dartmoor wild camping ruling?<\/a><\/p>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The judgement centred on the interpretation of the 1985 Dartmoor Commons Act that states &#8220;the public shall have a right of access to the commons on foot and horseback for the purpose of open-air recreation&#8221; of people&#8217;s use of Dartmoor was &#8220;likely to be more effective in protecting the land than attempts by private persons to challenge such use through themselves having to confront people on their land and bring a claim in private law&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Dartmoor National Park Association said it was &#8220;delighted and relieved&#8221; by the ruling.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Chief executive Dr Kevin Bishop said: &#8220;This is a landmark judgment not just for Dartmoor National Park but for people who have long campaigned for access rights.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;The judgement reaffirms our long-held belief for the public&#8217;s right to backpack camp on certain commons and, importantly, our role in regulating and managing that access.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-1o1fzgd-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"Work-with-us\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">&#8216;Work with us&#8217;<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">He added that people did not have a &#8220;blanket right to camp wherever, or do whatever, you want&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;With the right comes a responsibility to make sure that you tread lightly and leave no trace,&#8221; at the judgement.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;I think it&#8217;s shown the huge public interest in this case that people responsibly wild camp on Dartmoor every year and want to be able to continue to do so,&#8221; he said.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">He said it was &#8220;very unusual and odd that Dartmoor is the only place in England, Wales, where you can legally wild camp&#8221; and Right to Roam would be pressing the government to &#8220;extend that right to wild camp to other parts of England&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;People want a greater right of access to the countryside, let&#8217;s pass a new law that gives people the right to roam,&#8221; she said.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;We must now stimulate ministers to legislate in the same spirit across our countryside.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Caroline Voaden, Liberal Democrat MP for South Devon, said she was &#8220;absolutely thrilled&#8221; with the ruling.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;It is a vindication of something we&#8217;ve all known for a long time, that the stars are for everyone, and that access to nature is not a nice to have, but a fundamental necessity for a happy, healthy life.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Wild camping is good for body and soul, I&#8217;m very pleased the judges could see this.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-suhx0k-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-1o5p6v2-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Darwalls said they brought the case in order to safeguard Dartmoor.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Our aim from the outset was to protect and preserve Dartmoor, its flora and fauna,&#8221;
