{"id":28973,"date":"2025-02-24T06:29:31","date_gmt":"2025-02-24T11:29:31","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=28973"},"modified":"2025-02-24T06:29:31","modified_gmt":"2025-02-24T11:29:31","slug":"waspi-women-threaten-government-with-legal-action-over-refusal-to-pay-compensation","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2025\/02\/24\/waspi-women-threaten-government-with-legal-action-over-refusal-to-pay-compensation\/","title":{"rendered":"Waspi women threaten government with legal action over refusal to pay compensation"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">Campaigners have threatened the government with legal action unless it reconsiders the decision to refuse compensation to millions of women affected by an increase in the state pension age.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Women Against State Pension Inequality (Waspi) group is demanding payouts for 3.6 million women born in the 1950s who were not properly informed of changes first introduced in the 1990s.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The government apologised that the changes were not communicated quickly enough but told the BBC it &#8220;cannot justify paying for a \u00a310.5bn compensation scheme at the expense of the taxpayer&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Waspi chair Angela Madden said: &#8220;We believe this is not only an outrage but legally wrong.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The &#8220;letter before action&#8221; that has been sent to the government is a formal mechanism to allow it a chance to respond before the campaigners seek a judicial review at the High Court in two weeks time.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Last year the parliamentary ombudsman recommended payouts of up to \u00a32,950 each because of a 28-month\u00a0delay\u00a0in\u00a0writing\u00a0to\u00a0inform\u00a0the women affected of the changes.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Waspi\u00a0campaigners\u00a0have\u00a0claimed\u00a0women\u00a0suffered\u00a0financial\u00a0hardship\u00a0and\u00a0had\u00a0to rethink\u00a0retirement\u00a0plans.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However in December, Work and Pensions Secretary Liz Kendall apologised for the delayed communications but said there was &#8220;considerable awareness&#8221; of the changes to the pension age. She said sending letters earlier would not have made a difference to their ability to make retirement choices.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Her claim there was no direct financial loss could now be examined in court if the campaigners get approval for their judicial review.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-12l5xzx-LinksComponentWrapper e3eyuya0\" data-component=\"links-block\">\n<section class=\"ssrcss-msolhr-LinksWrapper e3eyuya5\">\n<ul class=\"ssrcss-1y914pf-InContentLinksGrid e3eyuya3\" role=\"list\">\n<li class=\"ssrcss-r2yl4r-PromoItem e3eyuya1\">\n<div class=\"ssrcss-s1qr4x-Promo e1vyq2e80\" data-testid=\"promo\">\n<div class=\"ssrcss-1enzf19-PromoCompact e18gnqux0\">\n<div class=\"ssrcss-1d68cot-PromoContent exn3ah99\">\n<div class=\"ssrcss-1f3bvyz-Stack e1y4nx260\">\n<p class=\"ssrcss-1sen9vx-PromoHeadline exn3ah96\"><a href=\"https:\/\/www.bbc.co.uk\/news\/uk-49919029\" target=\"_blank\" rel=\"noopener\"><span aria-hidden=\"false\">What is the row about women&#8217;s pensions?<\/span><\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/li>\n<li class=\"ssrcss-r2yl4r-PromoItem e3eyuya1\">\n<div class=\"ssrcss-s1qr4x-Promo e1vyq2e80\" data-testid=\"promo\">\n<div class=\"ssrcss-1enzf19-PromoCompact e18gnqux0\">\n<div class=\"ssrcss-1d68cot-PromoContent exn3ah99\">\n<div class=\"ssrcss-1f3bvyz-Stack e1y4nx260\">\n<p class=\"ssrcss-1sen9vx-PromoHeadline exn3ah96\"><a href=\"https:\/\/www.bbc.co.uk\/news\/business-68610680\" target=\"_blank\" rel=\"noopener\"><span aria-hidden=\"false\">&#8216;I want the \u00a345,000 state pension that was stolen from me&#8217;<\/span><\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/li>\n<\/ul>\n<\/section>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Ms Madden said: &#8220;We will not allow the DWP&#8217;s gaslighting of Waspi women to go unchallenged.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;The government has accepted that 1950s-born women are victims of maladministration, but it now says none of us suffered any injustice.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">With no compensation forthcoming she said: &#8220;The alternative is continued defence of the indefensible but this time in front of a judge.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Waspi group has also launched a crowd-funding campaign to try to cover an estimated \u00a375,000 in legal fees.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If the women were to win their case it is estimated it could cost the government as much as \u00a310.5bn.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">With government finances already under strain because of weak economic growth and higher borrowing costs, Sir Keir Starmer has said &#8220;the taxpayer simply can&#8217;t afford the burden&#8221; of compensation.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The changes were first decided in 1995 when the then-Conservative government sought to equalise the age at which men and women received their state pensions, aiming that by 2020 everyone would have to wait until their 65th birthday.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However in the aftermath of the global financial crisis in 2010, the Conservative-Lib Dem coalition decided to speed up the changes, to reduce the overall cost of the state pension.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Other countries have made similar decisions in recent years &#8211; however the UK government did not communicate its change quickly enough and the impact of that could now be examined in court.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">A government spokesperson told the BBC on Sunday it accepted the ombudsman&#8217;s finding of maladministration and had apologised for the 28-month delay in writing to 1950s-born women.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;However, evidence showed only one-in-four people remember reading and receiving letters that they weren&#8217;t expecting and that by 2006, 90% of 1950s-born women knew that the state pension age was changing,&#8221; they said.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Earlier letters wouldn&#8217;t have affected this.&#8221;<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cwyjx9dn38wo\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">Campaigners have threatened the government with legal action unless it reconsiders the decision to refuse compensation to millions of women affected by an increase in the state pension age.
