{"id":28742,"date":"2024-12-07T07:10:08","date_gmt":"2024-12-07T12:10:08","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=28742"},"modified":"2024-12-07T07:10:08","modified_gmt":"2024-12-07T12:10:08","slug":"tiktok-faces-us-ban-after-losing-court-battle","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2024\/12\/07\/tiktok-faces-us-ban-after-losing-court-battle\/","title":{"rendered":"TikTok faces US ban after losing court battle"},"content":{"rendered":"<p>TikTok has lost an appeal against plans to ban the video-sharing app in the US.<\/p>\n<p>The social media platform had argued the proposal was a breach of the US First Amendment, which protects freedom of speech.<\/p>\n<p>TikTok pushed to overturn a law that could lead to its ban in a few months.<\/p>\n<p>However, the petition was dismissed on Friday by the US Court of Appeals for the District of Columbia Circuit.<\/p>\n<p>Its judges ruled\u00a0<strong><a href=\"https:\/\/news.sky.com\/story\/is-tiktok-getting-banned-what-would-us-bill-mean-and-could-it-happen-in-the-uk-13093787\" target=\"_blank\" rel=\"noopener\">the government&#8217;s ban<\/a><\/strong>\u00a0was constitutional because it was designed &#8220;solely to protect that freedom from a foreign adversary nation and to limit that adversary&#8217;s ability to gather data on people in the United States&#8221;.<\/p>\n<p>The law, which was\u00a0<strong><a href=\"https:\/\/news.sky.com\/story\/tiktok-ban-in-us-moves-a-step-closer-after-senate-passes-bill-to-force-parent-company-to-sell-platform-13121844\" target=\"_blank\" rel=\"noopener\">signed off by US President Joe Biden in April<\/a><\/strong>, requires TikTok to break ties with its China-based parent company ByteDance by mid-January &#8211; or else it will be blocked in the country.<\/p>\n<p>It was introduced following concern from some US politicians that the company might share user data with the Chinese government, despite repeated assurances from the firm that it would not.<\/p>\n<p>Critics have also expressed fears that\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/china-5869\" target=\"_blank\" rel=\"noopener\">Chinese authorities<\/a><\/strong>\u00a0may be able to manipulate TikTok&#8217;s algorithms, shaping what content users see and are influenced by. (Image: AP)<br \/>\n<\/span><\/figcaption><\/figure>\n<\/div>\n<p>&nbsp;<\/p>\n<p>However, the two firms could also be thrown a lifeline by <strong><a href=\"https:\/\/news.sky.com\/topic\/donald-trump-5711\" target=\"_blank\" rel=\"noopener\">Donald Trump<\/a><\/strong>, who is due to be sworn in as president on 20 January.<\/p>\n<p>Despite trying to introduce his own <strong><a href=\"https:\/\/news.sky.com\/topic\/tiktok-8490\" target=\"_blank\" rel=\"noopener\">TikTok<\/a><\/strong> ban during his first term as president, the Republican has since changed his mind.<\/p>\n<p>He said during the 2024 presidential campaign that he wanted to &#8220;save&#8221; the app and expressed concern that a ban would help its rival Facebook.<\/p>\n<p>Mr Trump also signed up to TikTok and currently has more than 14 million followers on the site, although he has not posted anything since his election victory.<\/p>\n<p>Reacting to Friday&#8217;s court ruling, a TikTok statement said: &#8220;The Supreme Court has an established historical record of protecting Americans&#8217; right to free speech, and we expect they will do just that on this important constitutional issue.<\/p>\n<p>&#8220;Unfortunately, the TikTok ban was conceived and pushed through based upon inaccurate, flawed and hypothetical information, resulting in outright censorship of the American people.&#8221;<\/p>\n<p>It added: &#8220;The TikTok ban, unless stopped, will silence the voices of over 170 million Americans here in the US and around the world on 19 January 2025.&#8221;<\/p>\n<p>Similar security concerns over TikTok prompted ministers in the UK to\u00a0<strong><a href=\"https:\/\/news.sky.com\/story\/uk-government-expected-to-ban-tiktok-from-work-phones-12835138\" target=\"_blank\" rel=\"noopener\">ban the app from government phones<\/a><\/strong>\u00a0in March last year.<\/p>\n<p>Some 13 US states and Washington DC also\u00a0<strong><a href=\"https:\/\/news.sky.com\/story\/tiktok-sued-by-13-us-states-for-harming-young-peoples-mental-health-13230453\" target=\"_blank\" rel=\"noopener\">launched legal action<\/a><\/strong>\u00a0against the social media platform in October, alleging it was harming children&#8217;s mental health and was not doing enough to protect them.<\/p>\n<p>TikTok dismissed the claims as &#8220;inaccurate and misleading&#8221;.<\/p>\n<p>Source: \u00a0<a href=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2016\/11\/sky-news-logo-1.png\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2016\/11\/sky-news-logo-1.png\" alt=\"Sky News\" width=\"100\" height=\"20\" \/><\/a> <a href=\"https:\/\/news.sky.com\/story\/tiktok-faces-us-ban-after-losing-court-battle-13268185\" target=\"_blank\" rel=\"noopener\">news.sky.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">TikTok has lost an appeal against plans to ban the video-sharing app in the US.
