{"id":28655,"date":"2024-11-26T05:22:31","date_gmt":"2024-11-26T10:22:31","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=28655"},"modified":"2024-11-26T05:22:31","modified_gmt":"2024-11-26T10:22:31","slug":"uk-supreme-court-to-hear-case-on-definition-of-a-woman","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2024\/11\/26\/uk-supreme-court-to-hear-case-on-definition-of-a-woman\/","title":{"rendered":"UK Supreme Court to hear case on definition of a woman"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">Judges at the Supreme Court are to consider how women are defined in law in a landmark case brought by Scottish campaigners.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It is the culmination of a long-running legal dispute which started with a relatively niche piece of legislation at the Scottish Parliament, but which could have big UK-wide implications.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It will set out exactly how the law is meant to treat trans people, and what it really means to go through the gender recognition process.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">And it could have implications for the running of single-sex spaces and services, and how measures aimed at tackling discrimination will operate in future.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"What-will-this-case-decide\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">What will this case decide?<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">At the most basic level, it will address what \u201csex\u201d actually means in law.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Is it about biology and chromosomes set at birth, or does it tie in ideas of gender identity and the gender recognition process?<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Gender Recognition Act of 2004 established the process for obtaining a gender recognition certificate &#8211; something it states amounts to a change of sex \u201cfor all purposes\u201d.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">When someone gets a gender recognition certificate, &#8220;if the acquired gender is the male gender, the person&#8217;s sex becomes that of a man, and if it is the female gender, the person&#8217;s sex becomes that of a woman&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Then the Equality Act of 2010 came along to set out legal protections against discrimination for specific groups &#8211; with \u201csex\u201d, &#8220;sexual orientation&#8221; and \u201cgender reassignment\u201d included as protected characteristics.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It simply defines a woman as &#8220;a female of any age&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">There has been much dispute about how these two pieces of legislation sit together.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">When the Equality Act talks about \u201csex\u201d, does it mean biological sex &#8211; or legal, &#8220;certificated&#8221; sex as defined by the GRA?<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">This case won\u2019t change the letter of the law, but a ruling on how it should be interpreted could have big implications for how all kinds of public bodies and services operate, and whether others might be open to legal challenges.<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">There has been particular controversy in light of the debate about whether the gender recognition process should be streamlined &#8211; there was a lengthy wrangle at Holyrood over \u201cself-identification\u201d reforms.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Those were ultimately\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-politics-64288757\" target=\"_blank\" rel=\"noopener\">blocked by the UK government<\/a>, which claimed they would have a &#8220;significant impact&#8221; on the Equality Act.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But it plays into a number of other rows, with Scotland\u2019s\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cz7w322230go\" target=\"_blank\" rel=\"noopener\">Rape Crisis network currently in turmoil<\/a>\u00a0about how its centres define women and provide single-sex spaces.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Public bodies have expressed frustration about a lack of clarity around interpretation of the law, having been left to work out policy on their own.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Police Scotland &#8211; which has faced questions over how it treats transgender people &#8211; has\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cvgl9gx9yjdo\" target=\"_blank\" rel=\"noopener\">criticised an \u201cabsence of direction\u201d<\/a>\u00a0from politicians in Edinburgh and London over how to reconcile the gender recognition process with the Equality Act.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">With political leaders increasingly wary of the topic and the fierce debates which go along with it, it has ultimately fallen to the courts to adjudicate.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"How-did-we-get-here\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">How did we get here?<\/span><\/h2>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">MSPs at Holyrood passed the Gender Representation on Public Boards (Scotland) Act in 2018, with the aim of getting more women onto public sector boards.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">That law\u2019s definition of \u201cwoman\u201d included people who were \u201cliving as a woman\u201d and were currently or proposing to undergo the gender reassignment process.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The campaign group For Women Scotland challenged this in court, and after a series of appeals\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-scotland-60435954\" target=\"_blank\" rel=\"noopener\">they eventually prevailed<\/a>.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Judges ruled that the definition used \u201cconflates and confuses two separate and distinct protected characteristics\u201d laid out in the Equality Act &#8211; a reserved piece of legislation which MSPs do not have the power to alter.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Scottish government had to amend the bill to remove the definition.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But at the same time they issued new guidance alongside the legislation, stating that it would include women as defined by the Equality Act &#8211; and also the Gender Recognition Act (GRA), to the effect that a full gender recognition certificate could be taken as a declaration of someone\u2019s sex \u201cfor all purposes\u201d.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">For Women Scotland challenged this guidance in a fresh judicial review, which ended in defeat.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Judge Lady Haldane ruled in December 2022 that the definition of sex\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-scotland-scotland-politics-63956604\" target=\"_blank\" rel=\"noopener\">was \u201cnot limited to biological or birth sex\u201d<\/a>, but included those in possession of a gender recognition certificate.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">That ruling is what For Women Scotland are challenging at the Supreme Court.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">They have\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-scotland-scotland-politics-67289999\">already lost one appeal<\/a>\u00a0in the Scottish courts, but judges in Edinburgh agreed to push the case straight to the Supreme Court in London for a definitive ruling.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"What-are-the-arguments\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">What are the arguments?<\/span><\/h2>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The issue being considered by the court is whether \u201ca person with a full gender recognition certificate &#8211; which recognises their gender is female &#8211; is a \u2018woman\u2019 for the purposes of the Equality Act\u201d.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">For Women Scotland say the answer to that question is no.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">They\u00a0<a href=\"https:\/\/forwomen.scot\/wp-content\/uploads\/2024\/10\/For-Women-Scotland-v-Scottish-Ministers-Written-Case-for-the-Appellant.pdf\" target=\"_blank\" rel=\"noopener\">argue<\/a>\u00a0that sex is a \u201cmatter of biological fact\u201d, and that \u201cthe ordinary, biological meaning of sex is necessary to ensure the rights and protections provided to women\u201d.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">They say the Equality Act consistently refers to sex in terms of \u201cimmutable biological criteria\u201d, and that it supersedes the GRA thanks to a subsection of the 2004 Act which nods to it being subject to \u201cprovision made by \u2026 any other enactment\u201d.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Scottish government meanwhile essentially\u00a0<a href=\"https:\/\/www.gov.scot\/binaries\/content\/documents\/govscot\/publications\/speech-statement\/2024\/11\/for-women-scotland-ltd-appellant-v-the-scottish-ministers-respondent-supreme-court-hearing-statement-of-case\/documents\/for-women-scotland-ltd-appellant-v-the-scottish-ministers-respondent-supreme-court-hearing-statement-of-case\/for-women-scotland-ltd-appellant-v-the-scottish-ministers-respondent-supreme-court-hearing-statement-of-case\/govscot%3Adocument\/For%2BWomen%2BScotland%2B%2528Appellants%2529%2Bv%2BScottish%2BMinisters%2B%2528Respondents%2529%2B%2BLord%2BAdvocate%2B%2528First%2BInterested%2BParty%2529%2B-%2Bwritten%2Bcase%2Bfor%2BScottish%2BMinisters%2Band%2BLord%2BAdvocate.pdf\" target=\"_blank\" rel=\"noopener\">argues<\/a>\u00a0that the two pieces of legislation are clear in their language, and that MPs knew what they were doing when they passed them.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It says there is &#8220;no express provision&#8221; made in the Equality Act to affect the GRA&#8217;s wording that a certificate changes someone&#8217;s sex.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Indeed it says there are &#8220;clear indications&#8221; in the 2010 Act that the GRA &#8220;is intended to continue to have full effect&#8221; &#8211; &#8220;namely to reflect, by way of a person having acquired another gender, a change as a matter of law in their sex&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">For Women Scotland will be represented in court by Aidan O&#8217;Neill KC, while Ruth Crawford KC will speak for the Scottish government.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Five judges will hear their arguments &#8211; headed by the court&#8217;s president, Lord Reed &#8211; and will retire to consider them before issuing a judgement at a later date.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"What-could-the-implications-be\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">What could the implications be?<\/span><\/h2>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">This issue has become so emotive because people on both sides see it as a threat to their very identity.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The most recent census found there were 19,990 people in Scotland who were trans, or had a trans history &#8211; under 0.5% of the adult population.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The figure for England and Wales is also around 0.5% &#8211; 262,000 people told the last census that their gender identity and birth sex were different.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">There is uncertainty around the true figures, with census returns thought to be overestimated &#8211; but what we know for sure is that 1,088 full gender recognition certificates were granted across the UK in 2023-24, up from 867 the previous year.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The figure has been rising since application costs were cut &#8211; and in the context of this case, it is people with full GRCs who are central.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Beyond this, equalities groups stress that there are a great many minority groups which are protected by the Equality Act, and see this case as potentially being the &#8220;thin end of the wedge&#8221; which could undermine their rights.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">For trans people, they say it could erode the protections against discrimination they have under their reassigned gender.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If someone has a gender recognition certificate attesting that they are a woman, are they entitled to protection from sex discrimination under the Equality Act? Could they make an equal pay claim as a woman?<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The UK\u2019s first trans judge &#8211; who unsuccessfully\u00a0<a href=\"https:\/\/goodlawproject.org\/update\/were-fighting-for-trans-voices-to-be-heard-in-the-supreme-court\/\" target=\"_blank\" rel=\"noopener\">applied to intervene<\/a>\u00a0in this case &#8211; is said to have pursued a pensions claim along those very lines against the Ministry of Justice.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Meanwhile women\u2019s groups also say the ruling will have an impact on a large group &#8211; literally half of the population.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">They say it could affect the running of single-sex services and spaces. Things like support groups for victims of sexual abuse can only legally justify excluding men due to the Equality Act\u2019s protections.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Campaigners say everything from hospital wards to refuges and sports events might have to change policy or find themselves open to legal challenges based on the court&#8217;s ruling.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Lesbian groups &#8211; protected under &#8220;sexual orientation&#8221; in the 2010 Act &#8211; also say it could affect their ability to have exclusive clubs.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">There could also be political implications.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Some groups see the case as a reason to clarify the actual wording of the law, by having MPs amend the Equality Act itself.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Equality and Human Rights Commission &#8211; the national equalities regulator, which is intervening in the case &#8211; has called for this.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">They say that MPs\u00a0<i class=\"ssrcss-xbdn93-ItalicText e5tfeyi2\">did\u00a0<\/i>intend to include those with a gender recognition certificate as having changed their sex when they passed the Act in 2010, but that they may not have appreciated consequences which &#8220;jeopardise the rights and interests of women and same-sex attracted people&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">They say this is a &#8220;wholly unsatisfactory situation, which parliament should address with urgency&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But some other equalities groups oppose &#8220;reopening&#8221; the Equality Act, seeing it as a move which could see the rights of protected groups watered down.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">And it&#8217;s not clear that there is the political will for governments to wade into this topic.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The Scottish government previously tried to take the lead, when Nicola Sturgeon led the charge with self-identification reforms.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But her successors as first minister have backed away from these issues, with current first minister John Swinney pushing plans for a ban on conversion therapy onto the UK government&#8217;s desk by calling for a four-nation approach.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">At a UK level, rewriting the Equality Act was a Conservative pledge during the election campaign &#8211; and not one which Sir Keir Starmer matched.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Indeed Labour&#8217;s manifesto promised to &#8220;simplify and reform&#8221; the gender recognition process, removing &#8220;indignities&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">As well as affecting the interpretation of the law as it stands, the ruling in this case could reignite calls for reform in parliament itself.<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/ckgv8v5ge37o\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">Judges at the Supreme Court are to consider how women are defined in law in a landmark case brought by Scottish campaigners.
