{"id":28626,"date":"2024-11-22T07:56:25","date_gmt":"2024-11-22T12:56:25","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=28626"},"modified":"2024-11-24T07:56:52","modified_gmt":"2024-11-24T12:56:52","slug":"illinois-supreme-court-overturns-jussie-smollett-conviction-for-alleged-hoax","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2024\/11\/22\/illinois-supreme-court-overturns-jussie-smollett-conviction-for-alleged-hoax\/","title":{"rendered":"Illinois Supreme Court overturns Jussie Smollett conviction for alleged hoax"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">The Illinois Supreme Court has overturned a<\/b><a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/newsbeat-47317701\" target=\"_blank\" rel=\"noopener\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">\u00a0conviction against actor Jussie Smollett<\/b><\/a><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">, who prosecutors accused of staging a racist and homophobic attack against himself in 2019 in Chicago.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Smollett, who is black and gay, was convicted of five counts of disorderly conduct in 2021.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">He had claimed two men targeted him in a hate-crime, yelling racial slurs and putting a noose around his neck while he was walking down the street near his apartment.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Two men testified that the Empire television show star paid them $3,500 (\u00a32,700) to stage the attack.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Smollett was sentenced to 150 days in jail, but served only six days before he was freed pending appeal.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The state Supreme Court sided with Smollett&#8217;s attorneys, who argued in their appeal that Smollett should not have been charged by a special prosecutor after the Cook County State Attorney&#8217;s Office dropped charges in exchange for community service.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The decision sparked an uproar from many, including Chicago Mayor Rahm Emanuel said who said Smollett was &#8220;let off scot-free, with no sense of accountability for the moral and ethical wrong of his actions&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">A grand jury later re-established the charges after a special prosecutor took on the case.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;We are aware that this case has generated significant public interest and that many people were dissatisfied with the resolution of the original case and believed it to be unjust,&#8221; the state Supreme Court wrote in its opinion on Thursday.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Nevertheless, what would be more unjust than the resolution of any one criminal case would be a holding from this court that the State was not bound to honor agreements upon which people have detrimentally relied.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">During Smollett&#8217;s trial, prosecutors alleged he staged the attack because he was unhappy with a television studio&#8217;s response to hate mail he received.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Smollett said the attack was &#8220;no hoax\u201d and that he was the victim of a hate crime in Chicago.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But the two men he accused of perpetrating the crime &#8211; two brothers, one of whom Smollett said he met through the Empire show &#8211; said Smollett hired them and paid them with a cheque.<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c8xp28eq5l9o\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">The Illinois Supreme Court has overturned a\u00a0conviction against actor Jussie Smollett, who prosecutors accused of staging a racist and homophobic attack against himself in 2019 in Chicago.
