It said many customers rely on third-party alternatives, and insists it &#8220;works hard to make data transfer as easy as possible&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It is another example of the &#8220;growing tide of large class actions against big tech&#8221; which has &#8220;operated without sufficient constraint&#8221;, Toby Starr from legal firm Humphries Kerstetter told the BBC.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/technology-68309670\" target=\"_blank\" rel=\"noopener\">Facebook<\/a>,\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cqlle3k92zqo\" target=\"_blank\" rel=\"noopener\">Google<\/a>, gaming giant\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cpwwyj6v24xo\" target=\"_blank\" rel=\"noopener\">Steam<\/a>\u00a0and the UK&#8217;s\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/business-67649539\" target=\"_blank\" rel=\"noopener\">leading mobile providers<\/a>\u00a0are among the others facing legal claims at the same court, the Competition Appeal Tribunal.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Although most of these claims are in their infancy and take a long time to resolve, there will be more decisions coming out over the next couple of years and there will be settlements &#8211; these will start to affect the tech giants\u2019 businesses,&#8221; said Mr Starr.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"A-price-to-pay\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">A price to pay<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Users of Apple products get a small amount of digital storage for free \u2013 and after that are encouraged to pay to use its iCloud service to back up photos, videos, messages, contacts and all the other content which lives on their device.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Prices for this storage range from \u00a30.99 a month for 50GB of space to \u00a354.99 a month for 12TB.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Apple does not allow rival storage services full access to its products.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It says that is for security reasons &#8211; but it also contributes to the\u00a0<a href=\"https:\/\/www.statista.com\/statistics\/250918\/apples-revenue-from-itunes-software-and-services\/#:~:text=Revenue%20of%20Apple%20from%20services%20segment%202013%2D2024&amp;text=In%20the%20fourth%20quarter%20of,of%20U.S.%20dollars%20each%20quarter.\" target=\"_blank\" rel=\"noopener\">company&#8217;s enormous revenues<\/a>.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Which? says over a period of nine years dating back to 2015 Apple has been effectively locking people into its services &#8211; and then overcharging them.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;By bringing this claim, Which? is showing big corporations like Apple that they cannot rip off UK consumers without facing repercussions,&#8221; the body&#8217;s chief executive Anabel Hoult said.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Taking this legal action means we can help consumers to get the redress that they are owed, deter similar behaviour in the future and create a better, more competitive market.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Apple has strongly denied Which&#8217;s accusations.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;We reject any suggestion that our iCloud practices are anti-competitive and will vigorously defend against any legal claim otherwise,&#8221; it said in a statement.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-12l5xzx-LinksComponentWrapper e3eyuya0\" data-component=\"links-block\">\n<section class=\"ssrcss-msolhr-LinksWrapper e3eyuya5\">\n<ul class=\"ssrcss-mh3hvv-InContentLinksGrid e3eyuya3\" role=\"list\">\n<li class=\"ssrcss-r2yl4r-PromoItem e3eyuya1\">\n<div class=\"ssrcss-s1qr4x-Promo e1vyq2e80\" data-testid=\"promo\">\n<div class=\"ssrcss-1enzf19-PromoCompact e18gnqux0\">\n<div class=\"ssrcss-1d68cot-PromoContent exn3ah99\">\n<div class=\"ssrcss-1f3bvyz-Stack e1y4nx260\">\n<p class=\"ssrcss-1sen9vx-PromoHeadline exn3ah96\"><a href=\"https:\/\/www.bbc.co.uk\/news\/technology-64210531\" target=\"_blank\" rel=\"noopener\"><span aria-hidden=\"false\">Why it is becoming easier to sue Big Tech in the UK<\/span><\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/li>\n<\/ul>\n<\/section>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"Very-high-value-damages\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">&#8216;Very high value damages&#8217;<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Which? has instructed the international law firm Willkie Farr &amp; Gallagher to take the legal action, and says it will be funded by another firm, Litigation Capital Management.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Which? said they would be paid fees as the case progressed, getting additional payments if it was successful &#8211; but they would not be getting a percentage of any damages.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Alan Davis, from law firm Pinsent Masons, said there were very likely to be more, similar cases in the future.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;It is inevitable that further claims of this nature will continue to be brought given the very high value of the aggregate damages and the role of and incentive for litigation funders to support these claims which might not otherwise be brought without that financial support,&#8221; he told the BBC.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">He added the absence of any infringement decisions under EU or UK competition law meant it would be down to the claimant to prove the market abuse it was alleging was actually taking place.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However, he pointed out the regulator had announced a\u00a0<a href=\"https:\/\/www.gov.uk\/cma-cases\/cloud-services-market-investigation\" target=\"_blank\" rel=\"noopener\">wider investigation into cloud services<\/a>\u00a0in the UK.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Legal actions against big tech firms can take years as they work their way through the courts.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Which?
