{"id":28531,"date":"2024-11-08T06:48:26","date_gmt":"2024-11-08T11:48:26","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=28531"},"modified":"2024-11-08T06:48:26","modified_gmt":"2024-11-08T11:48:26","slug":"us-justice-officials-in-talks-to-drop-trump-criminal-cases","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2024\/11\/08\/us-justice-officials-in-talks-to-drop-trump-criminal-cases\/","title":{"rendered":"US Justice officials in talks to drop Trump criminal cases"},"content":{"rendered":"<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">The US Department of Justice is in talks with the office of special counsel Jack Smith over winding down the two federal cases he is overseeing against president-elect Donald Trump, according to US media reports.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Last year, Mr Smith brought charges against Trump over the alleged mishandling of classified documents and his suspected role in attempting to thwart the transfer of power after the 2020 presidential election.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But the justice department has a long-standing policy that sitting presidents cannot be prosecuted &#8211; which would apply when Trump returns to office in January.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Trump said during the election campaign that he would fire Mr Smith &#8220;within two seconds&#8221; if he was returned to office.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><a href=\"https:\/\/www.cbsnews.com\/news\/justice-department-trump-special-counsel-prosecutions\/\" target=\"_blank\" rel=\"noopener\">According to the BBC&#8217;s US partner CBS News<\/a>, two sources close to the talks say they centre on rules which prevent sitting presidents from being prosecuted and the need for a smooth transition between the outgoing Biden administration and Trump.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Deciding not to continue with the federal cases before Trump&#8217;s inauguration in January would also avoid a showdown between the incoming president and the justice department, the Associated Press reported.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-66341309\" target=\"_blank\" rel=\"noopener\">Mr Smith was appointed<\/a>\u00a0by Attorney General Merrick Garland in November 2022.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The two indictments brought by Mr Smith accuse Trump of conspiracy to reverse the 2020 election results in the run-up to the 6 January 2021 Capitol riot, and with retaining top secret records at his Mar-a-Lago estate in Florida and obstructing FBI efforts to recover them.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The classified documents case is currently stalled in the appeal court after a\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cz5rpdrxevro\" target=\"_blank\" rel=\"noopener\">US judge dismissed it<\/a>\u00a0on the grounds that Mr Smith was not properly appointed by the justice department.\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cdd75g4yrpdo\" target=\"_blank\" rel=\"noopener\">Mr Smith appealed against the ruling<\/a>\u00a0and the case is currently pending.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The election interference prosecution has been put on hold after the US Supreme Court ruled that\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/live\/cw0y5228v1yt\" target=\"_blank\" rel=\"noopener\">presidents have some immunity from criminal charges relating to official actions<\/a>.
