{"id":28291,"date":"2024-09-10T06:22:52","date_gmt":"2024-09-10T10:22:52","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=28291"},"modified":"2024-09-10T06:22:52","modified_gmt":"2024-09-10T10:22:52","slug":"eu-court-rules-google-must-pay-e2-4bn-fine","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2024\/09\/10\/eu-court-rules-google-must-pay-e2-4bn-fine\/","title":{"rendered":"EU court rules Google must pay \u20ac2.4bn fine"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">Europe&#8217;s top court has ruled Google must pay a \u20ac2.4bn (\u00a32bn) fine handed down for abusing the market dominance of its shopping comparison service.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The tech giant had appealed against the fine, which was originally levied by the European Commission in 2017.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It was at the time the largest penalty the Commission had ever imposed &#8211; though it has since been supplanted by a \u20ac4.3bn fine, also against Google.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Google said it was &#8220;disappointed&#8221; with the ruling.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It brings an end to a long-running case that was first brought by British firm Foundem in 2009, when the UK was still part of the EU.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Another of the complainants, shopping comparison site Kelkoo, called the ruling &#8220;a win for fair competition and consumer choice&#8221;\u00a0<a href=\"https:\/\/x.com\/KelkooPolicy\/status\/1833413158976868520\" target=\"_blank\" rel=\"noopener\">in a post on X<\/a>.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The European Court of Justice (ECJ), which made today&#8217;s judgement, said in its ruling the Commission was right to find Google&#8217;s conduct &#8220;discriminatory&#8221; and its appeal &#8220;must be dismissed in its entirety&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It ordered Google and owner Alphabet to bear their own costs and pay the costs incurred by the European Commission.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In a statement, Google pointed out it had made changes in 2017 to comply with the European Commission&#8217;s decision.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Our approach has worked successfully for more than seven years, generating billions of clicks for more than 800 comparison shopping services,&#8221; it said.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Anne Witt, professor of law at EDHEC Business School&#8217;s Augmented Law Institute, said it was &#8220;an important judgement&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;This is bad news for Google, which has exhausted its legal remedies in this case,&#8221; she said &#8211; while pointing out there could be further problems ahead for the firm.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Several follow-on actions by injured parties claiming compensation for losses suffered as a consequence of Google&#8217;s anticompetitive conduct are already pending in national courts.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">On Monday, Google was taken to court by the US government over its ad tech business &#8211; it has been accused of illegally operating a monopoly. That trial is ongoing.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Last week,\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c80en9nvlp9o\" target=\"_blank\" rel=\"noopener\">UK regulators provisionally concluded<\/a>\u00a0Google used anti-competitive practices to dominate the market for online advertising technology.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"Rivals-squeezed\" class=\"ssrcss-pbttu9-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">Rivals squeezed<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The EU&#8217;s case against Google started with Foundem, which filed its complaint against the tech giant in 2009.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">At its heart was the contention that Google made its own shopping recommendations appear more prominent than rivals in search results.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Google had tried to argue that the case had no legal or economic merit.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But seven years ago, the Commission agreed that the tech giant effectively monopolised online price comparison by preventing others from getting a foothold in the market.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">That decision has now been upheld.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Industry insiders have been keeping a close eye on the EU case, with suggestions that its outcome may illuminate the direction of travel of the many other antitrust cases Google is currently facing from the European Commission.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The search giant has amassed fines of \u20ac8.2bn from the Commission, which has repeatedly alleged it abused its dominant market position. These are:<\/p>\n<div class=\"ssrcss-1o5f7ft-BulletListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">2017: \u20ac2.4bn fine over shopping results<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">2018: \u20ac4.3bn fine over claims it used Android software to unfairly promote its own apps<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">2019: \u20ac1.5bn fine for blocking adverts from rival search engines<\/p>\n<\/li>\n<\/ul>\n<\/div>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The EU is also currently investigating the firm over whether it preferences its own goods and services over others in search results, as part of its Digital Markets Act.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If it finds Google guilty, the firm could face a fine of up to 10% of its annual turnover.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">It is far from the only clash between the EU and big tech.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In a separate judgement today, the ECJ has\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/ckgwkwxr4eqo\" target=\"_blank\" rel=\"noopener\">told Apple it must pay back \u20ac13bn (\u00a311bn; $14bn) in unpaid taxes<\/a>\u00a0to Ireland.<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cjw3e1pn741o\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">Europe&#8217;s top court has ruled Google must pay a \u20ac2.4bn (\u00a32bn) fine handed down for abusing the market dominance of its shopping comparison service.
