{"id":28089,"date":"2024-07-24T06:07:18","date_gmt":"2024-07-24T10:07:18","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=28089"},"modified":"2024-07-24T06:07:18","modified_gmt":"2024-07-24T10:07:18","slug":"family-to-sue-prison-service-over-death-of-inmate","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2024\/07\/24\/family-to-sue-prison-service-over-death-of-inmate\/","title":{"rendered":"Family to sue prison service over death of inmate"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">The family of a man who died after being restrained by up to 17 prison officers is suing the Scottish Prison Service (SPS), the Crown Office and Scottish ministers over his death.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Allan Marshall died days after being held face down by prison officers at HMP Edinburgh in 2015.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In what is thought to be one of the first cases of its kind in Scotland, his family has now raised a civil court action under human rights laws for a breach of his right to life.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Their lawyers said the aim was to ensure those responsible were \u201cheld to account\u201d and to try to enact change within the Scottish prison system &#8211; which has one of the highest rates of deaths behind bars in Europe.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">If the case is successful, it could result in a substantial financial penalty for the SPS, the Crown Office and the Scottish government.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The family of Mr Marshall say they are bringing the case because every other possibility has been thwarted or exhausted.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">They have gone through an initial police investigation and a fatal accident inquiry but they still don&#8217;t feel anyone has been held accountable for what happened nine years ago.<\/p>\n<\/div>\n<\/div>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.bbc.co.uk\/ws\/av-embeds\/articles\/crgk1llpmmno\/p0h96kz9\/en-gb\/\" width=\"800\" height=\"500\" frameborder=\"0\"><\/iframe><br \/>\nCCTV shows prison officers restraining Allan Marshal<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Mr Marshall, from Carluke in South Lanarkshire, was 30 when he died while on remand awaiting a court appearance over unpaid fines and breach of the peace charges.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Officers said he had become agitated, but rather than calling for medical assistance, they moved him to the segregation unit and physically restrained him, holding him face down.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Much of the incident was captured on CCTV.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">At various times it involved 17 prison officers with some of them using their feet, which is not a technique that is taught for use when restraining inmates.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">According to the fatal accident inquiry, one officer said he used his feet 10 or more times and also stamped on Mr Marshall. Scotland&#8217;s prosecution service &#8211; granted full immunity to all prison officers at HMP Edinburgh, ruling out any prosecution.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Earlier this year\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-scotland-68204587\" target=\"_blank\" rel=\"noopener\">the BBC revealed a Crown Office review<\/a>\u00a0had said the decision to give immunity had been &#8220;incorrect&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Mr Marshall\u2019s aunt, Sharon MacFadyen, has now raised a court claim against the prison service using human rights laws.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The right to life is protected under Article 2 of the European Convention on Human Rights, incorporated into UK law through the Human Rights Act 1998.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Her lawyers said that the Crown\u2019s decision to grant immunity to the prison officers meant this was now one of the only remaining routes to securing accountability.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Ms MacFadyen\u2019s court action is also directed against Police Scotland and the Crown Office, for breach of their duty to adequately investigate Mr Marshall\u2019s death and hold those responsible to account, which is also a requirement under Article 2.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Mr Marshall&#8217;s brother Alistair said: \u201cWe\u2019ve been fighting for justice for Allan for nine years.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Allan was killed in prison when he needed medical support.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;No-one has been held responsible for that. The system has failed Allan. We hope that through this court case we can finally get accountability.\u201d<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Barbara Bolton, legal director of JustRight Scotland, is working on the case.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">She said: \u201cThis case highlights the urgent need for transparency in deaths that occur in State custody.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Research shows a troubling rise in these deaths, reflecting preventable issues within the prison system.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Human rights law, particularly Article 2 of the European Convention on Human Rights, mandates that the State protects the right to life.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Thorough investigation and holding those responsible to account are essential for delivering justice to families and addressing critical issues within the prison system.\u201d<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">A Police Scotland spokeswoman said: \u201cWe have received instruction from the lord advocate to investigate possible corporate responsibility by the Scottish Prison Service.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;We are not able to comment further at this time due to the live nature of this investigation.\u201d<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">An SPS spokesman said: \u201cOur thoughts remain with Mr Marshall\u2019s family.
