{"id":27559,"date":"2024-04-16T07:26:15","date_gmt":"2024-04-16T11:26:15","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=27559"},"modified":"2024-04-16T07:26:15","modified_gmt":"2024-04-16T11:26:15","slug":"muslim-student-loses-prayer-ban-challenge","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2024\/04\/16\/muslim-student-loses-prayer-ban-challenge\/","title":{"rendered":"Muslim student loses prayer ban challenge"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><b class=\"ssrcss-1xjjfut-BoldText e5tfeyi3\">A Muslim student at a London school has lost a High Court challenge against its ban on prayer rituals.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Michaela School in Brent was taken to court by the girl over the policy, which was said to be discriminatory.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The non-faith state secondary school previously told the High Court that allowing prayer rituals risked &#8220;undermining inclusion&#8221; between pupils.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The school&#8217;s founder and head teacher Katharine Birbalsingh said the ruling was a &#8220;victory for all schools&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In an 83-page written judgment dismissing the student&#8217;s case, Mr Justice Linden said: &#8220;The claimant at the very least impliedly accepted, when she enrolled at the school, that she would be subject to restrictions on her ability to manifest her religion.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"Free-to-do-what-is-right\" class=\"ssrcss-1ipj56t-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">&#8216;Free to do what is right&#8217;<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">About half the school&#8217;s roughly 700 pupils are Muslim, the court previously heard. In March 2023, up to 30 students began praying in the school&#8217;s yard, using blazers to kneel on, the High Court heard.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The school introduced the ban in the same month due to concerns about a &#8220;culture shift&#8221; towards &#8220;segregation between religious groups and intimidation within the group of Muslim pupils&#8221;, the court was told.<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The case will be seen as upholding the right of non-religious schools to make their own decision about whether to set aside time and space for pupils to pray.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Ms Birbalsingh said in\u00a0<a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/twitter.com\/Miss_Snuffy\/status\/1780178135616520635\" target=\"_blank\" rel=\"noopener\">a statement on X, formerly Twitter,<\/a>\u00a0that a school &#8220;should be free to do what is right for the pupils it serves&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">She added: &#8220;Schools should not be forced by one child and her mother to change its approach simply because they have decided they don&#8217;t like something at the school.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;If parents do not like what Michaela is, they do not need to send their children to us.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<div class=\"ssrcss-1o5f7ft-BulletListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li><a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-london-68170336\" target=\"_blank\" rel=\"noopener\">School made being Muslim seem toxic, ex-pupil says<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Following the ruling, the student said in a statement that she was &#8220;disappointed&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;As is set out in the judgment, I do not agree that it would be too hard for the school to accommodate pupils who wished to pray in the lunch break,&#8221; she said.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;The school is very well run and generally very good at managing everything. The school doesn&#8217;t wish to allow pupils to pray, has chosen a different path and the judge has found in their favour.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Even though I lost, I still feel that I did the right thing in seeking to challenge the ban. I tried my best, and was true to myself and my religion.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">She said she planned to remain at the school and focus on her GCSE exams.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;I am grateful for the understanding that my non-Muslim friends at school have shown as to the issues that affect us,&#8221; she added.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"Knew-the-school-was-secular\" class=\"ssrcss-1ipj56t-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">&#8216;Knew the school was secular&#8217;<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In the legal action against the north-west London school&#8217;s governing body, the Michaela Community Schools Trust, the student alleged that the ban on prayer rituals breached her right to freedom of religion.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The pupil, who cannot be named for legal reasons, told the court the rule had &#8220;fundamentally changed&#8221; how she felt &#8220;about being a Muslim in this country&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However, the school argued its prayer policy was justified after it faced death and bomb threats linked to religious observance on site.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<div class=\"ssrcss-1o5f7ft-BulletListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li><a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-london-68013174\" target=\"_blank\" rel=\"noopener\">Reversing prayer ban would &#8216;expose school to risk&#8217;<\/a><\/li>\n<li><a class=\"ssrcss-f6h2dj-InlineLink e1kn3p7n0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-london-68000098\" target=\"_blank\" rel=\"noopener\">Pupil takes school to court over alleged prayer ban<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Dismissing the student&#8217;s case, Mr Justice Linden said: &#8220;The claimant at the very least impliedly accepted, when she enrolled at the school, that she would be subject to restrictions on her ability to manifest her religion.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;She knew that the school is secular and her own evidence is that her mother wished her to go there because it was known to be strict.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;She herself says that, long before the prayer ritual policy was introduced, she and her friends believed that prayer was not permitted at school and she therefore made up for missed prayers when she got home.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The judge upheld the student&#8217;s challenge to a decision to temporarily exclude her from the school.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-19w8cxh-ComponentWrapper-HeadlineComponentWrapper egtrm1f0\" data-component=\"subheadline-block\">\n<h2 id=\"Outstanding-school\" class=\"ssrcss-1ipj56t-Heading e10rt3ze0\" tabindex=\"-1\"><span role=\"text\">&#8216;Outstanding school&#8217;<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Education Secretary Gillian Keegan said: &#8220;I have always been clear that head teachers are best placed to make decisions in their school.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Michaela is an outstanding school and I hope this judgment gives all school leaders the confidence to make the right decisions for their pupils.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Michaela School is a free school known for its &#8220;tiger teaching&#8221;
