{"id":26724,"date":"2023-12-07T08:19:37","date_gmt":"2023-12-07T13:19:37","guid":{"rendered":"https:\/\/worldjusticenews.com\/news\/?p=26724"},"modified":"2023-12-13T04:21:01","modified_gmt":"2023-12-13T09:21:01","slug":"texas-woman-asks-court-to-let-her-have-an-abortion","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2023\/12\/07\/texas-woman-asks-court-to-let-her-have-an-abortion\/","title":{"rendered":"Texas woman asks court to let her have an abortion"},"content":{"rendered":"<p>A Texas woman who is 20-weeks pregnant and whose foetus has been diagnosed with a fatal condition has asked a court to allow her to have an abortion.<\/p>\n<p><strong><a href=\"https:\/\/news.sky.com\/topic\/texas-5755\" target=\"_blank\" rel=\"noopener\">Texas<\/a><\/strong>\u00a0is one of 13 states that bans abortion at nearly all stages of pregnancy.<\/p>\n<p><strong>UPDATE\u00a0 1:<\/strong><br \/>\n<b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">A Texas judge has granted permission for an abortion to a woman whose foetus has a fatal abnormality, despite the state&#8217;s ban on the procedure.<\/b><\/p>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><strong>The ruling &#8211; which Texas may challenge &#8211; is thought to be one of the first attempts to seek a court-granted abortion.<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\"><strong>Texas law prohibits pregnancy terminations except to save the life of the expectant mother.<\/strong><\/p>\n<\/div>\n<\/div>\n<p><strong>UPDATE\u00a0 2:<\/strong><br \/>\n<b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">The Texas Supreme Court has ruled against a woman seeking an abortion for her high-risk pregnancy.<br \/>\nIn its seven-page ruling, the Texas Supreme Court found that Ms Cox&#8217;s doctor had not proven that her safety was threatened due to a &#8220;life-threatening physical condition&#8221; as required under the law.<\/b><\/p>\n<p><strong>UPDATE\u00a0 3:<\/strong><br \/>\n<b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">Kate Cox has left Texas to get &#8220;healthcare&#8221; outside of the state instead.<\/b><\/p>\n<p>Kate Cox recently learned her unborn child is at a high risk of a genetic abnormality called trisomy 18, which typically does not result in a viable pregnancy.<\/p>\n<p>The 31-year-old mother-of-two has started legal proceedings in Austin seeking a temporary restraining order allowing a doctor to perform an\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/abortion-7020\" target=\"_blank\" rel=\"noopener\">abortion<\/a><\/strong>\u00a0without being prosecuted.<\/p>\n<p>Doctors have told Ms Cox her baby is likely to be stillborn or live for a week at most, according to court papers.<\/p>\n<p>The documents also say because she has already had two previous caesarean sections, she would need to have a third one if she continues the pregnancy, which could jeopardise her ability to have more children.<\/p>\n<p>&#8220;Yet because of Texas&#8217;s abortion bans, Ms Cox&#8217;s physicians have informed her that their &#8216;hands are tied&#8217; and she will have to wait until her baby dies inside her or carry the pregnancy to term, at which point she will be forced to have a third C-section, only to watch her baby suffer until death,&#8221; the court papers said.<\/p>\n<p>&#8220;Kate Cox needs an abortion, and she needs it now.&#8221;<\/p>\n<p>The legal action is believed to be the first time a woman has sought a court order authorising an abortion since the Supreme Court overturned the landmark Roe v Wade 1973 ruling which legalised abortion nationwide.<\/p>\n<p>Although Texas allows exceptions, doctors and women have argued in court this year that the state&#8217;s law is so restrictive and vaguely worded that physicians are afraid of providing abortions for fear they could face potential criminal charges.<\/p>\n<p>Ms Cox has urged the court to rule &#8220;expeditiously&#8221;.<\/p>\n<p>&#8220;It is not a matter of if I will have to say goodbye to my baby, but when,&#8221; she said in a statement.<\/p>\n<p>&#8220;I&#8217;m trying to do what is best for my baby and myself, but the state of Texas is making us both suffer.&#8221;<\/p>\n<p>In July, several Texas women gave emotional testimony about carrying babies they knew would not survive and doctors unable to offer abortions despite their spiralling conditions.<\/p>\n<p>A judge later ruled the abortion ban in Texas was too restrictive for women with pregnancy complications &#8211;
