The\u00a0<span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement \" href=\"https:\/\/apnews.com\/article\/trump-insurrection-amendment-2024-ballot-colorado-5b6e40f069abc1b8604ec37c46621055\" target=\"_blank\" rel=\"noopener\">ruling by District Court Judge Sarah Wallace<\/a><\/span>\u00a0on Friday \u2014 which said Trump is not covered by the Constitution\u2019s ban on insurrectionists holding office \u2014 was the latest in a\u00a0<span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement \" href=\"https:\/\/apnews.com\/article\/trump-insurrection-election-president-f6b72c94bb351c1b870d4884e54f6a75\" target=\"_blank\" rel=\"noopener\">series<\/a><\/span>\u00a0of\u00a0<span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement \" href=\"https:\/\/apnews.com\/article\/trump-insurrection-14th-amendment-ballot-michigan-b2a870f98a60dffbe4c9566cfe97457c\" target=\"_blank\" rel=\"noopener\">defeats<\/a><\/span>\u00a0for the\u00a0<span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement \" href=\"https:\/\/apnews.com\/article\/trump-14th-amendment-insurrection-2024-election-ballot-9c5f79203109ba221b35a48e708ad725\" target=\"_blank\" rel=\"noopener\">effort to end Trump\u2019s candidacy<\/a><\/span>\u00a0with Section 3 of the 14th Amendment.<\/p>\n<p>A group in\u00a0<span class=\"LinkEnhancement\"><a class=\"Link AnClick-LinkEnhancement \" href=\"https:\/\/apnews.com\/article\/trump-insurrection-14th-amendment-ballot-michigan-43f3b5bc379a2a1de66d21101252e40f\" target=\"_blank\" rel=\"noopener\">Michigan<\/a><\/span>\u00a0has filed an appeal with that state\u2019s Supreme Court.<\/p>\n<p>The constitutional provision has only been used a handful of times since the years after the Civil War. It was created to prevent former Confederates from returning to government positions.<\/p>\n<p>The group Citizens for Responsibility and Ethics in Washington, filing on behalf of a group of Republican and unaffiliated Colorado voters, argued that Wallace was wrong in ruling that it\u2019s not clear the provision was intended to apply to presidents.<\/p>\n<p>The section prevents those who took an oath to support the Constitution from serving in Congress, the Electoral College \u201cor as an officer of the United States.\u201d It does not specifically mention the presidency.<\/p>\n<p>Based on common sense alone, the appeal states, \u201cthere would be no reason to allow Presidents who lead an insurrection to serve again while preventing low-level government workers who act as foot soldiers from doing so. And it would defy logic to prohibit insurrectionists from holding every federal or state office except for the highest and most powerful in the land.\u201d<\/p>\n<p>Trump, meanwhile, appealed Wallace\u2019s finding that he did engage in insurrection and questioned whether a state court judge like her, rather than Congress, should settle the issue.<\/p>\n<p>The case will be heard by the seven justices on the state court, all of whom were appointed by Democrats.<\/p>\n<p>Colorado officials have urged a final decision by Jan. 5, 2024, when they must finalize their primary ballot.
