{"id":25960,"date":"2023-08-18T12:08:00","date_gmt":"2023-08-18T16:08:00","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=25960"},"modified":"2023-08-18T12:08:42","modified_gmt":"2023-08-18T16:08:42","slug":"fraudster-edwin-mclaren-complains-crowns-proceeds-of-crime-action-affecting-his-health","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2023\/08\/18\/fraudster-edwin-mclaren-complains-crowns-proceeds-of-crime-action-affecting-his-health\/","title":{"rendered":"Fraudster Edwin McLaren complains Crown&#8217;s proceeds of crime action &#8216;affecting his health&#8217;"},"content":{"rendered":"<p>A businessman who made \u00a31.7m from exploiting seriously ill homeowners has told a court how a &#8220;malicious&#8221; proceeds of crime action is impacting his own health.<\/p>\n<p>Edwin McLaren, 58, told judge Lord Arthurson that proceedings in the long-running case are having a negative impact on his wellbeing.<\/p>\n<p>The High Court in\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/edinburgh-6006\" target=\"_blank\" rel=\"noopener\">Edinburgh<\/a><\/strong>\u00a0also heard McLaren describe the action &#8211; brought by prosecutors to recover his ill-gotten gains for the benefit of the public &#8211; as &#8220;malicious&#8221;.<\/p>\n<p>He said the action was stopping him and his wife from accessing their pensions and had deprived his daughter of a quantity of jewellery.<\/p>\n<p>The court heard that Police Scotland had seized the jewellery during the probe into his and his wife Lorraine&#8217;s activities.<\/p>\n<p><strong>&#8216;This is affecting my health&#8217;<\/strong><\/p>\n<p>On Friday, McLaren asked Lord Arthurson to dismiss the action.<\/p>\n<p>McLaren, who represented himself, said the current action was taking a toll on him.<\/p>\n<p>He said: &#8220;This is affecting my health. It is damaging my health.<\/p>\n<p>&#8220;I would ask your lordship to give us back my daughter&#8217;s jewellery and to have access to our pensions.<\/p>\n<p>&#8220;I ask you to dismiss the applications. (Image: Police Scotland)<\/span><\/figcaption><\/figure>\n<\/div>\n<p>&nbsp;<\/p>\n<p>The couple, from Bridge of Weir in Renfrewshire, were responsible for\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/scotland-5866\" target=\"_blank\" rel=\"noopener\">Scotland&#8217;s<\/a><\/strong>\u00a0longest-ever criminal trial.<\/p>\n<p>McLaren was jailed for 11 years in 2017 for his involvement in a \u00a31.6m property fraud scheme.<\/p>\n<p>McLaren&#8217;s wife, also 58, was found guilty of two charges involving a fraudulent mortgage application on their own home and money laundering involving a sum of \u00a3128,000.<\/p>\n<p>McLaren was found guilty of 29 charges after a trial at the High Court in\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/glasgow-6071\" target=\"_blank\" rel=\"noopener\">Glasgow<\/a><\/strong>\u00a0that began in September 2015 and heard evidence over 320 days.<\/p>\n<p>His wife was sentenced to two and a half years behind bars but was released after nine months.<\/p>\n<p>During their trial, a court heard how McLaren preyed on vulnerable people by arranging for the title deeds of their homes to be transferred to his associates without the victims&#8217; knowledge.<\/p>\n<p>The estimated cost of the 20-month trial was \u00a37.5m.<\/p>\n<p>Jurors heard of the couple&#8217;s lavish lifestyle which included luxury holidays in Dubai and spending \u00a3100,000 on a ring for her and private schools for their children.<\/p>\n<p>In 2021, prosecutor Murdo MacTaggart told Lord Arthurson that the Crown and McLaren had agreed that he had made \u00a31,722,366.64 during his &#8220;course of criminal conduct&#8221;.<\/p>\n<p>However, both sides had agreed that the Crown could only recover \u00a34,000 from McLaren at that point in time.<\/p>\n<p>Meanwhile, Mrs McLaren&#8217;s advocate, Tony Lenehan KC, told the court that she had made \u00a3694,950 from criminal conduct.
