{"id":25804,"date":"2023-07-29T20:17:56","date_gmt":"2023-07-30T00:17:56","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=25804"},"modified":"2023-07-29T20:18:53","modified_gmt":"2023-07-30T00:18:53","slug":"judge-dismisses-donald-trumps-big-lie-lawsuit-against-cnn","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2023\/07\/29\/judge-dismisses-donald-trumps-big-lie-lawsuit-against-cnn\/","title":{"rendered":"Judge dismisses Donald Trump&#8217;s &#8216;Big Lie&#8217; lawsuit against CNN"},"content":{"rendered":"<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\"><b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">A federal judge has thrown out a $475m (\u00a3369m) defamation lawsuit brought by Donald Trump against CNN for allegedly likening him to Adolf Hitler.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The US cable network described Mr Trump&#8217;s unsubstantiated claim that the 2020 presidential election had been stolen from him as the &#8220;Big Lie&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Mr Trump argued the phrase referred to a Nazi propaganda campaign used to justify the persecution of Jews.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">US District Judge Raag Singhal ruled CNN&#8217;s comments were not defamatory.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In his ruling dismissing the lawsuit, Mr Singhal &#8211; who was appointed by Mr Trump &#8211; said the comments constituted opinion, and so Mr Trump could not legally sue the network for defamation.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;There is no question that the statements made by CNN meet the publication requirement for defamation under Florida law. The next question is whether the statements were false statements of fact. This is where Trump&#8217;s defamation claims fail,&#8221;\u00a0<a class=\"ssrcss-k17ofw-InlineLink e1no5rhv0\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.621239\/gov.uscourts.flsd.621239.31.0.pdf\" target=\"_blank\" rel=\"noopener\">wrote Mr Singhal in his verdict<\/a>.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;CNN&#8217;s use of the phrase &#8216;the Big Lie&#8217; in connection with Trump&#8217;s election challenges does not give rise to a plausible inference that Trump advocates the persecution and genocide of Jews or any other group of people. No reasonable viewer could (or should) plausibly make that reference.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;CNN&#8217;s statements while repugnant, were not, as a matter of law, defamatory,&#8221; he added.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Neither CNN nor Mr Trump have commented on the verdict.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Mr Trump had argued in the lawsuit that the use of the phrase had created a &#8220;false and incendiary association&#8221; between him and Hitler.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The Republican presidential candidate\u00a0is facing a number of other legal battles. He has been indicted twice and is facing 40 criminal charges over his alleged mishandling of classified government documents.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">He is also facing 34 felony counts of falsifying business records related to a hush money payment to a porn star in New York, as well as a possible indictment relating to his alleged efforts to undermine the 2020 election.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;Repeat a lie often enough and it becomes the truth&#8221;, is a law of propaganda often attributed to the Nazi propaganda chief Joseph Goebbels.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-11r1m41-RichTextComponentWrapper ep2nwvo0\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">But the description first appeared in Hitler&#8217;s Mein Kampf, 16 years before Goebbels&#8217; use of the phrase,\u00a0<a class=\"ssrcss-k17ofw-InlineLink e1no5rhv0\" href=\"https:\/\/www.populismstudies.org\/Vocabulary\/big-lie\/\" target=\"_blank\" rel=\"noopener\">the European Center for Populism Studies says<\/a>.
