{"id":25564,"date":"2023-06-24T20:35:13","date_gmt":"2023-06-25T00:35:13","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=25564"},"modified":"2023-06-24T20:35:13","modified_gmt":"2023-06-25T00:35:13","slug":"lawyers-used-chatgpt-to-help-with-a-case-it-backfired-massively","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2023\/06\/24\/lawyers-used-chatgpt-to-help-with-a-case-it-backfired-massively\/","title":{"rendered":"Lawyers used ChatGPT to help with a case &#8211; it backfired massively"},"content":{"rendered":"<p>Two New York lawyers have been fined after submitting a legal brief with fake case citations generated by ChatGPT.<\/p>\n<p>Steven Schwartz, of law firm Levidow, Levidow &amp; Oberman, admitted using the chatbot to research the brief in a client&#8217;s personal injury case against airline Avianca.<\/p>\n<p>He had used it to find legal precedents supporting the case, but lawyers representing the Colombian carrier told the court they could not find some examples cited &#8211; understandable, given they were almost entirely fictitious.<\/p>\n<p>Several of them were completely fake, while others misidentified judges or involved airlines that did not exist.<\/p>\n<p>District judge Peter Kevin Castel said Schwartz and colleague Peter LoDuca, who was named on Schwartz&#8217;s brief, had acted in bad faith and made &#8220;acts of conscious avoidance and false and misleading statements to the court&#8221;.<\/p>\n<p>Portions of the brief were &#8220;gibberish&#8221; and &#8220;nonsensical&#8221;, and included fake quotes, the judge added.<\/p>\n<p><strong>Read more:<br \/>\n<a href=\"https:\/\/news.sky.com\/story\/the-ultimate-homework-cheat-how-teachers-are-facing-up-to-chatgpt-12780601\" target=\"_blank\" rel=\"noopener\">Is ChatGPT the ultimate homework cheat?<\/a><\/strong><\/p>\n<p>While often impressive, generative AI like OpenAI&#8217;s\u00a0<a href=\"https:\/\/news.sky.com\/topic\/chatgpt-10560\" target=\"_blank\" rel=\"noopener\"><strong>ChatGPT<\/strong><\/a>\u00a0and\u00a0<a href=\"https:\/\/news.sky.com\/story\/google-launches-ai-chatbot-bard-to-rival-wildly-successful-chatgpt-12804958\" target=\"_blank\" rel=\"noopener\"><strong>Google&#8217;s Bard<\/strong><\/a>\u00a0have\u00a0<a href=\"https:\/\/news.sky.com\/story\/microsoft-limits-new-bing-after-reports-of-bizarre-answers-with-journalist-compared-to-hitler-12813741\" target=\"_blank\" rel=\"noopener\"><strong>a tendency to &#8220;hallucinate&#8221; when giving answers<\/strong><\/a>, as it may not have a true understanding of the information it has been fed.<\/p>\n<p>One of the\u00a0<a href=\"https:\/\/news.sky.com\/story\/what-are-the-concerns-around-ai-and-are-some-of-the-warnings-baloney-12893241\" target=\"_blank\" rel=\"noopener\"><strong>concerns raised by those worried about the potential of AI<\/strong><\/a>\u00a0regards the spread of disinformation.<\/p>\n<p>Asked by Sky News whether it should be used to help write a legal brief, ChatGPT itself wrote: &#8220;While I can provide general information and assistance, it is important to note I am an AI language model and not a qualified legal professional.&#8221;<\/p>\n<p>Judge Castel said there is &#8220;inherently improper&#8221; in lawyers using AI &#8220;for assistance&#8221;, but warned they have a responsibility to ensure their filings are accurate.<\/p>\n<p>He said the lawyers had &#8220;continued to stand by the fake opinions&#8221; after the court and airline had questioned them.<\/p>\n<p>Schwartz, LoDuca and their law firm were ordered to pay a total fine of $5,000 (\u00a33,926).<\/p>\n<p>Levidow, Levidow &amp; Oberman is considering whether to appeal, saying they &#8220;made a good faith mistake in failing to believe that a piece of technology could be making up cases out of whole cloth&#8221;.<\/p>\n<p>Source: \u00a0<a href=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2016\/11\/sky-news-logo-1.png\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2016\/11\/sky-news-logo-1.png\" alt=\"Sky News\" width=\"100\" height=\"20\" \/><\/a> <a href=\"https:\/\/news.sky.com\/story\/lawyers-fined-after-citing-bogus-cases-from-chatgpt-research-12908318\" target=\"_blank\" rel=\"noopener\">news.sky.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">Two New York lawyers have been fined after submitting a legal brief with fake case citations generated by ChatGPT.
