{"id":24075,"date":"2022-11-23T09:59:38","date_gmt":"2022-11-23T14:59:38","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=24075"},"modified":"2022-11-23T09:59:38","modified_gmt":"2022-11-23T14:59:38","slug":"mikayla-hayes-us-servicewoman-accused-of-killing-motorcyclist-in-norfolk-to-be-tried-in-uk-court","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2022\/11\/23\/mikayla-hayes-us-servicewoman-accused-of-killing-motorcyclist-in-norfolk-to-be-tried-in-uk-court\/","title":{"rendered":"Mikayla Hayes: US servicewoman accused of killing motorcyclist in Norfolk to be tried in UK court"},"content":{"rendered":"<p>A US servicewoman accused of killing a motorist in Norfolk will be tried in the UK, a judge has ruled.<\/p>\n<p>Airman first class Mikayla Hayes is accused of causing the death of 33-year-old Matthew Day by careless driving back in August.<\/p>\n<p>The father-of-one died of his injuries after a red Honda Accord car collided with his Yamaha motorbike while he was riding on the A10 in the village of Southery, in Norfolk.<\/p>\n<p>Deputy senior district judge Tan Ikram had been considering whether to grant the 24-year-old a trial in a US military court, as she had requested, or to allow the UK courts to deal with her case as argued by prosecutors.<\/p>\n<p>Lawyers for Hayes had argued that she was still on active duty at the time of the alleged incident and was returning home after a shift at RAF Lakenheath, in Suffolk, and should therefore face a US military court.<\/p>\n<p>Barrister Andrew Cogan had said his client had been wearing uniform as she made the 30-minute journey, which is paid for by her employer.<\/p>\n<p>The US Air Force (USAF) had served the Crown Prosecution Service (CPS) with a certificate under the 1952 Visiting Forces Act,\u00a0<a href=\"https:\/\/news.sky.com\/story\/us-air-force-asserts-jurisdiction-in-case-of-worker-accused-over-bikers-death-in-norfolk-12686296\" target=\"_blank\" rel=\"noopener\"><strong>which asserts jurisdiction<\/strong><\/a>.<\/p>\n<p>But, Judge Ikram overruled this argument on Wednesday, instead agreeing with prosecutor Rachel Scott, who said that Hayes was no longer on duty while driving home.<\/p>\n<figure id=\"attachment_24077\" aria-describedby=\"caption-attachment-24077\" style=\"width: 640px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2022\/11\/Matthew-Day.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-24077\" src=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2022\/11\/Matthew-Day.jpg\" alt=\"Matthew Day\" width=\"640\" height=\"360\" srcset=\"https:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2022\/11\/Matthew-Day.jpg 640w, https:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2022\/11\/Matthew-Day-300x169.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><figcaption id=\"caption-attachment-24077\" class=\"wp-caption-text\">Matthew Day<\/figcaption><\/figure>\n<h2><\/h2>\n<h2><strong>&#8216;She was simply travelling home after a day at work&#8217;<\/strong><\/h2>\n<p>Outlining his decision, the judge said: &#8220;There is no additional payment for the journey home.<\/p>\n<p>&#8220;There is no evidence the fuel for her journey was paid for by the US Air Force.
