{"id":22086,"date":"2022-05-07T13:24:19","date_gmt":"2022-05-07T17:24:19","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=22086"},"modified":"2022-05-07T13:24:19","modified_gmt":"2022-05-07T17:24:19","slug":"us-judge-dismisses-trump-lawsuit-challenging-his-twitter-ban","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2022\/05\/07\/us-judge-dismisses-trump-lawsuit-challenging-his-twitter-ban\/","title":{"rendered":"US judge dismisses Trump lawsuit challenging his Twitter ban"},"content":{"rendered":"<p>A US judge has dismissed a lawsuit brought by Donald Trump challenging his Twitter ban after his account was permanently suspended in the wake of the Capitol riots last year.<\/p>\n<p>The former US president had\u00a0<a href=\"https:\/\/news.sky.com\/story\/trump-asks-judge-to-force-twitter-to-restore-his-account-12423622\" target=\"_blank\" rel=\"noopener\"><strong>filed a request for a preliminary injunction<\/strong><\/a>\u00a0against the social media company, and attempted to argue Twitter was &#8220;coerced&#8221; by members of the US Congress to suspend the account, which had tens of millions of followers.<\/p>\n<p>In a written ruling, US District Judge James Donato in San Francisco rejected Mr Trump&#8217;s argument that Twitter violated his right to freedom of speech guaranteed by the First Amendment of the US Constitution.<\/p>\n<p>Twitter was among several social media platforms that removed\u00a0<a href=\"https:\/\/news.sky.com\/topic\/donald-trump-5711\" target=\"_blank\" rel=\"noopener\"><strong>Mr Trump<\/strong><\/a>\u00a0from their services after a mob attacked the US parliament building in the 6 January riot that left several people dead.<\/p>\n<p>Following the assault, Mr Trump made a speech in which he reiterated false claims that his election loss was due to widespread fraud &#8211; something that has been repeatedly debunked by courts and state election officials.<\/p>\n<p>In a court filing last year, Mr Trump&#8217;s lawyers claimed the social media site &#8220;exercises a degree of power and control over political discourse in this country that is immeasurable, historically unprecedented, and profoundly dangerous to open democratic debate.&#8221;<\/p>\n<p>The filing added that Twitter allowed the\u00a0<a href=\"https:\/\/news.sky.com\/topic\/taliban-7163\" target=\"_blank\" rel=\"noopener\"><strong>Taliban<\/strong><\/a>\u00a0to tweet frequently about its military victories in\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/afghanistan-6110\" target=\"_blank\" rel=\"noopener\">Afghanistan<\/a><\/strong>, but censored the president during his term in office by labelling his posts as &#8220;misleading information&#8221;.<\/p>\n<p>In July, Mr Trump launched a legal action against Twitter,\u00a0<a href=\"https:\/\/news.sky.com\/topic\/facebook-5956\" target=\"_blank\" rel=\"noopener\"><strong>Facebook<\/strong><\/a>\u00a0Inc and Alphabet Inc&#8217;s\u00a0<strong><a href=\"https:\/\/news.sky.com\/topic\/google-5876\" target=\"_blank\" rel=\"noopener\">Google<\/a><\/strong>, along with their chief executives, alleging they unlawfully silence conservative points of view.<\/p>\n<p>At the time of his suspension, Twitter argued his tweets had violated the platform&#8217;s policy barring &#8220;glorification of violence&#8221;.<\/p>\n<p>The company said the tweets that led to Mr Trump&#8217;s removal were &#8220;highly likely&#8221; to encourage people to replicate what happened in the Capitol riots.<\/p>\n<p><strong>Governing via Twitter<\/strong><\/p>\n<p>During his time in office, Mr Trump was often accused of governing by Twitter, with announcements made via his social media megaphone before official channels &#8211; at the time, a single tweet could spark a frenzy.<\/p>\n<p>For example, in July 2017 he announced his decision to ban transgender troops in three tweets. In March 2018, he fired Rex Tillerson, his then-secretary of state, via the platform.<\/p>\n<p>These days, after being cast into the social media wilderness he is forced to make announcements via emailed press releases and his own &#8220;Truth Social&#8221; startup.<\/p>\n<p>However, it may not be the last time the former Apprentice star is seen online.<\/p>\n<p>Following\u00a0<a href=\"https:\/\/news.sky.com\/topic\/elon-musk-6730\" target=\"_blank\" rel=\"noopener\"><strong>Elon Musk<\/strong><\/a>&#8216;s takeover, there has been speculation he &#8211; as a &#8220;free speech absolutist&#8221; &#8211; could force the restoration of Mr Trump&#8217;s account.<\/p>\n<p>However, Mr Musk may find he is constrained by reality, as under US law the right to free speech ends where harm, or incitement to harm, begins.<\/p>\n<p>And, in typical petulant style, Mr Trump has said he does not want to go back to the platform that rejected him, rather sticking to his own alternative &#8220;Truth Social&#8221; network.<\/p>\n<p>Source: \u00a0<a href=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2016\/11\/sky-news-logo-1.png\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2016\/11\/sky-news-logo-1.png\" alt=\"Sky News\" width=\"100\" height=\"20\" \/><\/a> <a href=\"https:\/\/news.sky.com\/story\/us-judge-dismisses-trump-lawsuit-challenging-his-twitter-ban-12607182\" target=\"_blank\" rel=\"noopener\">news.sky.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">A US judge has dismissed a lawsuit brought by Donald Trump challenging his Twitter ban after his account was permanently suspended in the wake of the Capitol riots last year.
