{"id":20528,"date":"2021-12-01T17:51:39","date_gmt":"2021-12-01T22:51:39","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=20528"},"modified":"2021-12-01T17:51:39","modified_gmt":"2021-12-01T22:51:39","slug":"us-supreme-court-top-us-judges-signal-support-for-abortion-limits","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2021\/12\/01\/us-supreme-court-top-us-judges-signal-support-for-abortion-limits\/","title":{"rendered":"US Supreme Court: Top US judges signal support for abortion limits"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\"><b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">The US Supreme Court appears poised to accept a Mississippi law that would bar abortions after 15 weeks of pregnancy, even in cases of rape or incest.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In a hearing into the case on Wednesday, conservative justices hinted with their comments that a majority backed upholding the law.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">A ruling on the law, expected in June, may see millions of women lose abortion access.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The court has not previously upheld abortion bans before about 24 weeks.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Both sides of the debate regard this case, known as Dobbs v Jackson Women&#8217;s Health Organization, as an all-or-nothing fight over abortion rights, with nationwide consequences.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Lawyers defending the Mississippi law have explicitly asked the court to overturn two previous landmark decisions regarding abortion.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The first, 1973&#8217;s Roe v Wade, gave women in the US an absolute right to an abortion in the first three months of pregnancy, and limited rights in the second trimester.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Nearly two decades later, in Planned Parenthood v Casey, the court ruled that states could not place an &#8220;undue burden&#8221; on women seeking abortions before a foetus could survive outside the womb, at about 24 weeks.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In the years since, the &#8220;foetal viability&#8221; standard has acted as a red line in abortion law, preventing any bans on abortion before this time.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">But anti-abortion campaigners hope the current ideological makeup of the court has created a new opening. The court, reshaped by three appointments under former President Donald Trump, has been called the most conservative-leaning in modern US history.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-dm4ypg-ComponentWrapper-HeadlineComponentWrapper e1xue1i88\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-1nmw0uu-StyledHeading e1fj1fc10\">What did the court hear?<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Addressing the court on Wednesday &#8211; with its 6-to-3 conservative majority &#8211; Mississippi Solicitor General Scott Stewart told justices that past rulings Roe and Casey &#8220;haunt our country&#8221; and &#8220;poison the law&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Mr Stewart took direct aim at the existing foetal viability standard, arguing that it is not &#8220;tethered&#8221; to the Constitution or any other historical precedent.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Justice Sonya Sotomayor, a liberal, took issue with this claim, responding: &#8220;there&#8217;s so much that&#8217;s not in the Constitution&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">She also warned that the Supreme Court &#8220;would not recover&#8221; if Americans see it as a political body, stepping in to reverse Roe and Casey.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The court would not &#8220;survive the stench that this creates in the public perception,&#8221; she said.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Representing Jackson Women&#8217;s Health Organization &#8211; the only abortion clinic in Mississippi &#8211; Julie Rikelman of the Center for Reproductive Rights spoke next, asking the court to strike down the Mississippi law and maintain a woman&#8217;s right to abortion.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;Mississippi&#8217;s ban on abortion, two months before viability, is flatly unconstitutional under decades of precedent,&#8221; Ms Rickelman said. Mississippi&#8217;s law would &#8220;force women to remain pregnant and give birth against their will&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">However, she faced pointed questioning from several of the justices, including Chief Justice John Roberts, on why the viability standard is appropriate.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In his questions on Wednesday, the chief justice appeared open to abortion bans after 15 weeks, a troubling sign for abortion advocates because Mr Roberts is seen widely as the ideological centrist of the court.<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The US Solicitor General Elizabeth Prelogar also spoke before the court today, arguing against the Mississippi abortion ban on behalf of the Biden administration.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;The real world effects of overruling Roe and Casey would be severe and swift,&#8221; she said, adding that women have come to rely on this &#8220;fundamental right&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-dm4ypg-ComponentWrapper-HeadlineComponentWrapper e1xue1i88\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-1nmw0uu-StyledHeading e1fj1fc10\">What are campaigners saying?<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">If the court strikes down Roe v Wade, or rules that the Mississippi law does not place an undue burden on women seeking abortions, at least 21 states are expected to introduce abortion restrictions, including outright bans after 15 weeks.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In these states, nearly half of US women of reproductive age (18-49) &#8211; some 36 million people &#8211; could lose abortion access, according to research from Planned Parenthood, a healthcare organisation that provides abortions.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Carol Tobias, president of anti-abortion group National Right to Life, told the BBC she was optimistic that the court would step in &#8220;to protect unborn children&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;We certainly hope that they will let the Mississippi law stand,&#8221; she said. &#8220;We&#8217;d love to see them go even further and say that unborn human beings deserve the same protection as born human beings&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Outside the Supreme Court, anti-abortion advocate Terri Herring told the BBC she had &#8220;high hopes&#8221; the court will throw out Roe v Wade entirely. It&#8217;s &#8220;overdue&#8221;, she said. &#8220;America is unsettled over abortion.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">But for other women in Washington on Wednesday, the possibility of pared back abortion access brings fear.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;I&#8217;m not shocked, but I&#8217;m scared,&#8221; said Olivia Dinucci. &#8220;Abortion still going to happen, people are going to do it no matter if it&#8217;s legal or not. said Katherine Franke, director of the centre for gender and sexuality law at Columbia University.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;We will see families descend into greater levels of poverty because the inability to take care of kids, rises in domestic violence,&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-dm4ypg-ComponentWrapper-HeadlineComponentWrapper e1xue1i88\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-1nmw0uu-StyledHeading e1fj1fc10\">Who gets abortions in the US?<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">There were about 630,000 reported abortions in the US in 2019\u00a0<a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.cdc.gov\/reproductivehealth\/data_stats\/abortion.htm\" target=\"_blank\" rel=\"noopener\">according to the US Centers for Disease Control<\/a>.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">This was an 18% decrease compared with 2010.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Women in their twenties account for the majority of abortions &#8211; in 2019 about 57% were in this age group.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Black Americans get abortions at the highest rate &#8211; Chief Justice John Roberts, who is now at the ideological centre of the court, seemed comfortable with such a result which, in and of itself, would constitute a major blow to Roe&#8217;s first-trimester abortion protections.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i85\" data-component=\"text-block\">\n<div class=\"ssrcss-17j9f6r-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">That may end up a best-case scenario for abortion-rights supporters at this point, however.
