In another lawsuit, Triller failed to inform a court that an investigation was underway and faces a case dismissal. In another, Triller faces dismissal due to lack of prosecution.<\/p>\n<p>Triller\u2019s\u00a0<a href=\"https:\/\/torrentfreak.com\/pirates-who-illegally-streamed-jake-paul-v-ben-askren-targeted-in-100m-lawsuit-210427\/\" target=\"_blank\" rel=\"noopener\">campaign<\/a>\u00a0to haul alleged Jake Paul vs. Ben Askren fight pirates into US courts hasn\u2019t been straightforward.<\/p>\n<p>After filing one big lawsuit, that was later\u00a0<a href=\"https:\/\/torrentfreak.com\/triller-wants-google-youtube-to-unmask-jake-paul-vs-ben-askren-pirates-210506\/\" target=\"_blank\" rel=\"noopener\">reduced to just one defendant<\/a>\u00a0by a judge, Triller began filing\u00a0<a href=\"https:\/\/torrentfreak.com\/triller-files-three-new-lawsuits-against-jake-paul-boxing-match-pirates-210528\/\" target=\"_blank\" rel=\"noopener\">individual complaints<\/a>\u00a0against some of the original defendants. Thus far, that venture hasn\u2019t gone particularly well.<\/p>\n<p>Last month in a California court, District Judge Fernando M. Olguin\u00a0<a href=\"https:\/\/torrentfreak.com\/jake-paul-fight-piracy-judge-dismisses-trillers-lawsuit-against-youtuber-210730\/\">dismissed<\/a>\u00a0Triller\u2019s lawsuit against YouTuber \u2018ItsLilBrandon\u2019 after failing to file for a default judgment supported by \u201cdetailed, clear, and thorough calculations\u201d indicating the scale of the damages sought.<\/p>\n<p>And now there are serious complications in other cases.<\/p>\n<h2>Judge Dismisses Case Against FilmDaily<\/h2>\n<p>The\u00a0<a href=\"https:\/\/torrentfreak.com\/pirates-who-illegally-streamed-jake-paul-v-ben-askren-targeted-in-100m-lawsuit-210427\/\" target=\"_blank\" rel=\"noopener\">original lawsuit<\/a>\u00a0that kicked off Triller\u2019s legal campaign now has just FilmDaily.com named as the sole defendant. This is interesting in itself since FilmDaily.com is not the domain Triller is complaining about \u2013 FilmDaily.co is.<\/p>\n<p>On July 30, Triller was again warned that the case against the site could be dismissed for lack of prosecution but Triller quickly responded with an appeal to the court not to dismiss the case.<\/p>\n<p>According to Triller, it has been conducting an investigation into FilmDaily but had failed to inform the court about that, a decision it now regrets. However, that investigation was apparently fruitful, with Triller able to identify the \u201ctrue identity\u201d of those behind the site.<\/p>\n<p>What is curious about Triller\u2019s recent response about FilmDaily is that it alleges (but does not show) that FilmDaily.co \u2013 which appears in most respects to be some kind of news portal \u2013 actually streamed the fight illegally.<\/p>\n<p>\u201cOn April 17, 2021, Defendant created and published a post titled \u2018Jake Paul vs Ben Askren \u2018Reddit\u2019 Live! Free Stream, How to Watch?,\u2019 providing a clickable link titled \u2018Click To Watch Paul vs Askren Live Stream Free.\u2019 A true and correct copy of the aforementioned post is attached hereto as Exhibit D,\u201d it reads.<\/p>\n<p>As the image of that exhibit shows, that text is indeed present. However, there\u2019s no evidence to show that the supposedly clickable link actually did anything or was tested, there are no screenshots of a fight being shown, and there is no explanation of why the same page advises people to visit Triller Fight Club and pay $49.99 to watch the event.<\/p>\n<p>&nbsp;<\/p>\n<p><center><a href=\"https:\/\/torrentfreak.com\/images\/triller-filmdaily-exhibit-d.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-207871 lazyloaded\" src=\"https:\/\/torrentfreak.com\/images\/triller-filmdaily-exhibit-d.png\" alt=\"Triller Filmdaily Exhibit\" width=\"550\" height=\"342\" data-src=\"https:\/\/torrentfreak.com\/images\/triller-filmdaily-exhibit-d.png\" \/><\/a><\/center>&nbsp;<\/p>\n<p>This is interesting in light of an\u00a0<a href=\"https:\/\/torrentfreak.com\/triller-sues-scam-streaming-site-accesstvpro-for-jake-paul-fight-piracy-219625\/\" target=\"_blank\" rel=\"noopener\">earlier lawsuit<\/a>\u00a0filed by Triller against a site called AccessTVPro. This platform bears all the hallmarks of a scam site that seems unlikely to have offered the fight since it appears to be a scammy bait-and-switch-type operation. Sites like these claim to have content, lure people in, then try to extract payment for stuff they don\u2019t have.<\/p>\n<p>Triller recently told the court that it\u2019s preparing a second amended complaint but none of that matters now. Triller was supposed to serve the defendant within 90 days of the filing of its complaint but failed to do so.<\/p>\n<p>\u201c[P]laintiff\u2019s Response, does not establish when it obtained information about the true identity of Defendant or why it did not seek an extension of time or otherwise attempt to prosecute this action. Plaintiff therefore does not establish good cause for the delay in timely serving Defendant,\u201d the court\u2019s order reads.<\/p>\n<p>\u201cPlaintiff\u2019s claim against Defendant is therefore dismissed under\u00a0<a href=\"https:\/\/www.law.cornell.edu\/rules\/frcp\/rule_4#:~:text=The%20plaintiff%20is%20responsible%20for,serve%20a%20summons%20and%20complaint.\" target=\"_blank\" rel=\"noopener\">Rule 4(m)<\/a>\u00a0without prejudice as a result of Plaintiff\u2019s failure to timely serve Defendant or establish good cause for that failure.\u201d<\/p>\n<p><em>(Order\u00a0<a href=\"https:\/\/torrentfreak.com\/images\/2-21-cv-03502-Triller-v-FilmDaily-Dismissal-Order-210809.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>, judgment\u00a0<a href=\"https:\/\/torrentfreak.com\/images\/2-21-cv-03502-Triller-v-FilmDaily-Dismissal-Judgment-210809.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>\u00a0\u2013 both pdf)<\/em><\/p>\n<h2>Man Sued For Saying He Watched Fight, Triller \u201cFailed to Litigate Case\u201d<\/h2>\n<p>On June 11, Triller filed a lawsuit in an Ohio court against an individual named Jerren Swords.\u00a0<a href=\"https:\/\/torrentfreak.com\/guy-who-bragged-on-triller-owners-instagram-that-he-pirated-jake-paul-fight-gets-sued-210614\/\">According to the complaint<\/a>, the Ohio resident made the mistake of taunting Triller co-owner Ryan Kavanaugh on Instagram, declaring that he\u2019d \u201cwatched the Jake Paul fight for free\u201d and there was nothing Kavanaugh could do about it.<\/p>\n<p>As it turned out, Triller was more than happy to step up with a lawsuit claiming that Swords had breached the Copyright Act and the Federal Communications Act while demanding at least $150,000 in damages.<\/p>\n<p>Triller followed up by executing a summons on Swords on June 16 and his answer to the complaint was due July 7. Thus far, Swords has failed to respond to the court and according to the judge, that could be enough for Triller to obtain a default judgment. However, Triller appears to have issues with its own legal filings.<\/p>\n<p>\u201c[P]laintiff has failed to make any effort to litigate this case since filing its Complaint. Thus, dismissal for lack of prosecution may also be warranted,\u201d Judge Michael R. Barrett warns in his order dated August 5, 2021\u00a0<em>(<a href=\"https:\/\/torrentfreak.com\/images\/1-21-cv-00401-Triller-Fight-Club-II-v-Swords-order-to-show-cause-210805.pdf\">here<\/a>, pdf)<\/em><\/p>\n<p>Triller responded to this order in a filing dated August 11, noting that it had served Swords on June 14 and on June 28, a man claiming to be Swords\u2019 father contacted counsel for Triller to discuss the complaint. Triller then wrote to Jerren Swords asking if he intended to retain counsel and whether he consented to Triller discussing the matter with his father.<\/p>\n<p>&nbsp;<\/p>\n<p><center><a href=\"https:\/\/torrentfreak.com\/images\/triller-letter-to-swords.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-207903 lazyloaded\" src=\"https:\/\/torrentfreak.com\/images\/triller-letter-to-swords.png\" alt=\"Triller letter to Swords\" width=\"550\" height=\"264\" data-src=\"https:\/\/torrentfreak.com\/images\/triller-letter-to-swords.png\" \/><\/a><\/center>&nbsp;<\/p>\n<p>Since then there has been no further communication so Triller is now seeking an entry of default judgment. As a result, Triller is asking the court not to dismiss the case.<\/p>\n<h2>Lawsuit Against Eclipt Gaming \/ Matthew Space<\/h2>\n<p>On June 3, 2021,\u00a0<a href=\"https:\/\/torrentfreak.com\/new-triller-lawsuit-targets-young-youtuber-for-jake-paul-fight-piracy-210604\/\" target=\"_blank\" rel=\"noopener\">Triller sued another YouTuber<\/a>\u00a0\u2013 Matthew Space \u2013 the alleged operator of the Eclipt Gaming channel. With just 2,250 subscribers at the time, the channel has specialized in GTA Online videos, with most getting just a few hundred views. According to Triller, Space posted the Jake Paul fight to his channel and it was watched 297 times.<\/p>\n<p>Despite the relatively small scale, Triller described Space\u2019s conduct as \u201ccalculated and reprehensible infringement\u201d, claiming that Space had somehow \u201cintercepted, received and\/or descrambled\u201d their satellite signals and is therefore liable for tens of millions of dollars in damages.<\/p>\n<p>On August 3, Judge Robert Gary Klausner wrote in an order to show cause\u00a0<em>(<a href=\"https:\/\/torrentfreak.com\/images\/2-21-cv-04603-Triller-v-Matthew-Space-Eclipt-Gaming-order-to-show-cause-210803.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>)<\/em>\u00a0that the action against Space could be dismissed for lack of prosecution. In a filing dated August 9, Triller said that it had served Space on June 8 so he was required to respond to the court before July 9.
