{"id":19136,"date":"2021-06-22T01:29:26","date_gmt":"2021-06-22T05:29:26","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=19136"},"modified":"2021-06-22T01:29:26","modified_gmt":"2021-06-22T05:29:26","slug":"us-supreme-court-sides-with-college-athletes-against-ncaa","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2021\/06\/22\/us-supreme-court-sides-with-college-athletes-against-ncaa\/","title":{"rendered":"US Supreme Court sides with college athletes against NCAA"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\"><b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">The US Supreme Court has ruled in favour of student athletes in a compensation row with the National Collegiate Athletic Association (NCAA).<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In a unanimous decision, the court said limits on education-related benefits for athletes cannot be enforced.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Under current NCAA rules, students cannot be paid, and scholarship money is capped at the cost of attendance.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The NCAA defended the rules as necessary to protect the distinction between amateur and professional sport.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">College sports generated $18.9bn (\u00a313.6bn) in 2019, according to the NCAA, but athletes are unpaid.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The NCAA, the main governing body of US collegiate sports, hosts 90 championships in 24 sports, which see more than 57,000 total participants each year.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i83\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-ve3352-StyledHeading e1fj1fc10\">What did the court say?<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The current and former athletes who filed the case had said the restrictions on compensation amounted to an unlawful restraint of trade.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">On Monday, the high court agreed, ruling that the NCAA&#8217;s curbs on non-cash payments, including benefits like computers, musical instruments, academic awards and paid internships, violates a federal law called the Sherman Antitrust Act &#8211; meant to outlaw monopolies in business.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The student athletes involved in the suit were members of top-tier basketball and American football teams, which generate the most revenue for the NCAA.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Writing for the court, Donald Trump nominee Justice Neil Gorsuch said that the NCAA had essentially sought &#8220;immunity from the normal operation of the antitrust laws&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In a concurring opinion, fellow conservative Justice Brett Kavanaugh noted that &#8220;the NCAA&#8217;s business model would be flatly illegal in almost any other industry in America.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;The NCAA is not above the law,&#8221; he said.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Monday&#8217;s decision upholds a ruling from a federal appeals court last year. The Biden administration had filed a brief in support of this lower court decision this March.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Jeffrey Kessler, the lead attorney representing the student athletes, said in a statement the &#8220;historic decision&#8221; is about the athletes, &#8220;especially those who will never join the pros&#8221;, Reuters news agency reported.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;Hopefully, it will also swing the doors open to further change, so that we can finally see a fair and competitive compensation system in which these incredible players get to benefit from the economic fruits of their labours and pursue their educational objectives.&#8221;<\/p>\n<div class=\"ssrcss-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i83\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-ve3352-StyledHeading e1fj1fc10\">What happens next?<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In Monday&#8217;s decision, the Supreme Court did leave room for the sports body to design rules around student benefits.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;If the NCAA believes certain criteria are needed to ensure that academic awards are legitimately related to education, it is presently free to propose such rules,&#8221; Justice Gorsuch wrote for the court.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">He added that any questions the organisation has over &#8220;the scope of its authority&#8221; with academic awards can be determined by the courts &#8211; but the NCAA has only requested such clarification once before.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;Before conjuring hypothetical concerns in this Court, we believe it best for the NCAA to present any practically important question it has in district court first.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The court&#8217;s ruling did not address the larger &#8211; and contentious &#8211; issue of whether student athletes can be paid.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The NCAA said it would examine whether student athletes can be compensated for the use of their names and images, allowing them to benefit from endorsements and marketing deals.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">NCAA President Mark Emmert said in a statement that the organisation remains committed to &#8220;working with Congress to chart a path forward&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The last time the country&#8217;s top court heard an NCAA case was in 1984.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">NCAA v the Board of Regents of the University of Oklahoma similarly looked at whether the sports body violated the Sherman Act with regards to controlling college football broadcast rights.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The court ruled 7-2 in favour of the university, and changed the way college football could be televised, leading to the billion-dollar TV contracts in place today.<\/p>\n<div class=\"ssrcss-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i83\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-ve3352-StyledHeading e1fj1fc10\">Not so amateur anymore<\/h2>\n<\/div>\n<div class=\"ssrcss-18mjolk-ComponentWrapper e1xue1i87\" data-component=\"image-block\">\n<figure class=\"ssrcss-md0xev-StyledFigure e34k3c23\">\n<div class=\"ssrcss-ab5fd8-StyledFigureContainer e34k3c21\"><span class=\"ssrcss-13t93ir-Placeholder e16icw910\"><img decoding=\"async\" class=\"ssrcss-1drmwog-Image ee0ct7c0\" src=\"https:\/\/ichef.bbci.co.uk\/news\/1536\/cpsprodpb\/27FB\/production\/_112953201__104759290_anthonyzurcher_tr-nc.png\" srcset=\"https:\/\/ichef.bbci.co.uk\/news\/240\/cpsprodpb\/27FB\/production\/_112953201__104759290_anthonyzurcher_tr-nc.png 240w, https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/27FB\/production\/_112953201__104759290_anthonyzurcher_tr-nc.png 320w, https:\/\/ichef.bbci.co.uk\/news\/480\/cpsprodpb\/27FB\/production\/_112953201__104759290_anthonyzurcher_tr-nc.png 480w, https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/27FB\/production\/_112953201__104759290_anthonyzurcher_tr-nc.png 624w, https:\/\/ichef.bbci.co.uk\/news\/800\/cpsprodpb\/27FB\/production\/_112953201__104759290_anthonyzurcher_tr-nc.png 800w, https:\/\/ichef.bbci.co.uk\/news\/976\/cpsprodpb\/27FB\/production\/_112953201__104759290_anthonyzurcher_tr-nc.png 976w\" alt=\"Analysis box by Anthony Zurcher, North America reporter\" width=\"1536\" height=\"306.11957796014065\" \/><\/span><\/div>\n<\/figure>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The NCAA, in defending its limits on compensation for college athletes, had argued that the unique amateur nature of university sport set it apart from other business practices in the US.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">A unanimous Supreme Court just disagreed. The same federal law that regulates massive industries and prevents anti-competitive activities also applies to intercollegiate athletics.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">For the moment, that means schools can give student-athletes modest cash payments and buy them laptop computers and other educational supplies, in addition to the free tuition, room and board many already receive.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">That, however, may just be the start.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">While the court didn&#8217;t go so far as to allow unlimited compensation to student-athletes, Monday&#8217;s decision opens the door to future lawsuits that seek exactly that.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In fact, Justice Brett Kavanaugh, in a separate opinion, seemed to welcome such an effort.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">It&#8217;s difficult to view big-time college sport in the US, with its celebrated March basketball tournament and billion-dollar autumn American football competition, as a bastion of amateur athletics anymore.
