{"id":19107,"date":"2021-06-17T17:43:59","date_gmt":"2021-06-17T21:43:59","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=19107"},"modified":"2021-06-17T17:46:54","modified_gmt":"2021-06-17T21:46:54","slug":"south-carolina-court-halts-executions-until-firing-squad-is-available","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2021\/06\/17\/south-carolina-court-halts-executions-until-firing-squad-is-available\/","title":{"rendered":"South Carolina court halts executions until firing squad is available"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\"><b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">A high court in the US state of South Carolina has blocked two executions until the inmates are given the choice of death by electrocution or firing squad.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">A new law requires inmates on death row to decide between the two methods if lethal drugs are not available.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">But as prison authorities have not yet formed a firing squad, the executions have been halted by the supreme court.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Inmates Brad Sigmon and Freddie Owens were due to be executed this month.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The convicted murderers were denied lethal injections &#8211; their favoured option &#8211; because prison authorities did not have the drugs needed.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">A shortage of these drugs has led to a 10-year pause in this method of execution in the state.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The new law, which came into effect last month, was designed to close a loophole that allowed inmates to indefinitely postpone their executions if the drugs were not available.<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Given the lack of a firing squad, electrocution was the only method of execution available in the state.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">But lawyers for Sigmon and Owens challenged the use of the method in court, arguing their clients have the right to die by lethal injection.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">They petitioned the South Carolina Supreme Court to stop the planned executions of their clients until their appeals had been heard.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<div class=\"ssrcss-1pzprxn-BulletListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li><a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-45835584\" target=\"_blank\" rel=\"noopener\">How many countries still have the death penalty?<\/a><\/li>\n<li><a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-55587260\" target=\"_blank\" rel=\"noopener\">Looking for answers in the life of a killer<\/a><\/li>\n<li><a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/in-pictures-53758533\" target=\"_blank\" rel=\"noopener\">Last meals on death row<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">On Wednesday, the court ruled in their favour, saying the inmates had not been given the choice &#8220;to elect the manner of their execution&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The court said no further execution notices should be issued until &#8220;protocols and policies to carry out executions by firing squad&#8221; are in place.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">In response to the court order, the state&#8217;s prison authorities said it was &#8220;moving ahead with creating policies and procedures for a firing squad&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;We are looking to other states for guidance through this process. We will notify the court when a firing squad becomes an option for executions,&#8221; the South Carolina Department of Corrections said.<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">South Carolina is one of four states that allow executions by firing squad. Oklahoma, Mississippi and Utah are the others.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Sigmon, 63, was scheduled to be executed on Friday. He has spent nearly two decades on death row after he was convicted in 2002 of killing his ex-girlfriend&#8217;s parents with a baseball bat.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Owens&#8217;s execution was planned for 25 June.
