{"id":18873,"date":"2021-05-20T07:20:33","date_gmt":"2021-05-20T11:20:33","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=18873"},"modified":"2021-05-20T07:20:33","modified_gmt":"2021-05-20T11:20:33","slug":"pip-implant-victims-elated-by-compensation-win","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2021\/05\/20\/pip-implant-victims-elated-by-compensation-win\/","title":{"rendered":"PIP implant victims &#8216;elated&#8217; by compensation win"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p><b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">More than 2,500 women who were victims of the PIP breast implant scandal should receive compensation, a French appeal court has decided.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>The women involved, including 540 Britons, say they are elated and exhausted after 10 years of fighting for justice.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>The court also upheld an earlier judgement which found German company TUV Rheinland negligent.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>It awarded safety certificates for the faulty implants.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>The court decision could have far-reaching implications for thousands of other victims.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<div class=\"ssrcss-1pzprxn-BulletListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li><a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-48132572\" target=\"_blank\" rel=\"noopener\">PIP breast implant scandal: Victims visited by bailiffs<\/a><\/li>\n<li><a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/health-18057761\" target=\"_blank\" rel=\"noopener\">PIP breast implants: &#8216;serious lessons must be learned&#8217;<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Jan Spivey, one of the women in the case, was given PIP implants after she had a mastectomy due to breast cancer.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>After hearing the decision, she said she was &#8220;elated and exhausted&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;It&#8217;s been a very long journey,&#8221; she said.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;We&#8217;ve been in and out of court, and that&#8217;s been really difficult for women. We&#8217;ve got health issues and we&#8217;ve got lots of other responsibilities too &#8211; PIP has had an impact on the whole of our lives.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;It&#8217;s been an inescapable issue.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Jan developed aching joints, pain and fatigue after having the implants, and once they were removed it was clear they had been leaking silicone into her body.<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;My PIP implants from 20 years ago are still impacting on my life and my health and my wellbeing, even today,&#8221; Jan said.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;I think I&#8217;ve been angry every single day for the 20 years I&#8217;ve been affected by PIP.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Olivier Auma\u00eetre, the lawyer representing Jan Spivey and around 2,700 others in the current case, said it was an historic day for the victims and for women&#8217;s rights. He said the company would now have to fully compensate all the victims.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;I&#8217;m very happy for all the women I represent who have waited for such a long time for this decision and suffered for such long periods,&#8221; he said.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i83\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-qozapo-StyledHeading e1fj1fc10\">&#8216;Amazing victory&#8217;<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Another woman affected by the case, Nicola Mason &#8211; who had breast implants which then ruptured &#8211; said the court decision was &#8220;a victory, it&#8217;s amazing&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;We&#8217;ve waited a long time for this,&#8221; she told the Today programme on BBC Radio 4.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Nicola first found out about the rupture when she was pregnant, after noticing a large lump under her arm.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>She said it was &#8220;quite traumatic and there was absolutely nothing I could do&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Eventually, the implants were removed but she says she has been left with a massive lump of silicone under her arm which still flares up.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;I don&#8217;t think anyone knows the long-term effects,&#8221; she says.<\/p>\n<div class=\"ssrcss-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i83\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-qozapo-StyledHeading e1fj1fc10\">Cheap silicone<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Between 2001 and 2010 the substandard implants were manufactured by the French company Poly Implant Proth\u00e8se or PIP.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>It was liquidated in 2010 and its founder was later given a prison sentence after it emerged the implants were filled with cheap, industrial-grade silicone which was not cleared for human use.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>It is estimated up to 400,000 women worldwide have received the illegal implants.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Latin America was worst hit, in particular Colombia, where there are estimated to be 60,000 victims. In the UK it is thought 47,000 women are affected.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>The case, known as TUV1, was the first to be brought, a decade ago, against TUV Rheinland which issued European safety certificates for the PIP implants.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Lawyers for the German company said they challenged today&#8217;s court&#8217;s decision for holding the company liable, &#8220;even partly&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;The evidence in this case clearly shows that T\u00dcV Rheinland acted diligently, in compliance with applicable regulations,&#8221; they said.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>At no time, the company said, had it been aware that breast implants manufactured by PIP were not compliant.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>The ruling is expected to have wider implications for almost 20,000 other women, half of whom are British, who are taking similar legal action in France.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-18mjolk-ComponentWrapper e1xue1i87\" data-component=\"image-block\">\n<figure class=\"ssrcss-1pvhdts-StyledFigure e34k3c23\">\n<div class=\"ssrcss-ab5fd8-StyledFigureContainer e34k3c21\"><span class=\"ssrcss-1hq4gmv-Placeholder e16icw910\"><img loading=\"lazy\" decoding=\"async\" class=\"ssrcss-1drmwog-Image ee0ct7c0\" src=\"https:\/\/ichef.bbci.co.uk\/news\/976\/cpsprodpb\/DE91\/production\/_118577965_alifie.jpg\" srcset=\"https:\/\/ichef.bbci.co.uk\/news\/240\/cpsprodpb\/DE91\/production\/_118577965_alifie.jpg 240w, https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/DE91\/production\/_118577965_alifie.jpg 320w, https:\/\/ichef.bbci.co.uk\/news\/480\/cpsprodpb\/DE91\/production\/_118577965_alifie.jpg 480w, https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/DE91\/production\/_118577965_alifie.jpg 624w, https:\/\/ichef.bbci.co.uk\/news\/800\/cpsprodpb\/DE91\/production\/_118577965_alifie.jpg 800w, https:\/\/ichef.bbci.co.uk\/news\/976\/cpsprodpb\/DE91\/production\/_118577965_alifie.jpg 976w\" alt=\"Alifie Jones\" width=\"976\" height=\"549\" \/><\/span><\/div><figcaption class=\"ssrcss-1rnnz6t-StyledFigureCaption e34k3c22\">Alifie Jones had her implants removed<\/figcaption><\/figure>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&nbsp;<\/p>\n<p>Alifie Jones is at home with her son where she has been recovering after having her faulty PIP breast implants removed &#8211; just last month.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>She was finally convinced by a friend to take them out after suffering years of extreme exhaustion and debilitating pain.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>She says the worst thing about it was wondering why she felt so ill all the time: &#8220;Not knowing what it was, the mysterious illnesses, not being able to exercise. Not being vibrant, having my life, sort of stolen from me in a way.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>The surgeon was shocked by what he found when he removed one of the implants. It had broken into multiple pieces inside her &#8211; exposing her body to an industrial-grade silicone gel.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;I can&#8217;t believe they were allowed to be implanted in me. I don&#8217;t know how they got through regulations.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;But I feel guilty that I messed about with my body and I put them in in the first place.
