{"id":18817,"date":"2021-05-12T06:01:11","date_gmt":"2021-05-12T10:01:11","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=18817"},"modified":"2021-05-12T06:01:11","modified_gmt":"2021-05-12T10:01:11","slug":"nra-bankruptcy-us-judge-dismisses-case","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2021\/05\/12\/nra-bankruptcy-us-judge-dismisses-case\/","title":{"rendered":"NRA bankruptcy: US judge dismisses case"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p><b class=\"ssrcss-hmf8ql-BoldText e5tfeyi3\">A US judge has dismissed a bankruptcy case involving the National Rifle Association (NRA), leaving it to face a lawsuit that could see the powerful organisation dissolved.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>In a written statement, the judge said gun-rights group did not file for bankruptcy in good faith.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Last year,\u00a0<a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-53684033\" target=\"_blank\" rel=\"noopener\">New York&#8217;s attorney general Letitia James filed a lawsuit<\/a>\u00a0accusing the NRA of financial mismanagement.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>The NRA described the move as a &#8220;baseless, premeditated attack&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>It declared bankruptcy in January.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<div class=\"ssrcss-1pzprxn-BulletListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li><a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-41488081\" target=\"_blank\" rel=\"noopener\">America&#8217;s gun culture in charts<\/a><\/li>\n<li><a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-49574445\" target=\"_blank\" rel=\"noopener\">NRA declared &#8216;domestic terrorist organisation&#8217;<\/a><\/li>\n<li><a class=\"ssrcss-9nsdc6-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-35261394\" target=\"_blank\" rel=\"noopener\">Why is US gun lobby NRA so controversial?<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Tuesday&#8217;s hearing focused on whether the group should be allowed to establish itself legally in Texas instead of New York, where it faces the lawsuit.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Although its headquarters are in Virginia, the NRA was chartered in New York in 1871 as a non-profit organisation and it is incorporated in the state.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;The court believes the NRA&#8217;s purpose in filing bankruptcy is less like a traditional bankruptcy case in which a debtor is faced with financial difficulties or a judgment that it cannot satisfy and more like cases in which courts have found bankruptcy was filed to gain an unfair advantage in litigation or to avoid a regulatory scheme,&#8221; Judge Harlin Hale wrote.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>&#8220;Excluding so many people from the process of deciding to file for bankruptcy, including the vast majority of the board of directors, the chief financial officer, and the general counsel, is nothing less than shocking,&#8221; the judge added.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i84\" data-component=\"text-block\">\n<div class=\"ssrcss-18snukc-RichTextContainer e5tfeyi1\">\n<p>Tweeting after the ruling was issued, Ms James wrote: &#8220;The NRA does not get to dictate if and where it will answer for its actions, and our case will continue in New York court.
