{"id":18675,"date":"2021-04-26T08:27:20","date_gmt":"2021-04-26T12:27:20","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=18675"},"modified":"2021-04-26T08:27:20","modified_gmt":"2021-04-26T12:27:20","slug":"us-teens-snapchat-rant-reaches-supreme-court-in-free-speech-case","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2021\/04\/26\/us-teens-snapchat-rant-reaches-supreme-court-in-free-speech-case\/","title":{"rendered":"US teen&#8217;s Snapchat rant reaches Supreme Court in free speech case"},"content":{"rendered":"<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p><b class=\"ssrcss-14iz86j-BoldText e5tfeyi0\">A teenager&#8217;s rant that led to her getting kicked off her cheerleading team has reached the US Supreme Court.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Brandi Levy sent a profanity-laden post to her friends on Snapchat in 2017, venting her frustrations with cheerleading and her school.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>But when coaches at the Pennsylvania school discovered the post, she was barred from the squad for a year.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>The case will determine whether schools have the right to punish pupils for what they say off-campus.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>It is being viewed as a major test of the US Constitution&#8217;s First Amendment, which protects free speech rights.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Arguments in the case will begin on Wednesday.<\/p>\n<\/div>\n<\/div>\n<div id=\"piano-inline1\"><\/div>\n<div class=\"ssrcss-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i84\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-qozapo-StyledHeading e1fj1fc10\">What was in the post?<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Ms Levy, then 14, posted the snap &#8211; a combination of photo and text that disappears after 24 hours &#8211; when she was upset about not being chosen for the varsity cheerleading team.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>She posted it on a Saturday while at the Cocoa Hut, a 24-hour convenience store in Mahanoy City. The shop is not part of the school.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>It showed her with her middle finger raised, and her caption contained a four-letter swear word directed at cheerleading, softball, school, and &#8220;everything&#8221; generally.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>The post was screenshotted by a friend and shown to another pupil, who was the daughter of one of the cheerleading coaches at Mahanoy Area High School.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>The coaches then suspended Ms Levy from the team for a year.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>She then sued the Mahanoy Area School District, arguing that the decision breached her First Amendment right to free speech.<\/p>\n<\/div>\n<\/div>\n<div id=\"piano-inline2\"><\/div>\n<div class=\"ssrcss-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i84\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-qozapo-StyledHeading e1fj1fc10\">What is Ms Levy&#8217;s argument?<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Ms Levy, now 18, says the photo was posted from an off-campus location on a non-school day &#8211; meaning the school did not have the authority to discipline her for it.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Pupils&#8217; speech is protected by a landmark Supreme Court case from 1969, Tinker vs Des Moines Independent Community School District, when pupils wore black armbands to protest against the Vietnam War.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>The court in that case ruled that pupils&#8217; speech was protected as long as it didn&#8217;t cause &#8220;material and substantial&#8221; disruption to the school.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<div class=\"ssrcss-1pzprxn-BulletListContainer e5tfeyi3\">\n<ul role=\"list\">\n<li><a class=\"ssrcss-hiczm3-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-46886367\" target=\"_blank\" rel=\"noopener\">How far do free speech protections go in the US?<\/a><\/li>\n<li><a class=\"ssrcss-hiczm3-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/technology-51658341\" target=\"_blank\" rel=\"noopener\">YouTube does not have to guarantee free speech<\/a><\/li>\n<li><a class=\"ssrcss-hiczm3-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/stories-41851771\" target=\"_blank\" rel=\"noopener\">I lost my job over a Facebook post<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>When Ms Levy&#8217;s case reached the Court of Appeal last year, the court in Philadelphia ruled in her favour. It said that the 1969 ruling did not give school officials the authority to discipline pupils for things they say off-campus.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>The court emphasised that this ruling did not consider &#8220;the First Amendment implications of off-campus student speech that threatens violence or harasses others&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Ms Levy told the Associated Press news agency: &#8220;I&#8217;m just trying to prove a point that young students and adults like me shouldn&#8217;t be punished for expressing their own feelings and letting others know how they feel.&#8221;<\/p>\n<\/div>\n<\/div>\n<div id=\"piano-inline3\"><\/div>\n<div class=\"ssrcss-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i84\" data-component=\"crosshead-block\">\n<h2 class=\"ssrcss-qozapo-StyledHeading e1fj1fc10\">What does the school say?<\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>After the Court of Appeal ruling last year, the school district asked the Supreme Court to take up the case.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>It argues that staff commonly take action against pupils for speech and actions that happen off-campus &#8211; and that in recent times this has become more important, as pupils learning remotely due to Covid-19 has blurred the lines between off-campus and on-campus communications.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>It also says that, as Ms Levy&#8217;s Snapchat post was sent to her school friends and fellow cheerleaders, it disrupted the school community.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>The district argues that a decision in favour of the teenager would make it more difficult for schools to police bullying, racism and harassment that occurs outside of school hours on social media.<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-56886687\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">A teenager&#8217;s rant that led to her getting kicked off her cheerleading team has reached the US Supreme Court.
