move away from a &#8220;merits-based approach&#8221; in 2016-18 was &#8220;unlawful&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>The group had claimed the change led to a &#8220;shocking and unprecedented&#8221; fall in rape cases leading to criminal charges.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>But the court agreed with the CPS that the change in guidance &#8220;was not a change of legal substance&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>End Violence Against Women (EVAW) had been aiming to show there was a change in policy in the way the CPS handled rape cases, and that the way the prosecutors went about that change was unlawful.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>During the hearing,\u00a0<a class=\"ssrcss-hiczm3-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-55816219\" target=\"_blank\" rel=\"noopener\">the group had said the CPS adopted what is known as the &#8220;bookmaker&#8217;s approach&#8221;<\/a>\u00a0to cases, which saw prosecutors considering what may happen based on past experience of similar cases, rather than its earlier &#8220;merits-based approach&#8221; based on objective assessment of the evidence in that case alone.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Legally binding guidance on the old approach was removed in 2017, and the CPS introduced a 60% conviction rate target in relation to rape cases.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>EVAW&#8217;s lawyers had argued both the volume of cases and the charging rate fell following this change in guidance.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>They cited figures showing an average of 3,446 rape cases were charged per year between 2009 and 2016, compared with 2,822 in 2017, a fall of 23%.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>At the same time the charging rate &#8220;declined precipitously&#8221; from 56% in 2016, to 47% in 2017 and 34% in 2018.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<div class=\"ssrcss-1pzprxn-BulletListContainer e5tfeyi3\">\n<ul role=\"list\">\n<li><a class=\"ssrcss-hiczm3-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-48095118\" target=\"_blank\" rel=\"noopener\">Why are rape prosecutions falling?<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Andrea Simon, End Violence Against Women&#8217;s director, said the group was &#8220;deeply disappointed&#8221; by the dismissal.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>She said the court had &#8220;given the CPS the benefit of the doubt&#8221; and &#8220;we still lack alternative answers&#8221; to why rape prosecutions have fallen.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>&#8220;Thousands of rape victims continue to be let down by a broken criminal justice system,&#8221; Ms Simon added.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>The Lord Chief Justice Lord Burnett, sitting with Lord Justice Holroyde and Lady Justice Elisabeth Laing, said: &#8220;We do not consider that it was unlawful to decide to remove references to the merits-based approach from the Director of Public Prosecution&#8217;s legal guidance.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>&#8220;Stripped of references to the merits-based approach, the remaining guidance is not unlawful.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<p>Lord Burnett added: &#8220;We reject the submission that the decision created any risk of systemic illegality.&#8221;<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-56402068\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">The Court of Appeal has dismissed a legal challenge against the Crown Prosecution Service over its policy on prosecuting serious sexual offences.
