But Montgomery&#8217;s lawyers argued that the date could not be set while a stay was in place.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>A court sided with her attorneys, stopping an order from the director of the Bureau of Prisons scheduling her death.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>But on Friday,\u00a0<a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.chicagotribune.com\/nation-world\/ct-nw-federal-execution-lisa-montgomery-20210101-hj2siswnmfaxjimegqp4xh7ni4-story.html\" target=\"_blank\" rel=\"noopener\">a panel of judges concluded that the director had acted under the law<\/a>, allowing the execution to take place.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"unordered-list-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<div class=\"css-1pzprxn-BulletListContainer e5tfeyi3\">\n<ul role=\"list\">\n<li><a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-55236260\" target=\"_blank\" rel=\"noopener\">In Trump\u2019s final days, a rush of federal executions<\/a><\/li>\n<li><a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-49122869\" target=\"_blank\" rel=\"noopener\">US resumption of federal executions criticised<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Montgomery&#8217;s legal team said they will\u00a0<a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/edition.cnn.com\/2021\/01\/01\/politics\/lisa-montgomery-execution-date\/index.html\" target=\"_blank\" rel=\"noopener\">file a petition for the judges to reconsider their ruling<\/a>.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The last woman to be executed by the US government was Bonnie Heady, who died in a gas chamber in Missouri in 1953, according to the Death Penalty Information Center.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Federal executions had been on pause for 17 years before President Donald Trump ordered them to resume earlier last year.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>If the remaining executions go ahead, Mr Trump will have overseen the most executions by a US president in more than a century.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Montgomery&#8217;s execution date is just days before President-elect Joe Biden takes office.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Mr Biden, who for decades was a fierce supporter of the death penalty as a Delaware senator, has now said he will seek to end federal executions once he takes office.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i84\" data-component=\"crosshead-block\">\n<h2 class=\"css-qozapo-StyledHeading e1fj1fc10\">Who is Lisa Montgomery?<\/h2>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>In December 2004, Montgomery drove from Kansas to the home of Bobbie Jo Stinnett, in Missouri, purportedly to purchase a puppy,\u00a0<a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.justice.gov\/opa\/pr\/executions-scheduled-two-federal-inmates-convicted-heinous-murders\" target=\"_blank\" rel=\"noopener\">according to a Department of Justice press release<\/a>.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>&#8220;Once inside the residence, Montgomery attacked and strangled Stinnett &#8211; who was eight months pregnant &#8211; until the victim lost consciousness,&#8221; it says.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Montgomery cut into Stinnett&#8217;s body to remove the baby, which she took with her in an attempt to pass it off as her own.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>In 2007, a jury found Montgomery guilty of federal kidnapping resulting in death, and unanimously recommended a death sentence.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>But Montgomery&#8217;s lawyers say she experienced brain damage from beatings as a child and is mentally unwell, so should not face the death penalty.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i84\" data-component=\"crosshead-block\">\n<h2 class=\"css-qozapo-StyledHeading e1fj1fc10\">Federal and state executions &#8211; what&#8217;s the difference?<\/h2>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Under the US justice system, crimes can be tried either in federal courts, at a national level, or in state courts, at a regional level.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Certain crimes, such as counterfeiting currency or mail theft, are automatically tried at a federal level, as are cases in which the US is a party or those which involve constitutional violations.<\/p>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The death penalty was outlawed at state and federal level by a 1972 Supreme Court decision that cancelled all existing death penalty statutes.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>A 1976 Supreme Court decision allowed states to reinstate the death penalty and in 1988 the government passed legislation that made it available again at federal level.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>According to data collected by the Death Penalty Information Center, 78 people were sentenced to death in federal cases between 1988 and 2018 but only three were executed.<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-55513158\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">A US appeals court has lifted a stay of execution on the only woman awaiting a federal death penalty.
